Well he just didnt apply within 90 days and applied late, that doesnt mean he got an extension from uscis. There is no such thing as extention.

Okay, thanks. One more thing. So when you file the i751 are you provided with a new receipt number to check status on you case like you guys are posting the timelines here or do we use the receipt number we received when initially file the i130

You can send it anytime between when your 90-day window opens and when your card expires. Just don't mail it early, even a day too early and they will return it. It happened to someone on this thread. And of course, don't be late.

I heard someone who got an entensuin to file the i751. So their m GC expires last year n now they will be submitting the form n doc. So what is that extension?

They always give a reason for denial, to the extent of citing the applicable section of law....whether or not they elaborate on specifics may vary.

Okay thank you so much. I am in my 90 day window right now. But I don’t have enough evidence to send with my I-751 yet.

should I file with a waiver? How long will the review take after this and when will they ask for additional supporting documents ? And after this how long did it take for the actual interview?

He only made sworn statements on 3 occasions at NYC field office that I had committed marriage fraud despite the fact  that we had been married for 6 years. USCIS quoted his statements in response to the Mandumus Action. I managed to rebut the allegations by writing a 8 page response outlining specific facts about the marriage. In the end I got my permanent GC and subsequent citizenship.

Congrats on success. So glad things worked out for you.  So he sent a complaint to the nyc field office? And that’s where your case was being handled?

Did you have a child in the marriage? Would that make any difference in my case? Because that is all we have as proof and nothing else

not until you filed the mandamus, you actually got to know the reason for denial? Because they don’t usually share that right?

You need to submit service inquiries and document all their responses. Give it time and if nothing is being done about your case then I would advice you to seek help from an immigration attorney.

In my case I had exhausted all means and a Right of Mandamus is what helped. I got to find out what exactly my ex had disclosed to USCIS and I was also given a chance to rebut those allegations.

    Hi,

of you don’t mind sharing, can you plz tell us what did your ex disclose to Uscis. Did they take those allegations seriously? Did your ex try to prove that the relationship was not bona fide? Did you provide enough evidence then?

and how long did all this take after you submitted the i751?

    thanks

There are better reasons for denial i.e. missed the 90 day window but my denial was one of the really bad ones. My ex and his attorney contacted USCIS and claimed that I didn't marry him in good faith. Immigration never acknowledged that. I found out from my ex. I went to I-751 interview with the divorce finalized and they denied based on lack of evidence two months later. I refiled I-751 and filed 290B all the same week.

Some people here say don't send too many papers and be brief and straight to the point but my packages were close to 500 pages each. My statement/letter/explanation, whatever you call it, was 14 pages alone. I just forked over everything, literally. I figured, if you claim not having enough evidence, fine, I'll give you evidence. I called everyone I could. I even made Kennedy Space Center dig up our photos from when we were there for the last shuttle launch.

USCIS had my paperwork for 3 years almost to date. I filed my second I-751 & 290B in April of 2016 and got the approval in May of 2019. I went about 2x year to NYC office to get a stamp and inquire about my case, before they purged appointments on their website. They never told me anything useful. They never sent me an RFE. I was waiting for a NTA (and periodically calling the automated court number) but it never came either. They told me that they will call me in for an interview "when it's your turn", whatever that means. Instead, one day I found the approval in my mailbox. I guess writing emotional 14 pages on how much of a (removed) my ex was did help at the end.

**Just want to emphasize that this is my experience and not an advice by any means**

Good luck y'all fighting a denial, one day you'll put it behind you.

    Hi,

did you file with a divorce waiver? What if you don’t file within that 90 day window? Can you get an extension?

Must we submit all evidence when filing? We never had any joint account, only a child but I don’t have any recent pictures or birth cert.

Divorce is in process. What evidence will I need to submit if I self petition? What did they ask about the divorce? Can my suppose report to Uscis for the marriage not being bona fide? Do they take such complaints seriously to deny the application?

    Thanks

    Congrats!!! We have similar dates.

    1st Scan Date: March 29

Second Scan Date : June 7th.

How did you find out about CC? Did you get a notification? Did your status change at CEAC after the second scan date?

Yea we do. What's document were u missing?

When they first completed my review everything was there expect for my translated marriage certificate. I sent the translated marriage registration certificate which was not acceptable.

I call NVC on July 24th jus to see if any changes or any updates if they need anything else since we were at week 7 and I saw for my embassy they have been completing cases in 7-9 weeks. So when I called the first things they told me was that they completed my case that day n sent to embassy for interview date.

And also if u login at ceac website u will notice the AOS fee part is not there any more which means ure case is complete. When I got my 2nd scan date there was no change on the website. N jus received an email for my checklist

Wow congrats  scan date may 24 and still waiting 😭😭

Thanks!!! But it took me Almost one full year from my priority date to case complete date. Could have been sooner but I forgot to send the translated marriage certificate 🙈

Was it your first scan date? Actually my first scan date took full 9 week to get reviewed n then received a checklist. Since this was my 2nd scan date i guess this is y it took only 7 weeks.

But I also had my county's Congressman contact the nvc on my behalf trying to expedite it after receiving this second scan date.

where does the petitioner live? Ask them to have their congressman contact nvc n find out why it still hasn't been competed

    Best of luck!!!

Hello, we tried posting yesterday but I think our internet connection was not good.

So we have sent off our medical expedite request to the email that we found listed on the website JBMG linked us to, and we also saw many people on VJ have used that email address.

Now it has been two full days, and we are wondering if it was the correct email after all? Can anyone confirm for us which email to use?

    Thank you,
    The Goobies

If you send an email to nvc that take about a month to reply. That's what happened with mine.

Where does the petitioner live? Ask them to contact their county's congressmen and have them call nvc on your behalf and request to Expedite. U will get a faster response from them.

Thanks! i am very concern still about proof of domicile. hope we gave sufficient evidence.

Anyone here knows. how long does it take usually for NVC to give checklist if there is any?

    Thanks

    Hi,

My first scan date was march 22nd and then I got a checklist email on may 27th (9 weeks after my scan date)

i was missing my translated marriage certificate. I have sent that n then my 2nd scan date was June 7th. Now I'm still waiting to get a case complete

So it takes then the whole 9-11 weeks to actually even look at ur documents n then tell u what's missing. N of u need to resubmit something then u get a new scan date n then again a 9-11 week

    wait.

For my proof of domilice I submitted a copy of my drivers license.

    Hope this helps

Hi, I literally just joined this forum so haven't updated any of my info yet (I will do so). But basically, my scan date was May 8th and I received CC 28th June. Will I make it for August interviews?

     Congrats on ure case complete🤗

Can u please share what the next steps are, like what u are required to take to the interview?

Where is your interview? U can check how long it takes to get an interview for your embassy

  13. 1st scan date: March 22nd

    2nd scan date: April 27th

    3rd scan date: June 7th

The 2nd scan date was coz of an email I had sent some time in March requesting to change my embassy n included some documents in it n they forwarded that which were a duplicate of what they already scanned on March 22nd

the 3rd scan date I got after my first review complete (from 1st scan date) and it was missing a document. They asked me to send that in.

Now I've been told that my review will take 11 weeks form the 3rd scan date.

has anyone else had something similar and have already gotten a case complete?

i see that now it's actually taking less than 11 weeks so I wanted to know when I can expect a case complete

    thanks

NVC will reset the scan date if there are any new documents received or any information changed.  Your scan date will be the date on which they have received all payments AND all required documentation (e.g., forms, civil documents, etc.).  When they have received everything, the review timer starts.

In other words, if you sent in additional documentation or if your case information was updated, the new scan date would be your "Scan Date" and you would start your 11 week count from that date.

I noticed you said attached.  Are you email filing?  This thread was for mail processing I guess I can add email filing to the forms for reference.  Please make sure you fill out the following form to share your progress with the rest of us :)

Omg now Ure scaring me, checklist😭

This request that I sent via email was in march even before sending in my packet it's just that they took a month to get to this email.

I still believe it's like an error from their side for including those doc in on April from the email when the person viewing the email had already seen that the embassy was changed and I had a scan date already. They should have just disregarded that email. I don't know why that rep even did this😩

This whole process seem like a never ending process, now it's all going to be at least another month delay to be with my hubby😭😭😭😭

No, I did mail filing. And that email was just to change my embassy. I don't know why they added those to my documents as the attached docs in the email didn't have to be forwarded to anyone. Now because of their error I have a new scan date 😭😭😭
