    Ok thanks! I am doing immigration evaluations i have directed her to her attorney I really can’t give her an answer I’m not a lawyer lol

    we are still waiting on my husbands decision as well Thank you i was just curious if they  weren’t eligible wouldn’t they tell her that at the interview they have their criteria I can’t imagine them telling people that and having them spend all that money and evals etc when immigration knew it wasn’t possible every case is different

    There are some things that can not be waived so in that case there would be no opportunity given to apply.

    Ok thank you my client was told at her interview she was eligible to apply for a waiver but is worried she won’t be approved for smuggling not an immediate family member she’s spending a lot of money and wondering if she’s getting good advice from her attorney

    At the I-130 interview, you were not told that you qualify for the waiver.  You were told that you were eligible to apply for the waiver.  Two very different things. 

     

     

    I believe that’s correct my client was  told eligible for a waiver so they can apply based on meeting the eligibility to apply but doesn’t mean they will be approved

    Boiler Could the consular at the I-130 interview tell an applicant they qualify for a waiver then the applicant does apply to be later told they don’t qualify for the waiver? I was curious if you would know based on your visa journey experience. Seems awful to make people to continue the time and expense of the process after the first interview if they don’t even meet the criteria to begin with and don’t have a chance to be approved right?

    Which is when i applied for an expedite.but got denied. 

    Was that the date of your request for expedite? We requested an expedite January 9th received letter stating they were reviewing our case, February 23 the system updated. My attorney called and they said it was denied the date we requested the expedite? I’m so confused 🤷‍♀️

    40 years ago???? Absolutely ridiculous! I am so sorry! This process is so horrific and the time, money and energy you’ve already spent! Was the victim injured? 40 years ago no other record? 🤦🏼‍♀️ smh

    When you ask to speak with tier 2, you'll go in a waiting queue and the system will call you back when an officer is available.   You can then ask if you can 3 way call the applicant. 

     

    I've done it countless times when I expedited my I-601.

    Thank you my husband wants to wait but I’m praying it’s good news.... I was just curious if anyone ever experienced this and knew what it means uscis is so hard to understand their process 

  9. Our 212 and 601 were updated in the system on Friday and Saturday. I called USCIS today and they told me because I was the petitioner she couldn’t give me any information. I asked if she could tell me if the case was updated or if there was a glitch in the system and she said yes and to wait for the letter. We asked for expedite on 1/11 submitted our evidence 1/15 on 1/29 they sent a letter saying they have received our expedite and if we don’t hear from them in 15 business days consider it denied. Has anyone had this experience? I don’t know what to think and with all the snow storms in our state I don’t know when I will get the letter and my husband and attorney want to wait for the letter....I hope it’s not a denial or RFE.....TIA 🙏

    They received our expedite request and confirmed it with email January 15th, would they update the system for a denied expedite or if they sent RFE for expedite???

  11. I requested an expedite and the system updated for our 601 but when I click on the link there’s nothing there. We already received the notice on January 29 that if we didn’t hear from them it would most likely be denied after 15 days. It’s been about 17 days and the system updated but I don’t know what that means. I have received no email and we had already sent our evidence. 🙏

    Did your expedite ever get approved? Our attorney just mailed ours as well and i am worried because i have read everything that says to call but he’s been in law for 30 years and says this is how he does it...thanks

    Thank you boiler, it’s what I was thinking I don’t believe they would say to file a waiver if you didn’t meet the waiver criteria. I would think they would tell right there correct at the interview there is no waiver available. We filed the 212 with our 601 and have to wait again because we filed it with the 130 and said we needed to go to the interview, out attorney said we could file them together, going on 3 years waiting....Thank you for your response

    We filed the 212 with our 130 and they didn’t approve the 212 because we hadn’t gone to the interview yet. Thanks Boiler, you’re always on it 😊 we went to the interview and needed the 212 and 601, my question is at the interview you either qualify for the waiver or don’t right? At the interview they would tell you?

    Thanks it just doesn’t seem fair they have to wait another year after filing the 601a but the process is the process...

    Yes and it stayed that way until they made a decision March 27 I believe they sent it we responded within a few days and they confirmed they received it on April 12. We didn’t get approved until June 29

    I mailed them a copy, because in the back of it they requested a copy to be attached )

    i responed to the RIFE a month ago and haven’t heard anything no text no email no update on my status online still ( mailed request for initial evidence) the package was delivered and signed as it shows in the ups website! 

     

    Would re-sending another response for RIFE complicate things and creat confusion or it’s going to be fine? 

     

     

     

     

    It took them 11 weeks to respond to ours 😢

    Yes she crossed in 2012. If we are able to change the false claim of citizenship to fraud/misrepresentation then we can file the I-601 waiver to waive the unlawful presence and fraud/misrepresentation without having to wait 10 years. We did include the back up documentation of her trauma when she was seeing a therapist on the I-601A waiver. The hardest part of all of this is having my two daughters (3 & 5 year old) telling me every night of when their mother will be home. Our attorney believes we have a strong case to be granted a waiver if the consulate changes the false claim to US citizenship to fraud/misrepresentation. Until then, there is nothing we can do because the false claim is a life time ban. Thank you so much for reaching out to me!

    Im so sorry that is awful! So was she living in the US then you filed for her papers? I will pray this all works out for you and your family. The process is so painful 😣
