  1. Hi,

     

    I am in the US with K-1 visa and I applied for AOS. Now my case is pending. In november, I want my family to visit me for a month with a tourist visa. But I am worried about this effecting my case, because it can be suspicious and they can think that I am taking my family here illegally, which is not the case at all. They will stay in my and my husbands apartment for a month but then they will go back. Is there anyone who had anything like that before? Was it okay, or did it cause a problem? I was thinking of sending a letter saying "they will stay with us for a month." to make getting visa easier for them but I am also afraid of effecting my green card case.

    So I just looked at some all threads. Apparently you can study but rules may vary among institutions and states. Some institutions might charge you an international student fees. It might also be a bit more difficult to get financial assistance. Try and call the specific institutions that you are interested in and check their respective rules :)

    I'm a K-1 visa holder, just married to my American husband. We're filling papers to apply for adjustment of status. My husband is my sponsor and his father is a joint sponsor. But he filled the affidavit of support before we got married. So he wrote my last name as it was before we got married and signed it. But when we got married I added my husbands last name to mine. Would it cause a problem? Should we have him sign those papers again with my new last name?

If you decide to use Obamacare via the federal/state exchanges, instead of purchasing a private plan or adding her to a joint work plan, you're going to need to have filed for Adjustment of Status to prove that she has some sort of legal status - the earliest you'd be able to apply is with either an NOA1 or the EAD while waiting for a green card.

     

    Temporary insurance, travel insurances, and short term insurances are considered subpar by the government - and that means the penalty will still apply. Everyone residing in the US must have health insurance or pay a penalty. Under the new administration this is likely to change, and some tweaks have already been made regarding how exactly that would likely not be enforced. However - please don't let someone telling you that she needs an SSN deter you from obtaining health insurance for her. She's within her rights to obtain an SSN nearly immediately, and despite that not having one doesn't prevent you from purchasing insurance.

    My familiarity with Obamacare is very limited, I'm still under my father's insurance for another few years, so I haven't had to deal with any of this yet. Even after looking through the marketplace website, several things don't totally make sense to me. Open enrollment is over, so she would have to qualify for special enrollment, like you mentioned. It seems like recent marriage qualifies for this, but she wouldn't even be eligible until she was a lawful permanent resident, and recent permanent residency status is another qualifier for special enrollment. Are you saying that filing for the AOS and EAD is sufficient for qualifying, and actually holding a greencard isn't necessary?

     

    I had no idea non-citizens were required to have insurance under ACA. Thank you for bringing this to my attention! I'm confused about how she wouldn't be able to use the marketplace unless she has permanent residence, but is still subject to the fine before that. I'm I understanding you correctly?

  5. My fiance will be moving to the US soon on a K1 visa. It's my understanding that she cannot apply for traditional medical insurance without a social security number. After a little research, it seems there are several options of basic limited coverage. "Inbound Immigrant" seems to be the plan which is the most available to us. What are people's experience with this? Do you have any suggestions/warnings?

  6. My fiance will have her K1 interview soon, and so we are trying to plan out the details of her flight here. However, a detail about this confuses me. The K1 visa allows her to stay for 90 days. In the 90 days we get married and apply for the adjustment of status, paired with advanced parole and employment authorization. Getting the AP takes 90 days. This means that there MUST be some time she will be in the US after the K1 expires, but her AP has not been granted yet. In this time, how is she legally allowed to be in the country?

    So, my fiance is my sponsor for K1 visa. And my father-in-law (to be) is my co-sponsor. They filled all of the documents that they needed to. But it wasn't written anywhere that if the sponsor is married, he/she should sign it with his/her wife/husband jointly together. So they sent me papers without my father-in-laws wifes signature. But then Turkish embassy renewed their page, and now it says sponsor should sign it with wife/husband jointly. 

     

    Right now, I have a paper from my father-in-law who is my co-sponsor without his wifes signature. Do you have any idea if this will cause a problem? Do I have to want those papers again from him with the wifes signature too?
