We don't know anything about your case, so there's always a chance for denial as there is with every case.

Having said that, just make sure your fiance knows all about these, the dstes, what happened, what the end result was. It's been my experience from reading these thst in general misdemeanors aren't s big deal unless it involved hurting s child in some way.

I hope we get this man. We'll both be heartbroken

Relax. The CO's at USEM are very accommodating. Just have your fiancee ask for the correction be made during the interview. He should have your BC with him so he can provide a copy. You'll be fine. It's an honest mistake. Just have him own up to it and have it changed. NP.

Yes is on the i-129 form also my g24 bio. I couldn't sleep knowing what a huge screw up. Thanks I'll make another bio for her to let them know. We got this far hope this mess up won't let us down

What do you mean it's not a crime until you violate? If you got arrested it will show up. You did the right thing being honest.

    Good luck!

A civil no-contact order is not a criminal offense. It's a civil matter.

The restraining order will show up on a background check if someone goes to the courthouse and does a name check. The court file is a public record......

Yeah talked to a immigration lawyer he said it's not a big deal because I didn't violate the order but I am definitely going to call More tommorow afternoon. Thank you

So, it's a domestic violence charge? Depending on the outcome of it you might have an issue or some explaining to do at the very least. Now I am not a lawyer, so I can't give specific details. However, you may want to at least contact an immigration lawyer and see what they say.

When the fiance does her interview they actually give a pamphlet about domestic abuse, so obviously they're very concerned with it.

Again, I'm not a lawyer and the outcome of your case would make a difference as well as the circumstances and how recent it was.

Yes I looked it up is really not a crime or charge til you violate witch I didn't ...she was mad and put that on me ...I was real truthful on my k1 also printed the criminal sheet . Going to have to call tomorrow and ask can't sleep well having that on my mind 24-7

You're the United States citizen right? It depends on the crime. Any domestic abuse or violence could be bad. However, a misdemeanor theft charge or something like that wouldn't make a difference.

Yes USA citizen a domestic violence restraining order simple battery criminal mischief but the restraining order is not a crime

That's not very long so far. I'd suggest calming down and getting patience, because you have a long way to go.

We've all been through it, just talk every day and support each other!

Also, I'd suggest creating a timeline it helps other members and it helps when you ask questions, so we know when exactly you filed and everything.

Yes I'll make one soon as I have off.

It's definitely a complicated process. Without this site I never would have done it alone. I just Googled any questions or asked on here and checked everything 5 times. It's worked so far!!!

I've heard lots of stories about people paying people and still waiting a really long time because somehow they messed up. No one can guarantee anything, so I didn't see the point in a crazy over priced lawyer.

I was going to do it myself  until I got the form and I didn't understand me n my woman was like what is this . We both didn't know what we was getting into. We're so new to this k1 visa and process..I have this 1 issue that been bothering me. I have misd crime but none involved in drugs or rape (welp) you think that'll hurm my chances?

You don't need to be afraid of an RFE.  It happens.  In my case, it was something super simple...I forgot to check ONE box on page 5 of the I-129F application.  JUST ONE BOX.  It was an easy fix, except for the fact that it got lost.  Now, that being said...I did NOT make a copy of my original RFE sheet.  It is blue and has a bar code on it.  The reason I share this with you is to educate you and not scare you...MAKE COPIES OF EVERYTHING YOU SEND AND MAKE SURE TO GO TO THE POST OFFICE DESK AND ASK FOR A DELIVERY CONFIRMATION ON EVERYTHING YOU SEND.  A tracking number is an ABSOLUTE must to protect yourself in regards to time frames. USCIS is very strict on timeframes and the last thing you want to do is have to start this expensive, tedious, long process all over again.

I had Fred whal (visa coach)do my paper work . I felt little discouraged took him 2 months to do my k1 file.

She can apply for a visitors visa, but will most likely get denied.  She is already considered a beneficiary on a K1 Visa, so that shows intent to immigrate.  Remember, the main thing about this K1 process is PATIENCE, PATIENCE, PATIENCE!  YOU HAVE TO BE PATIENT.  My fiancee has her interview on May 24th.  I applied on October 14th.  I would probably have this process done by now if it wasn't for a lost RFE.  You have to remember this is a long, government process.  It takes time.  You just have to sit tight and wait like the rest of us.

    Don't scared me with rfe

It would be a waste of money to file for the B1/B2 visa because she will get declined. B1/B2 visas you have to prove that you have strong ties to your country which would show that she has intent to return back home. That would be hard to prove with a k1 visa in the system when the k1 visa's purpose is to allow her to marry you in the US with the intention to stay.

Unfortunately, it's a wait game. If you can, try to go see her while you wait but if not, build up some patience. It may seem like it will be a long process but truthfully it's not. Try saving up as much money as you can and she should start doing the same because this journey while rewarding, will be very expensive. Help her finalize and prepare to come live here in the US because it WILL be different. I talk to my fiance about this all the time and even suggested that he talk to his friends that have migrated here so that they can explain what he needs to prepare.

I'm going to send my packet off in 1-2 weeks. But I'm going to see my fiance next week and MAYBE one more visit before I go back to be with him on his interview but either way, I will be standing side by side with him at the interview.

    Good luck on your journey!!!

Yes thank you. I have read about it but so many ppl say different things. I know she got strong ties. I spent all my vacations going there won't get to go back til 2018 witch is a bummer that's a wait. I filed think March noa1 5 days later. I guess I'll have to wait. A guy told me if I join the service it can go by faster always thought about joining B4 this but if I start getting desperate I'll look into that IDK yet. Waiting game. Thank you thou

It took +/- 6 months in 2016 and 2015 also. The time for K1 has been around 6 - 9 months for a while now. Possibly not going to speed up in the future.

You can take some time to review the guidelines to get more of an idea of the process. It will help better prepare yourself.

i need to be in a coma this wait sucks.....yes i seen some ppl got it less then 6 i wish i can be that person....feel like joining navy/amy lol

She can apply, (I Did), chances are she will get declined, (I did) because it  will be hard to prove she is not just going to stay up in the states once she gets the visitors visa.

that sucks....even if she has a job also a place???????

  14. Ok I'm working with a guy  name Fred wahl. Going to try to keep this short. Am so new to this but my question is I have crimnal record first ever so they gave me chance so is all misd....none involved drugs/murder/ or anything high... Just battery/property damage/ also i think resisting without violance........but before all that mother of my child put a restraining order of domestic violence/child.....but she cut it off less then 2 months also never violated the order. So is not a criminal change. Can this effect me? Of bringing her to me?

Also how long is the procces? Am in Ma she lives in the Philippines..........
