    Some people who just overstay a day or 2 get it done at NAIA on the way out or get an extension before leaving the airport. You might check with philippine immigration upon arrival if this would be possible.

    If it is a unlocked GSM phone you can. If it is a CDMA phone, which most in the USA are you cant. What is make and model of phone?

    it's gsm, bought new, motorola c139. will i need 2 activate it w/ cingular b4 it's unlocked, or the fact that its brand new means its already unlocked? thx

    Im not sure if its unlocked or not, my nokia was locked but I dont have any experience with a motorola. You might want to buy a sim card with roaming emabled on ebay and put it in the phone to know for sure if its unlocked..thats what I did once.

  3. I think you are being poorly served by your lawyer. No competent lawyer will guarantee results. As PW said I hope you have the guarantee in writing, which I doubt, because in most states you cannot sue for legal malpractice unless a guarantee is in writting and as I say no competent lawyer will make such a foolish guarantee.

    What is the guarantee...to give your fee back? Well fine but what about all the time you have wasted going down this path. The law is quite clear you are not entitled to the visa until she is free to marry and she is not free to marry until she is 18. You might direct your lawyers attention to FAM 41.81 and the notes, but get the guarantee in writing first :D

  4. My wife is from the Philippines and is considerably younger than me but every day she makes me feel like a king. I can't believe how affectionate, warm and caring she is. She actually helped me take care of my grandson over the weekend and is so wonderful with children, I was amazed. I am sold on Filipinas and think they are just about perfect!

    I'd disagree...they are perfect, not just about :D

  5. The sex in tourism act reference to 18 refers to paid sex...which I assume is not happening. The application to other situations depends on the law of consent in the petitioners home state.

    But it is a concern espically because many young women in third world countries may be inclined to lie about their age. The embassy will advise a prospective petitioner to stay far away from her until you are 100% sure she is 18...they will even advise you have a private detective verify her story before you become involved.

    Given that fact I'd be very hesitant to consider even filing a petition until she is 18. There really is no hurry...

  6. has anyone lived and worked in the philippines while waiting for the process to complete? i'm considering this but cant find a position to fill or exactly where to look...any suggestions?

    Also if you happen to get a job dont forget that you need a work permit. I have heard some very bad stories about foriegners being caught working without one... it will cost you alot ...

    Are you aware she will have to go to the CFO seminar before she can leave the country and get a passport? additionally she need a stamp to actually get on the plane. She is not going to get that...until she is 18.

    You may think the question is marrying in the us, but the embassay and the philippine government do not. The fact is she is not free to marry anywhere until she is 18. The embassy wont give you the visa and the philippine government wont let her out of the country...

    Tell me, suppose she could get married here...how would she get her Philippine passport changed to her married name if the government of the philippines says the marriage is void. Remember marriage to a philipino under the age of 18 even with parental consent is void.

    This is just one example of the can of worms trying to do this opens up. I'm not trying to rain on your parade but its not going to happen til she turns 18.

  8. Im sorry your worried but as I say the embassy will not approve you until she turns 18 because she is not free to marry. They are likely to send the petition back to the USCIC without even scheduling an interview.

    I have dealt with the manila embassy with a 17 year old fiance and it was not a pleasant experience. They will not approve the petition until she turns 18.....thats the end of the story...sorry.

    Additionally, even should you decide to marry there and try to get your certificate of legal capacity to marry ahead of time the manila embassy will not issue it because she is 17 and not not free to marry...

    I've done this and tried this in manila within the last year so I am confident things have not changed.. :(

  9. You have a problem. She needs to be free to marry in the philippines and in the usa. A marriage to someone in the philippines under the age of 18 is void even with the consent of the parents. So even if you somehow could marry in the usa the philippines will not recognize the marriage as valid.

    But this is all moot because the manila embassy will not approve the petition until she is 18.

  10. I've sent 3 global priority to my fiancee. All of them got there. Fastest was 10 days, longest was 2 weeks and she lives in the provinces in a small town. I checked on sending her a package fed ex one time, they said they could do it and it would only cost me $500.00 LOL! The guy at fed ex freaked out and said let me check that again, verified her city,country and zip and all that and he says yup it's $500. So not sure fed -ex is a good option unless your fiance lives in a large city unless something has changed very recently.

    With Fedex up to 8 ounces is about 48 bucks. One pound is 100....and it goes up from there.

    I try to keep it to less than 8 ounces :D

  11. I sent a USPS global priority once it took about 2 weeks, she had to go to the postoffice and pick it up. Ive sent 2 by regular mail she never received either.

    If she really needs something I send Fed Ex, takes 2-3 days. I also enclose a Fedex for me is she needs to return something. That way can get something sent and returned in under a week.

    DHL may be about as fast but they dont get out of manila very far..

    I'd like to thank the good Capt and Aussie for making it clear a time line is not mandatory.

    The reason I posted was that I came here for information and many posts no matter how trivial the question had some do good timeliner telling the poster to update the time line..I thought I had messed something about the rules ... us paranoid types are prone to do that :hehe:
