Can I still enter the US with an AP combo card/work permit, when my green card interview and application was cancelled 3 months ago? Online the status says: we cancelled your interview for your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number *, and mailed you a cancellation notice. We will notify you by mail if the appointment is rescheduled, a decision is made, or if we need something from you. Based on this, can I still legally enter the US and have a good reason to do so? I will have a return ticket to show I will go back to my country.

You came on a K1 visa so you can only adjust status successfully through the petitioner, your wife. So once she withdraws her petition your legal path for a Greencard at this point is moot. You would have to return back to your home country. I think this answers your question.
Yes, I am already back in my home country. I just want to properly withdraw the application instead of it being denied for future consequences. My question is, does it get denied now when my wife withdraws? I just want to have it withdrawn without it being denied/approved.

Yes I know that, but I'm main petitioner and my wife is the main sponsor of the I-485 I thought. If my wife withdraws, will the application be withdrawn or actually be denied because she cannot withdrawn for me, only her sponsorship?

Does anyone know if my wife withdrawals her petition of the I485, does the whole application get denied automatically or till the interview date? I don't want the I-485 application to be denied but instead be withdrawn/cancelled.

Hello,
I went on a 3/4 month visit to my home country and I want to enter the U.S with my advance parole combo card. My wife lives in Wisconsin and I want to enter the U.S in Los Angeles. Is this possible or is it weird that I come back to the US not close to where she lives?

If you are in process for AOS that is your legal status -- your legal status is not a K-1 visa holder, it is that your are adjusting status. If you want to go back and live in your home country you can and your AOS application will be abandoned, and you would not have violated any immigration laws (no overstay or anything). So you shouldn't have trouble if you want to come visit the US in the future (on VWP or tourist or whatever).

If you go back before AP it is not considered overstay on Visa. Because you are legal with status while your AOS is being processed. That status is a "Pending" status. Going back and leaving the USA before AP simply means you abandon your AOS process. So, you'd have to start from step one again, which would be the I-129F. No overstay accrued.
I think I will be denied for the VWP because I got a previous AOS application and a B2 visa denial for lack of home ties. I have to overcome immigrant intent for my next B2 tourist visa which will be hard, but time will establish my home ties better so hopefully I can visit if I wanted to in the future. Do you think its possible to overcome? Thanks

Hello, I really need advice from someone that knows about this. I have a very difficult situation going on. Me and my wife married and we filed for the AOS within 90 days of the K1 visa. We are about to get divorced. My K1 visa expired, so if I will go back before my AP is this considered overstay on my K1 visa? My main concern is that I will never be able to come back to the US on a non immigrant visa or the VWP with a previous AOS application and especially an overstay if thats the case.

My husband came on a K1. We applied for his SS# within a couple weeks of POE. He got his card in about 10 days. Maybe your local office is backed up or slow? Maybe he didn't know what he was talking about. I would've asked why he crossed out the 2 weeks and why would it take so long (8 weeks).
He said because it goes through immigration so it will take longer. I took a copy of my I-94 with me

He said it has to go through immigration, so they have to look at it first (I think it's an identification thing) It normally only takes 2 weeks right? He crossed the 2 weeks out on my paper and wrote 8. This is exactly 1 week after my PoE. I brought all the required documents with me, so I don't know what the problem is. Could I not be registered in the system yet?

I was thinking about something interesting.. do you think the officer interviewing you already reviewed your case and is close to approving you but needs to verify some things with the questions he/she is asking? (This goes for Western European countries)

I could make a new DS-160 because I still have a choice which one to fill in on the ais.usvisa site to make the payment. In my country we have to send back the confirmation that you're ready for your interview, with the DS-160 copy included. Would you recommend me to make a new one because they have my old one already or will they simple replace the old one since I paid for the new one?

Hi there I filled in No for this question since I didn't consider my fiance being a immediate relative. Do you think it is a mistake from me filling in no? I already confirmed my DS-160. They say I need to do this:
'For all applicants: if you made a mistake answering the questions about your family, education, travel, or any security-related question, you must complete a new DS-160 form and print a new confirmation page.'
Is that really necessary because I send back my packet 3 already with my DS-160 copy to the consulate..

in this case I dont think they want to trick me in purpose. they say that immediate relatives not including parents Means fiancé/fiancée, spouse (husband/wife), child (son/daughter), or sibling (brother/sister).
so if I put my fiancee as a immediate relatives is not a mistake.
some people answer me ina different way an dI understand why , just nbecause the forms they filled a time when they were working on their cases is no longer the same today. forms of USCIS and DHS are constantly updated and modified.
I also would like to forward a wish to moderators to update forms on the sections immigration forms sampel for dowload to allow people to have a clear idea about this forms now.

Once you've done the interview, you'll see statuses like "administrative processing" and "issued". I have no idea if there are any other ones because my last DS-160 was a couple of years ago for my B2

When I check my immigrant status on CEAC it says Ready but when I check with my DS-160 number on non-immigrant it says no status. I send in my DS-160 1 week ago and they received the packet 3 from me last Friday (in my country we have to send the confirmation back). When does this non-immigrant status change? Is it after the visa approval? I thought you always checked the status under immigrant.

It makes sense to say that, but at the same time we are not very private people because both of our profile pictures on facebook are of us together. We also uploaded pictures together on facebook so it doesn't make sense in our situation to say that. Any ideas? I think what I suggested might be the best but im not sure

Hi there, thanks for giving me tips. We are confident in our relationship, and in my opinion it's a good reason to say that because we are 19 and 20 years old. We prefer to not post everything online because of that. We both are not really in contact with anyone on facebook anyways, and the people that know about our marriage is in our inner circle. Those are the people we talk to regularly

Thank you all And if it comes up, we will tell the CO the truth of not wanting to feel the bad energy/judging from some people online. We are still really young and sharing this with everyone at this moment is not a good idea. It doesnt change the fact that we are happy to get married and finally live our lives together.

Hi I was just wondering if it would be a problem during the AOS process from our K1 to not have wedding pictures on our facebook? I have seen many people that got married that didn't post it online but that was before all of this: https://techcrunch.com/2017/06/01/us-approves-social-media-background-checks-for-visa-applicants/
I suppose the officer looks on our facebook accounts but could they deny our case just by not having wedding pictures online?

I don't know yet but it's estimated for mid September-start of October. Hopefully around mid July they will receive our documents from the NVC At the Amsterdam consulate you can't schedule the interview yourself. Some got their interview date 2 months after sending back packet 3 to the consulate for example, and I think the same will happen to me. I heard from fellow Dutch people that it depends on the medical exam (which is fully booked in july already since 2 weeks ago). There is only one doctor that can do it for you. How does all of this go in Germany?

She needed a social security number. I can't really remember much else, but you should find out application deadlines. Community college deadlines may not be early, but why don't you try contacting their admissions offices?

Hi thank you for letting me know but the community college I will go to, I can enroll with the visa, so I was right it all depends on the school. Technically it is legal to study, unfortunately it's too late for me to reach the fall semester deadline Ohwell I will have more time to adjust to the country and prepare everything.

Yes because we are in divorce proceedings and that's why I went back to my country. I left the US with the AP and the petition was not abandoned but cancelled by us. I am still wondering if I could enter the country or not, since it seems they cancelled the petition.
