  1. Hi, I have not filed taxes for 2020 yet. I cannot do so until I receive a Schedule K-1 (I am a partner in an LLC) from the founding partner. It usually takes him near the deadline to do so. Is tax year 2020 returns expected for I-751? My ROC filing deadline is in late February.

     

    The AOS interview was 2 years ago in 2019. I provided 2018 tax transcripts at the time. Should I just re-include the 2018 tax transcripts even though they already have them?

    You mentioned previously that you filed in September. Just wanted to let you know we got our interview notice (in the mail, no e-mail or text) for late February, so you should be getting your soon hopefully! Keep your eye on the mailbox!

     

    A few questions for others:

    • Does anyone know what documentation is valid for showing eligibility for lawful permanent status? Is a copy of the passport page with K-1 visa enough?
    • I submitted the I-864 with the AOS application. Should I still bring most recent tax info and/or letter from employer?
    • The notice asks for "original and copy of each supporting document submitted with application. Otherwise, we make keep your originals for our records." Did anyone submit all their AOS supporting evidence again?

     

  3. Getting anxious as I filed in Sept., but seems they are already moving on to October+!

    About the account, I just had to reset my password.

     

    In my case status, it used to say "ready to be scheduled for an interview...", now that is nowhere to be found. Instead the last significant record is " We accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status. Our National Benefits Center location is working on your case. " After that are my inquiries into why the case is taking longer than the processing time.

    Hi KimchiLumpia. I filed and they received around 9/11/2017, so I'm about to hit the 1 year mark next week. You're not alone.

  5. Any September filers in Seattle still waiting for interview scheduling? I'm about to hit the 1 year mark for waiting and I'm getting really nervous. Like, did they lose the application? Did the notice get lost inbetween junk mail, etc.

     

    Does anyone know if you get an e-mail for the interview date if you filed the G-1145, E-Notification of Application/Petition Acceptance form with K-1?

    If it's any consolation to you, same has happened to me, glitch is still there. I don't think they'll be fixing it anytime soon. I did call the general USCIS phone number and entered in my number there, and it actually says we're waiting to get an interview date like before.

  7. Fiance submitted her I-485 in September, got a notice, had her biometrics done on Oct. 4th. Oct. 5th we get a notice about the I-693 (Medical and Vaccination) was not signed and submitted, but to submit later at the interview. We did not get a notice about an interview date yet.

     

    Do we just wait now for interview notice? How long does this take? Also, how can I find where the case is being processed so I can check processing times?

     

    Worried a little bit here. Every time I check the mail, I check every page of junk mail to make sure the notice isn't hidden inside somewhere. Also, my fiance is interested in possibly working. Is it OK to apply for EAD now?

  8. I am applying for AOS based on a K-1 visa. In the I-485 form, Part 2, question 2, it asks, "Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)?"

     

    Do I check Yes or No here?

     

    Based on this: https://www.uscis.gov/sites/default/files/files/pressrelease/Section245ProvisionLIFEAct_032301.pdf, it seems I check No because I am still maintaining a lawful presence in the U.S. with my K-1. Is this correct?

  9. Hi all, my fiance had her interview today. CO said she would have her visa within the week. They did take her passport.

    Some questions:

    • Does that mean she passed?
    • If you fail the interview, do they not take your passport?
    • Has there been an instance where even if you fail the interview, they take the passport anyway and tell you later?
    • Older threads seems to suggest they ask the interviewee to fill out a delivery form for the visa. My fiance was not asked this. However, when we applied for our interview appointment online, the online form asked if we wanted it delivered to fiance's home, we checked "yes" and filled out the address. Is this just a change in process?

    Some countries allow you to download your packet 3 on their US embassy website.

    Because you have made no mention of your foreign fiance's country, the members here cannot give you specific advice to your case.  

    My fiance would have her interview at the embassy in Seoul, Korea. I hope you can help since you've got Kimchi in your name ;) I also love lumpias. Delicious!  

  12. After NOA2, about when and who is the packet 3 mailed to? After NOA2, it seems like much of the work now has to be done on the beneficiary's side, so does packet 3 get mailed to them or the petitioner? Also, does the packet 3 get mailed after the chosen embassy receives the case from NVC, or when they send it to them? Is it by e-mail or physical mail? Some have told me about an e-packet 3 which basically an e-mail version.

     

    NOA2 says, "The notification letter will provide you with a unique number for your case...." does the packet 3 come along with this or is the packet 3 received later?

  13. Prepping I-134 for K1-visa. So, I'm a bit of an odd duck in that I'm self employed through a K1 partnership. I work for a startup company. So, for I-134 evidence, I only have a schedule K-1 (different from K-1 visa), no W-2 or pay stubs. VJ community, do you think the schedule K-1 and employer letter is enough? Employer would be my boss. I am a partner, but I'm really more treated as an employee.

     

    One thing I'm a bit worried about is that most of my pay comes from guaranteed payments and not business profits. Basically, most of my income comes from the funding that we have from investors. I'm not sure if this will be a problem, and might be better to get a co-sponsor instead.

     

    FWIW, I made $50,000 last year, so I'm sure I'm above the poverty guidelines. Also, I have been employed with the company for 4 years now, and expect to be continuing to work for them even until next year. I wonder if this is all that matters?

     

    Also, I read that income must be 125% above poverty guidelines. Since I'm single with no dependents, I just calculate 1.25 * $12,060 = $15,075? Is this right?

    Same here. Early January filer, and it's making me nervous when I see later January filers getting approval first (I'm happy for them, don't get me wrong), because it makes me think I'm about to receive an RFE. My guess is that the ones getting it early are from Vermont service center. There are some from California/Texas ones that may have gotten it expedited. However, my gut feeling says that there is a box of case files and they just pull randomly. With the number of cases that there are, I doubt they have boxes full of files that are neatly ordered and filed in the order of date received.

  15. Issue at hand: I don't think you have anything to worry about. The temp "travel-ban" is for certain countries only.

     

    I hate to be a fear monger, but I truly worry about the Trump administration because of Steve Bannon. He hates immigrants, even legal ones.
