  1. Dear all,

This process is finally over for me. These are my timelines:

    1) Advisory Opinion:

Department of State Advisory Opinion Finding: Subject

    Item Action Date
    212(e) Finding Letter Sent September, 30 2016
    Form DS-2019 Received August, 25 2016
Advisory Opinion Request Received August, 25 2016

    2) No Objection

Department of State Decision: Favorable Recommendation

    Item Action Date
    Recommendation Sent August, 28 2017
Response to Funding Source Memo Received August, 23 2017
Funding Source Memo Sent January, 10 2017
No Objection Statement Received December, 08 2016
    Fee Received November, 30 2016
    Form DS-3035 Received November, 30 2016
    Form DS-2019 Received November, 30 2016
Passport Data Page Received November, 30 2016
Statement Of Reason Received November, 30 2016
    Other Received November, 30 2016
DOS Case File Number Sent November, 30 2016

    3) At USCIS, the case was received on 06 Sept 2017, and approved on 14 Sept 2017. I received the I-797C and I-797 by mail not in the US address I had indicated when I submitted the original package, but instead (and surprisingly) in my home address abroad.

    4) I applied for the Visa in the US embassy in my home country and in less than a week had the visa approved and was finally able to fly to the US (from where I am now writing) and be onboarded in my new job on 31 October 2017.

Hope everyone manages to have their cases sorted out. Good luck, and happy Thanksgiving!

@Coco8 I ask you since you seem to know a lot of things..

Do you know how can we ask an admin to close this threat so people (including myself:innocent:) start using the 2017 dated forum?

None of us really belong in this 2016 timeline one since we all applied in 2017...  or that doesn't really matter?

Interesting but still bad advice. The Waiver Review Division is not quite the IRS. It's a small group of employees based in a single office space. The cases in which the a waiver apply are better defined than taxation matters, and further, the evidence to be presented is also better defined.

The consequence of asking the AO twice is that one will have to wait 3 more months, not to mention the lawyer fee if one submits through one. Only submit again if circumstances change, or if there are new facts. Otherwise, it's just time wasted.

Guy i read on another website that sometimes it is a good idea to request 2 advisory opinions back to back, so if one says that you are subject to 212(e), another might say that you are not. And you can use whichever one that fits your needs. Is it true?

No. This is bad advice. The DOS is not stupid. After you fill out the form online, they will ensure that whatever posterior applications you submit, they will fall under the same case number.

Moreover, it is also a waste of time. It takes about 3 months to obtain a response from an Advisory Opinion. Do not send the same twice unless there are new facts, new documents, or change of circumstances that could make you no longer subject to the 212(e) rule.

I was hoping they sent my NOA1 to my non-US address and it got lost in the mail.. but when I called USCIS (after a month) they couldn't even find my application in the system... The guy I spoke to made a service request to the Vermont Center..

I wanted to have a reference if this was happening with other people.. but I see is not.. I'll keep waiting for the answer of the request and see what happens..

Im glad to hear things are finally moving along for you.. I couldnt imagine waiting for so long without knowing whats going on...:o

You may have read this elsewhere here in the forum: at USCIS the people who answers the phone often get confused about the No Objection cases, in that it's not you who files the I-612, but the DOS. When speaking to them, make this clear, that the case was filed, and all that you need is the receipt number.

have you heard anything from UCIS after Favorable Recommendation?

Yes, I have received the NOA (I-797C), but not yet the final document (I-797). The case is pending with them.

The NOA was sent to my residential (non-US) address where I was when I submitted the whole paperwork in 2016, not to the address I had indicated as the mailing address (which was a US address, of a friend).

If you haven't received yours yet, try checking whether it wasn't sent to your residential address.

  6. Hi Yazounet,

This seems bad. I had a similar situation back in January and only last few weeks it was sorted out. Here's my timeline:

Department of State Decision: Favorable Recommendation

    Item Action Date
    Recommendation Sent August, 28 2017
Response to Funding Source Memo Received August, 23 2017
Funding Source Memo Sent January, 10 2017
No Objection Statement Received December, 08 2016
    Fee Received November, 30 2016
    Form DS-3035 Received November, 30 2016
    Form DS-2019 Received November, 30 2016
Passport Data Page Received November, 30 2016
Statement Of Reason Received November, 30 2016
    Other Received November, 30 2016
DOS Case File Number Sent November, 30 2016

During this 8+ months wait, I tried multiple times to contact the DOS but wasn't able to find out what the memo was or to whom it was sent. My previous sponsors never received anything.

This case, of "Funding Source Memo", seems somewhat more rare than the usual "Sponsor Views Request", and apparently takes a lot of time. I moved to my home country in the mean time.

Please keep us posted as it can help others in the future.

    Good luck!

  7. There was an update to my case a few days ago. No actual recommendation yet...

    Funding Source Memo - Sent - January, 10 2017

    Statement Of Reason - Received - November, 30 2016
    Other - Received - November, 30 2016
    [] - Sent - November, 30 2016

  8. I received a letter saying that my case number has been changed (it now matches the same number of the Advisory Opinion, and there is an extra "tab" on the top of the page):

    Fee Received November, 30 2016

    Form DS-3035 Received November, 30 2016
    Form DS-2019 Received November, 30 2016
Passport Data Page Received November, 30 2016
Statement Of Reason Received November, 30 2016
    Other Received November, 30 2016
    [] Sent November, 30 2016
The status is "Pending". The letter also says I have to communicate with the Embassy of my country in Brazil to let them know of the case change number, which I will promptly do on Monday.
  9. Hi all,

This is my first post, just sharing my ongoing experience:

    1) Asked an "Advisory Opinion", with the documents all sent on 13/Aug/2016, via mail, likely arriving on 15/Aug/2016. Then:

    Item - Action - Date

    212(e) Finding Letter - Sent - September, 30 2016
    Form DS-2019 - Received - August, 25 2016
    Advisory Opinion Request - Received - August, 25 2016
    2) Prepared the paperwork for the J-1 Waiver (No Objection) and sent everything by mail on 12/Nov/2016 (impossible to have this done sooner). It likely arrived on 14/Nov/2016. Now I'm waiting. The website still says only "Currently, there is no information regarding the status of your case. If you would like additional information, please contact Public Inquiries at 212ewaiver@state.gov".
    Waiting (well, pulling the hair...)
