I am reposting my message on this forum as I think it is more relevant:

My situation is somewhat involved. In principle I would like to do everything according to the law, but I think in my particular situation, whatever I do, it will be confusing and not 100% compliant.

Both me any my wife are in the process of applying for citizenship. By law, our son is required to apply for a GC renewal after he turns 14, even though his green card says it is valid until 2022. There is a rule that if we apply for the renewal within 30 days after his birthday, the only fee we pay is a biometric fee. We could take advantage of this 30-day rule and submit an I-90 application now, but processing usually takes a few months, up to 6 months. Assuming the optimistic scenario that we pass our interviews with no problems, we could naturalize within 30 days from now, which would render our kid's application moot - he becomes a citizen before his new green card is issued. But there are opinions, which I found by googling around, that since his green card is not valid after he is 14 years old, it cannot be used for applying for a passport. But the new card cannot be issued, since according to USCIS he is an US citizen before they complete his GC replacement process.

I think this is a very theoretical question, as for all practical purposes it is best not to apply for the GC replacement at this very moment. But can be his old green card contested by the State Department when applying for a passport? Is any way to find a legally correct solution or we are facing legal entanglement that cannot be solved?

I found that a very few people are aware that a 14-years old green card holder is required to renew his/her green card, that also includes CBP agents.

That is very old topic and I am not sure I do the right thing trying to revive it now.

There is no requirement that you must bring your passport photos to the interview, similar to the requirement that you have to bring your photo ID. But people are occasionally asked for photos, even if they do not change their names. The reason is that, sometimes, the pictures taken during fingerprinting are not good. So think of it as additional insurance: you can have them handy or you can send them later which will slow the process down slightly. There is 95% chance that you will not be asked for the photos.

Good work and nice analysis! I posted a similar thing in the March 2017 thread. My focus was Raleigh. Your field office is quite busy and slow compared to Raleigh where my case is processed, so it could be that it is entirely backlog-related problem, not background checks. Also, my experience shows that the online status for paper-based applications is not reliable and not always updated.

I also entered around ~250 cases that follow my case but it was only around 4-6% still in "fingerprint appointment scheduled". I do not understand why your numbers show it is almost a third.

I have probably spent as much time as you in BG checks but I have a rather optimistic attitude in the sense that I think it could be worse. Sure, I am disappointed since it took them 73 days to approve my green card so my expectations were high. There is a law mandated rule that USCIS MUST make a decision within 120 days after the interview and this is why they do not schedule interviews before they know everything they needed to know.

We would need to gather more data to make statistically significant conclusions. My theory is only based on the assumption that it would make much more sense to double check EB applicants, as with marriage based applicants the only thing you need to verify is the marriage itself and a clear criminal history. In case of EB you might need to check the employment history, possibly verify salary, maybe check whether the applicant is a recipient of food stamps or similar programs.

It is possible that every one of us will get stuck, e.g. they ask for your criminal history from your home country and the response takes a few months to arrive at USCIS.

I would expect that they should have it done before you are invited to the interview and what happened to you now is just a true oversight. Fairly large number of applicants report that they get "Decision cannot be made" and after that they are quickly approved (unless they are CARRP). But I would say you (and me) are still lucky. Out of 243 cases that I checked around me, 11 is still in "fingerprint scheduled", which is 4.5%. I am really curious whether my theory about thorough background checks of EB applicants is true, as EB immigration is only about 10% of the total GC issued.

It is possible, but as I said before, it is only my working hypothesis that EB applicants are double checked. I do not have enough data. Employment-based green cards also experience high level of fraud and I think it is OK if they are verified, like e.g. you applied for advanced degree GC but your later carrier shows completely different path and you are a chef, or you had a green card sponsored by an employer and you quit right after getting your permanent residence status, not to mention that you might be a public charge. With marriage-based GC, if you are still married to the same person and, even better, you have kids together, there is nothing to contest.

Please let us know once you get more info. I am not sure whether this is a pattern, but my impression is that employment-based GC holders might face extra scrutiny. I am EB2-NIW myself, so it could be that my relatively late update to the "in-line" status (together with my wife) is related to extra verification of the GC application. Once they grant you citizenship it will be extremely difficult to reverse it without serious crimes you might have committed before you naturalize (like genocide).

My understanding is that as long as you are on non-immigrant visa you should not register, so you are good to go.

I was curious what is your status. From my experience, as long as you are not in-line, your file is in Missouri at NBC and Raleigh does not have it under their control yet. They let me off the hook recently, on September 7th, and my case moved right away. I think you can now definitely place a service request saying that your case is out of normal processing.

@Yuliya LipinaIt could mean anything, maybe the guy does not like immigration at all, or maybe he despises "chain immigration". Whatever the reason he cannot legally deny citizenship based on your plans to bring family members, but he certainly can delay the case.

Congratulations!

Raleigh is relatively fast, I would have finished the process if my case were not being held at NBC for so long. Other people who are in-line just wait for their local offices backlogs to clear.

I have received an interview letter in the mail today. It was a great surprise, since my online status has never changed from "in-line" to "appointment scheduled".

I still have my service request pending and I am in-line according to the egov website. So it is true that some people do not get their electronic notifications.

Welcome! I would recommend reading another thread. I read all the posts there. You could also browse through monthly reports, but this is painful, since the relevant information is scattered.

My own experience shows that being in-line is significant and it enables interview scheduling. It also seems that whatever USCIS says verbally does not matter. I would even dare to say that they lie or distort the truth. A service request is slow but reliable as USCIS is quite careful about what it says in writing. It also gives you a chance of real case review by someone who has permissions and power do make any changes.

Not at all. I have placed SR on my case on Aug 24th while my wife's case was left undisturbed. This SR is still listed as unassigned. My wife's case has moved to in-line on September 1st and her appointment was scheduled on September 6th. My case has moved to in-line a day after that (09/07) and no interview is scheduled yet, which additionally took me by surprise. Since Raleigh is one of the fastest offices, I expected I am already in the bucket of old cases and I should have an interview scheduled quickly, but no, It seems another wait is coming.

It might probably seem hilarious why I get inpatient after just 4 days from the time I was placed "in-line". It all depends on context. At least two users in this thread reported getting the "interview scheduled" notification on the very next day after they were placed in-line (and the "in-line" change also had happened after a 4 month delay), my wife got her notification 2 working days after being placed in-line, so I do not know why after 4 days I only have radio silence. Could be the service request? Or sudden surge of background clearances in cases older that mine? Maybe interviews are scheduled in large batches every week or two? Who knows, but as soon as anything changes I will report it here.

USCIS is full of surprises.

Did they put you "in line" or you still are in the fingerprint appointment phase? I think only paper-based responses from USCIS are credible. Have you tried placing a service request?
