  1. Hello Everyone,

     

    Just like @roralau, my visajourney has come to a happy ending. After 10 months of waiting, i had a nice interview this morning at USCIS Santa Ana, CA and subsequently had my oath-taking all same day. 
     

    It was a combo interview (I571 and N400) I had this morning. It was a hard core, in-depth scrutiny from the adjudicator at the beginning but we ended up havin a nice chat towards the end!

     

    I wish everyone a happy journey here! You’ll have yours soon. Claim it!!!

    It should be there before this week ends.. if not, it might take until early next week. My card was mailed to me right before it online status changed lol. Some went to have the online status changed to approved before mailed. Mine jumped from production to mailed. It differs in many many cases.

     

    But the good news is that you were approved and you will receive it real soon.. Congratulations! See you at RoC.. :)

    Thanks!! Actually, 3 minutes after I posted this I received a text saying my green card is being produced!!! The email said August 2nd which is yesterday when I had my interview :) I'm excited!! The I130 is being reviewed whatever that means but I'm happy!! 

    That's it! You will get your greencard in the next 7-10 days! I am so happy for you!

    I just wanted to add that the DS-3025 is included in the medical report that is in the sealed envelope you hand over at POE. So USCIS already have the original, however, that medical report is put in your A-file and most often USCIS doesn't manage to connect that file with your application. That's why we should send a copy of the DS-3025 with our AOS package - USCIS already knows we passed the medical in our home countries or else we wouldn't have been granted the visa. The vaccinations aren't a requirement to get the visa however, that's why they're interested in the vaccination work sheet to see if it's marked complete or not, since it's a requirement for the AOS. Wouldn't surprise me one bit if they never bother to look at the whole medical report at all (since they already know we passed it).

    That being said means that as K1 visa holders, the only proof that we have a complete medical exam is through DS-3025. If that is the case, we can contend that the 1 year validity starts at time of the submission of the packet.

     

    We are all being inquisitive as to what exactly is the validity of the medical examination. Each of them has their own interpretation in which the only thing we can do is to hope that the person adjudicating our case has the same interpretation as ours. Only receiving an RFE will determine how they understood the whole of it.

    EDIT, the i-693 seems to have a littel different rule than the foreign medical exam.     I have read what are inside those links over and over again and from what is clear, "it is valid for 1 year from the time it was submitted to USCIS". Supporting point would be from "the time it was signed by the civil surgeon" in which for a K1 visa case is the day you had your medical examination from your home country.

     

    I also believe as K1 applicants, we were given this brown envelope containing the results which is handed over during POE. It may be the time this was submitted to USCIS just for my thought.

     

    In the case of a DS-3025, I just don't know if it follows that the deadline for that is the day the civil surgeon signed it. This is because it was not submitted on POE and should be included in I-485 packet.

     

    The only time that the I-693 has a year of a deadline from the day you submitted it applies to B1/B2 visas since they will have to do their medical exams here in US. 

     

    If field offices may not be at par with each other in terms of how they interpret the said rules (which of course would result to an RFE), then I guess the safest is to apply the "valid for 1 year rule". There is no use forcing what we understand about it against an officer after we get an RFE. We can always call them to have this discussed but it's better to talk to a Tier 2 officer about this.

     

    This is just as far as I can understand which may differ others' opinion. Hope this may help. ☺️

    I don't think so. It's still good to go I guess since it hasn't passed the 23rd which is 1 year to be exact. ☺️

    I totally agree with this. I've had my EAD in hand for 3 weeks and the update still says that it's been mailed to me. Never been updated to "card has been delivered". My i485 has been stuck on fingerprint fee received since 12/20. Hopefully that's a glitch that it's stuck also and is ready for interview (just no date yet). 

     

    BTW hi guys. Dec filer from CA. not sure if this is the right thread for me. So many to choose from!! Going from DACA and applied thru my USC wife.

    By the way, i believe that the status "Card was mailed to me" is the final one after getting the EAD.

     

    For your I-485, I just dunno why the status remained that way. Let's pray that you are eligible for an interview waiver. Or somehow, your case might be stuck in a background check. 

     

    Many possibilities.. one thing we have to do is to wait patiently.. ???

     

    I am hoping for the best for all of us. More positive vibes and results..

    Oh yes I received my combo card since last month.. now it's that I just want to make sure that I can see my interview date online once it's changed.. ?

     

    Do they change it to your specific interview date or just by mail? Sorry to bug you with questions. Hihihi

    I-765 and I-131 and I-485 are all treated independently. They do not correlate to one another as USCIS said.. 

     

    It is a job of USCIS to provide the combo card while the I-485 is in process separately. 

     

    Once you get the I-765 and I-131, the role of NBC for these petition are over. Once your status for I-485 changes online to Your Status Is Scheduled For Interview, they already passed on your case to your respective service center. 

     

    If there are some issue in your I-485 in NBC level, they will not pass your case to your local service center. This is what you call RFIE. It may or may not affect your I-765 and I-131. But in many cases they do. Ideally, they don't and shouldn't.

     

    The only reason why some people do not receive their EAD and AP because of RFIE, this is because the lacking info is necessary for them to conduct a background investigation. This is a vital part of the whole process.
