    The paralegal managing my relative petition case I talked to (because you rarely speak to an actual attorney) said that it takes 3 weeks to prepare the I-130 while I already gave them all my bona fide documents and the biographical information from my wife (US Citizen) and I. Afterwards we are going to meet to review it before sending the package and sign it.

     

    i know that most of you did not choose to hire a lawyer and that it is not necessary. But, does it really take 2-3 weeks to file the I-130? Perhaps an immigration lawyer put this kind of stuff as low priority and doesn’t really work on it?

     

    i now have to change the Return flight ticket date to a later one in order to be able to meet with my lawyer in the U.S. to review the I-130 together and sign before leaving for my home country and wait for the petition to be approved.

    Ours did the same thing! He took an entire month and the only reason he got around to it was because we went in to ask why we hadn't received our noa1..

    so intead of December 4ish our i130 was received jan9 😤.

    its horrible I think lawyers get too many cases and end up making our process even longer because of the wait.

It's frustrating because around the time when we first filed  (dec-Jan); Texas was the fastest , other ppl would even say that if your case got sent to texas you were lucky because they were the fastest. And now they seemed to be overwhelmed with all the transferred cases 😩. Hope they come back with lots of energy from their 4th of July holiday day off.

No news yet...I'm so bummed out about waiting, our priority date is Jan 9 and at first I was so excited about being sent to Texas center because it seemed to be soo fast in comparison to the other locations  and then you see some lucky people getting NOA2 after just a couple of months lol ...:( but it seems like we are going to have to wait the same as everyone else :/ good luck to us all.

    I know that if we file under her maiden name, her green card, visa etc.. will be under that name and not her married name (which we want under her married name). If so, we definitely need to get her a new passport with her updated name and then i'm assuming we would file everything with her married name. or do we file under her maiden name and then name change when everything is processed. any help would be appreciated!

     

     

    Hi ,what country is your spouse from?

    in my case our attorney recommended to do it under my maiden name because mexico will not change your name on your passport even if you want to. then your passport and residency card will have different last names. If her country allows to change names then definitely go for it, it would be waaay easier.

    Just be careful and don't lose  your I-797 Petition Acceptance Notice (NOA2) once it arrives. A copy of the NOA2 is actually needed later on in the process. I've heard USCIS charges a pretty penny to get a copy if you lose it!

Hi my husband and I filed the i130 on January 2017, we received our NOA1 in the mail about two weeks later, One day instead of placing it in my  folder  I stuck it in a large pocket of the sweater I was wearing ( I know so dumb right!?!!)  Unfortunately after moving  and a couple of unforeseen family emergencies I completely forgot about it and  earlier today I noticed the left over paper in the pocket :/ Well my question is, will I need that paper down the line in our process? I took a picture of it when i first received it but it isnt very good . Can I call and explain my situation to get a new one or just leave it like that and print out the picture i took of it? thank you in advance for any advice.

When is your appointment!?  Im also so scared that they will denied his visa due to the same reason! ? He has quite a few tattoos his both last names one on each arm in old english his parents names and the name of his deceased brother in cursive; on his chest he has another piece of a samurai on his shoulder blade a unicorn, and lastly an his leg he has a tattoo of what looks like to be a mechanic leg. I dont think any of his tattoos are gang related, but we will have to see once we are there. In case our appointment is before yours I will let you know how it went. ?

    Yes that one. I know there isn't much info out there, the thing is I guess it depends on the interviewer at the consulate..but its crazy that their decision can change our lives forever. :(  just based on  what they think. in my opinion a clean background check and fingerprints are good enough to prove we are not gang members , they are basically just judging us based on our looks. Cover ups are expensive tho :\ hope I can save up before my appointment. Please share anything you find out or updates to your case.

    My lawyer "warned me " about this before we started my paperwork. Every day I pray he doesn't do it because I don't think he needs approval from congress if he just does it as an' execuve order' .

    Our i130 hasn't even been approved yet! Have you applied for the waiver yet?

Until then I will keep waiting any advice or prayers will help! Also I like to read updates on your journeys it gives me hope! 

    Omg that is such a long time :(  keep calling your attorney , that's what you are paying them for!  Mine never replies my emails or answers my calls so I have to show up in person to get his attention...I seriously regret hirinbg him! Hope that you get an answer soon .prayers sent your way.

    He has His OSHA Certificate and I believe some type of tattoo artist certificates so I'm hoping that helps. I did Google this and the tattoos that were denied did look pretty gang related. Like smile now cry later tattoos and stuff that honestly looks gang related. But we will keep our fingers crossed and I'm guessing we will be going before you so I will keep updating 

    I have my last name on my arm in old English and other tattoos and although they are most definitely NOT gang related I can see why someone who doesn't know me would think otherwise (I was young and dumb and didn't think it thru when I got them) I saw a video on YouTube where an immigration attorney recommends taking pictures of the tattoos and describing  what they mean to you or if possible even print out the meaning from online websites ,,,in case they ask you about it in your interview. I am so nervous about it that  I am actually looking to cover them up  something more colorful because I don't want to risk it :(

    I think the active days is how long since they received your application, I have heard that the physical NOA1 takes longer than the online updates to your case because its "snail mail".  Check the timelines similar to your case on here to get an idea of how long it will be.

    I would hire a PI so that you can have evidence and be 100% certain.

    after that I am sure you can contact USCIS and inform them of the situation.

    Fingers crossed! We hope getting ours before the end of April despite what the uscis.gov website seems to say.

     

    Looking at the timelines on here (filtering to TX service center and sorting by NOA1), you can see the "roughly 75 days" estimate is about right.

     

     

     

     

     

     

    thank you for the reply! the same thing happened with our lawyer! the reason we found out when we were approved is because we went on the uscis website ourselves. (and  for some reason i check it daily , just in case i am one of those lucky ones that get processed in the blink of an eye) no luck yet but like you said, fingers crossed!!

  15. We are on the same boat as you. My husband and I were hesitant to apply after the election, but we figured we have to at least try and just think positive, we just got our 'receipt notice' Im not sure if thats NOA1 but thats where we are right now...we got texas service center so i hope to go they process our i130 fast because I am still nervous about all these executive orders left and right and the tension with Mexico right now. Just go for it and dont forget to pray to god every. Wish you all the best of luck in your visa journeys :) !!!!
