  1. Hi, I am a US born citizen living in California. And I need some info to do my I-130 for my wife. I was wondering what else I needed to enclose with my I-130 paper, G-325A bios and the 4 passport pictures? Somebody told me that I needed to enclose copies of our birth certificates, wedding pictures, passport copies, phone records and everything along with the I-130. I looked on the USCIS website but they didn't mention it. So I was wondering what am I supposed to include in my mail package besides the I-130 and the Biographical info? thanks a lot in advance for any assistance.

Yodrak is a very knowledgable member of the forum. the directions for the 129f state if living outside th US, to file with the Service Center of your last residence. the G-325a asks for residence for the last five years. has he had no US residence for over five years? He has had no address to which any mail has been sent to? does he now use his mom's address as a mailing address?

    i don't think he should file from a state where he intends to reside. if he is using his mom's address as a US mailing address and hasn't had a residence in the US for over five years, i would think it should be submitted to the the Service Center which has jurisdiction over his mom's address.

    i could be wrong. hopefully someone will correct me if i am.

    Before living and working in oversea, i think he has his permanent home address in America of course. But now, he doesn't have. According to what i have just studied from school in my American Culture class, it is said that Americans are very mobile, they are not sticked to live at one place, and every American often moves from place to another at least few times in his/her life. And so does my fiance. He lived in different places when he was in US, and the last place he stayed before working in oversea was NC. According to what you said, should my fiance write down the address that he was staying in NC for last time? Yes, i think he will use his mom's home address.

    But you seem not to answer to my main point. He and his mom are living in different state of America. Well, i think i need to explain clearly about this: his mom is living in PA, while he and i are planning to stay in NC - that is the place i like best and intends to buy home for us to live there in this October when he returns America for his short vacation. And of course, he will file K-1 for me here. And my question is that is my fiance allowed to file K-1 visa for me at USCIS in NC with his mom's PA home address?

    William, so, my fiance will use his mother's permanent US address to file for me, then he is supposed to receive mail from CIS, right? But, i should tell you this, my fiance will come back to work oversea when his vacation ends, then, how can he keep in touch and get mails from CIS in oversea while they will send mails to his mom's home address?

    Is this possible for my fiance to use his mom's home address in USA to fill out in the form I-129F? As you know guys (i told several times about my case here), that my fiance will stay in oversea and file K-1 for in his oversea address as well. But he intends to use his mom's postal address to make it legal in the form. But you know, his mom is living in PA, while the place he is going to file for me in another state (this is a state where we will live together) and is it possible to accept?

    My question could be silly for those who already experienced this before. But being honest, this is really a big wonder for me - newscomer. I am actually seeking advices from you.

    Is it possible for my fiance to file for K-1 while he is temporarily living and working in oversea?

    I will tell you more about this now. My fiance is about to go back the States to see his family and intend to file at that time too. But he will only stay in Amercia for 3 weeks vacation, after that he has to go back to the country in oversea to continue his work contract. And my question is if my fiance won't meet any problem while filing K-1 during time he spends his vacation there? After that is it possible for him to continue finishing the whole process while he is in oversea?

  7. Hopefully someone with even more experience than I will also respond to your post, but as I understand it, there will be no problems for him filing so long as there is a valid mailing address for him to have documents sent to.

  9. it doesn't need to be a detailed long story, just 3 to 4 paragraphs describing the basics of how you two met. i don't know that it makes a difference who writes it. have faith in him . he can do it.

    Tks for your answer, roymcn3rd. You know he is too busy with his job in oversea, and has a fewer time for himself. That's why i think it is better for me to prepare as much as i can. Is there any body here who used to let your fiancée do the Question 18 yet?

    It is written like this: Describe how the relationship was established on Question 18, Form I-129F.

    My fiance is going to fill out the form I-129F, but what about Question 18 i have just displayed above? I think my memory is better than him, and i think i will explan everything about how the relationship between him and i was built instead of him. Is it possible for me to write it? Or my fiance must do it?

    It's quite interesting when you give me informations about this lawyer. He used to be in Vietnam for ages, that sounds good. Thanks soo much Yodrak for giving such important infos about this lawyer that fiance and i have been searched.

