    Yes, put the alien number that you already have for OPT. But they will assign you a new one. 

    Alien number = USCIS number

    Yes. No questions asked during the interview about the difference in address.

    My interview was a year after we submitted the application. So I had already received the EAD as stated in the letter, we had moved in together. 

    For your application, try drafting a letter to truly explain your situation otherwise a difference in afdress will be seen as red flag.

    You have to put all forms together with their supporting documents in separate folders. So yes you will need a couple of copies. For example you need the US citizen birth certificate for I485 I864 and I130 but not I765 so you need 3 copies.

    You can elect to be treated as a resident alien for tax purposes. We did that for our 2016 taxes. I do my own taxes so I had done a lot of research I used taxact.com to fill out the forms online (free). Then I printed out the forms and mailed it out to the IRS with a letter asking to “select the choice”. You can look that up on their website.

    Q.18 'Status at Last Entry' - I have put down 'K1 Adjustment of Status.' Is that right? I came back from abroad using my combo card in September.

    Q.19 'Current Immigration Status' - Again I have put down 'K1 Adjustment of Status'  Is that also right?

     

    I have read somewhere that the combo card gets automatically extended after sending it off and if you don't get the extension/renewal by the time your current card expires it automatically extends for 180 days? Does that apply to us being under the category 'C9?'

    I submitted my renewal application early in january and received the notice that it’s pending. 

     

    What you need:

    - the application form

    -2 passport photos

    -a copy of your NOA for the i485 ( the letter you received after sending your application saying that it is pending) 

    - a copy front and back of your current ead

    - a copy of your I94 (optional)

  9. When I went to the doctor's office, I told them I already know it will be positive. So I skipped the test and did the chest xray. The result was fine (I already knew it would be fine because I had to do a chest xray 5years ago in my freshman year of college - so I wasnt worried). The doctor filled out the form for uscis and according to the copies that they gave me, everything is fine. Dont worry. I didnt have to take any further medication. 

  10. I called USCIS on 10/23 to submit a request since my case hasn't been updated in a while. PD 2/17/17.  EAD appproved 4/28.

    This is the response I received yesterday  through email: 

     

    "Type of service requested:
    -- Outside Normal Processing Times

    The status of this service request is:
    Due to workload factors not related to your case, USCIS anticipates a delay in completing your case. USCIS is committed to adjudicating immigration benefits in the order received and in a timely and efficient manner.  We regret any inconvenience that results from delays in processing."

     

     😕I guess I just have to keep waiting for my interview notice. I haven't received any RFE

    I made one cover letter for the whole package. They actually scan everything you send at the chicago lock box. I know because my package was returned the 1st for incorrect fee and every dingle page had some scanning codes at the bottom. I believe the emectronic copies are sent to different agents.

    I am in a lesbian relationship. Our parents on either side do not approve. Our siblings are supportive though. During the interview, tell the truth about how they dont support you. It's very common so it wont be a big deal. We got married at the courthouse with noone except for my sister in law (my family is not in the US).

    Im F1 too and worked in 2015 with OPT but I didnt send my w2. We only sent my spouse's w2, letter of employment and our jointly filed taxes. So far I havent received any rfe so I think that was the right thing.

    Since your spouse makes enough money, then you dont need to provide your work permit. Though you would add the exact amount that you both made since that's what is on your tax form.

My packet was received on 5/12/2017 and I received my NOA in the mail dated 5/17/2017. In my packet, I included a request for expedited processing of my I-765 renewal. I am worried because I only have a little over a month left on my EAD and being out of a job for even just a month is scary. In my request for expedited processing (included in the mailed packet), I provided my salary information, proof of rental payments, proof of monthly student loan payments, and proof of health insurance through my employer. I have reached out to my local congressman and was told that he submitted an inquiry to USCIS. I also filled in the ombudsman form online requesting further help with my expedition request. I called USCIS customer care and was told that because I already filed for expedited processing with my packet, I am unable to request again through them. I have my infopass appointment scheduled for 6/6/2017 (21 days before my EAD expires).

     

    Right now, I am just freaking out. Anyone have any experience with this? Any advice? Thanks!

     

    P.S. I know the packet was filed late but I was told by an attorney (who I ended up not retaining) that as long as I file before my EAD expires I should be fine. I think he ignored the fact that my current EAD is class C3B while my class requested is C9. This makes me ineligible for the automatic 180 day extension. He also told me it would be worthwhile waiting to file my taxes before I send in the packet which made sense considering USCIS would have likely required evidence of the tax filing anyway, but at least by then, they would have been working on my EAD.

    Those are two different classes of EAD so as far as I know it is not a "renewal". If you pick "renewal" on the application , your application will be rejected because you have to pay for a renewal. C9 is free though. Also, I believe in order to issue you an EAD you need to have your biometrics done first so that would take about 2 months after the application was filed. Meaning i dont think you ll have an ead until around 7/12/17. 

    I may be wrong.

    1) Is there a difference between coming into the country the first time and then re-entering. When I came the first time in 2013, I did not intend to marry, but have since met. Now when I come back to re-enter into the USA in June, technically "I would have intent" to marry, since we are now proposed.

     

    Then if we get through this, which I assume, since we are in different lines, her the USA, and myself, the non-resident line, we then would look to marry soon. But I would be heading overseas again for CPT this summer. Again, I would be "with intent" but does this matter?

     

    Then once married, I assume in the next 12 months, things then change all together. I look to complete the full application (I-130, I-485, I-765, I-864, G-325A, Bona Fide Evidence & I-693A ). A few questions about this:

     

    2) If my GC application is during my OPT where I have EAD (Work Authorization) -  Can I continue to work?

    3) Once application is made, can I leave the country? as my current status of F-1 OPT allows me to have multiple entries? - I realize you can apply for AP (I-131), but if I am in currently in legal non-immigrant status, does this change?

    4) If I propose, and are engaged, before we get married and I go to Canada? Does this change with any re-admissions into USA?

    5) Finally, what if my passport expires during the Permeant Residency? Does this matter at all? or do these transfer over?

    1) I dont have an answer to your "intent question.

    2)if you have and EAD for opt then you dont need to apply for an ead through the green card process. Dont fill out I765

    3)once you submit your green card application , you can only leave if you have AP otherwise your application will be withdrawn.

    4) not sure

    5) just renew your passport 6months before it expires. Go to your embassy.

    As for my own question, here's my scenario:

     

    1. I am currently dating a chinese student during her OPT. She has been in the states for over 2 years (arrived august 2014) and we started dating around january 2015. We are now getting engaged and married within the next few weeks.

    2. She currently has an EAD through her OPT and has a valid F-1 visa.

    3. We would like to file her I-485 as soon as is reasonable after the ceremony, along with an application for an AP and EAD

     

    My questions are regarding the timing of the application (is it too soon to file for adjustment right after the ceremony?), the feasibility of adjusting from F-1 status (form I-485 does not have a specific check box for this type of adjustment I don't think?), and whether or not there are any specific document requirements for this type of adjustment request (outside of the standard documents listed on the document instructions).

     

    If I come up with anymore questions I will try to include them in an edit. Thanks in advance for any help you can provide.

    You have to file out i485 i130 i864.

    on the I485 you have to pick part 2 option A ( since you would be submitting it together with i130).

     

    As far as the documents you need to send for the I485 that relates to F1:

    passport biographical page , page with f1 visa, passport entry stamps, i94
