    I' m a us citizen petition for my husband who is here on an F-1 visa. It is currently out of status for couple of months know.  I'm filling out the form I 130 and I'm a little confused on question Part C( information about your relative )#17 ( list spouse and all children of your relative ) do I just listed my husband name or do I have to list my name and also my childrens from a previous marriage.  My income is below the poverty guideline.  So I was just wondering if I should just sent In The form I-130 first and wait to see If I can find a co-  sponsor and mail in I 485 and I765 later. Would that be ok and not delay in my processing.

      You listed your spouse and all of his children (whether they are also your children or not too).

       

      If your I-864 isn't satisfactory then you will be RFE'd for a joint sponsor.

      You are the best, thank you for the quick response:jest:

      My spouse does'nt have any children, they are mine from a previous married so do I list them on there, I should sent in My I-130 , I-485, I765 and I864 and wait for RFE'd for the join sponsor and sent that in later is that corrected.

      You would not include those children if they aren't his.