    Mew, you don't need to say sorry, it was just a minor misunderstanding. This is also a lesson for me that not all people know what the abbreviation stands for, especially about places. I should have said the full word of NC like this North Carolina insteading of NC, right? :)

    Second, you do know that after you get the visa, you have 6 months to enter the U.S. and get married within 90 days in the U.S., yes? In case your case is approved fast - it can happen! - you could find problems in moving to the U.S., since your fiance is living abroad.

    You mentioned the notary public. I-134 is the only documents that needs to be notarized, as far as I know. Documents can be notarized by consular officers in U.S. consulate/embassies abroad.

    Of course i know what NC is, that is the place where fiance and i are going to settle, but i do not know much exactly about it such as population, is there any Viet community? Something like that. You already misunderstood my meaning, and that's why you called it was a dumb question!

    I do not know anything which is involved in this process until i have discovered this useful site and tried to read as many informations as possible to update my knowledge, Mew.

    At first, my fiance decided to do the entire process on his own. But later, he changed his mind, now he wants to hire a reliable lawyer who can take a good care of our case. I think it is a good idea, because my fiance is temporarily working oversea, he has one year left of contract of working oversea. So, hiring a lawyer is very wise decision at the moment, don't you think so, Arazia? However, because not all of the lawyer can handle his clients'case effectively and successfully, so that's why he and i should be careful to search the best lawyer to handle our situation.

    By the way, do you know about NC? If so, would you mind telling me something about it?

    Just like you, i'd like to find a good lawyer who can handle our case in the beginning, but my fiance didn't agree. He said that he could do what a lawyer could do, then why he just wasted money for something he knows. But later on, he changed his mind because he found out that it would be more difficult for him to do the whole process by himself, and because he is currently living oversea and work, then it would not be easy for him to contact with the notary public to solve the unexpected problems during the process. And i am really glad he changed his mind at the end. In my mind, a good lawyer can manage the case easily and responsibly. However, finding a good and responsible one is not easy, is it?

  14. I feel like i was survived in this forum when i have just posted my problem and all possible answers were shown up for me. Thank you soo much guys. I really appreciate your help.

    You know that, in the beginning when i first watched in the Guides for K-1, it is said that G-325a should be filled out by both of persons, the beneficiary and petitioner. But when i clicked to the "for example", leading me to an example of G-325a, i found out that two examples of G-325a filled out by american citizen and his/her fiance(e) are just the same. Maybe that is a mistake from the person who made a list of things there. If you still don't understand what i am trying to express, you can simple go back that page and click it, you will know what i mean. And that's a problem, and no wonder why i felt so confused about it. But now, thanks to you guys, everything is clear now, and i will do exactly what you have just advised me.

    Another question is: what do you think if my fiance has an idea of hiring a lawyer to do everything for us? Any suggestion would be highly appreciated.

    Let me introduce to you first about my situation so that you can understand what i am trying to ask here. My fiance is an usa citizen, and he is going to file in fiance case. I read on the Guides, but still can not figure something on there, especially on G-325a. In the Guides, it is said there are totally two sheets of G-325a, one filled out by us citizen and other left will be filled out by foreign fiance. My question is those two sheets just similar to each others? I mean, there is nothing different from the sheets of G-325a filled out by american citizen and foreign fiance, right? If so, only one person can complete the G-325a and then make it two? Is it possible?

    What about the signature? In my case, i am now living in asia, and i am not there to fill the form, my fiance is going to fill out the G-325a, and is it possible for him to sign on the behalf of me?

    I still have some questions and hopefully those will be clearified by one of you - those who have so many experiences on this.

OK, When I visited my fiance in China I brought a completed G-325A and Letter of intent to marry with in 90 days of entering on a K1 Visa for her to sign, when i got back to the USA I then proceded to folow the instructions on filing the I-129F petition. Examples of G-325A, and Letter of intent can be found in the guides.

    What you have just advised me is what my fiance has to do in his side, but what about me? It is said that when the fiance goes back to the states, he will take some papers from his fiance's side: birth certificate... or something like that. I just heard of it but don't know exactly. And that is what i wonder. When he visited me in last April of 2006, he didn't bring any papers which were involved in filing document yet.

    My fiance is going to file the document according to fiance case of course, but he has no idea of what document i should prepare in my side and send to him via mail. I have known this site for such quite long time, and still watched the topics here. I know a lot of people were in my case and they managed to file their documents. Now, i am here to ask your help. Can you please tell me what papers i should prepare and send to my fiance?
