    I would think they want to see it resolved before they approve.

    The only concern about this route for me is how long it might take them process and aprove me through this RFE procedure.

    You might get lucky and they might just MoveOn or ask you to get the case resolved before approving.

    I had no idea about the traffic tickets being as issue before applying for N400. I am thinking about just paying of the ticket without taking the option of deffered probation. I will just show that I have paid of the ticket by pleading guilty and withdraw my contest.

  3. I have a 2.5 years old school bus crossing traffic citation of over 500 USD. The ticket was controvarsial so I hired a traffic lawyer who is representing me for this case. We are still waiting for a court date on this ticket while I have N400 interview in two weeks. My traffic lawyer's office is saying that as I am not convicted yet so it should not be a problem. On the other hand many people and lawyer online say its best to not keep any citation pending during interview.Even if I try to pay this ticket I have the option to go on deffered probation for 6 months to make off record, if I do this my ticket will be eventually dismissed after 6 months but the immigration officer might hold off my decision until I send them proof of ticket getting dismissed through probation. Or I can pay off the ticket without probation option that way this ticket will be in my driving record, charge points but might not delay my interview decision. I am not sure what to do at this point. Can anyone help me find some answers to my questions?

  4. My spouse's i130 was approved  she in the USA. We selected adjustment of status while filing the i130. Now we are changing to consular processing since her f1 visa is over and we did not file adjustment of status in time.
    Can anyone tell me the consular processing time would be for our case? Will take too long to send the case to NVC by filing i824?

    I don’t know the details of how reinstatement works and whether or not pending pauses the existing overstay, sorry.

    Yes she is the same wife. We could not submit i485 back then because of sponsorship issue. We were about to submit it in next two weeks. But from what you have shared it seems like we can not do an adjustment of status anymore if there is no overstay forgiveness for her situation. Can she do a consular processing while she continues to stay in the US? She will do a F1 reinstatement application with her university, in case it gets denied will it be counted 180 days towards banned while it is pending.  

  8. I am a green card holder(US permanent resident) and my spouse is/was a F1 student. Her i130 was approved 9 months ago. But we have not filed for her adjustment of status yet. She was going to pursue a higher degree in the same university after her graduation in May. Her university did not notify her that she needs to update the i20 within 60 days as a result she is out of status now for one month. Her university is advising her to apply for reinstatement. But to decide that we need to know if we can still file for her adjustment of status(i485) at the same time or should we wait for one or the other? Can anyone please suggest the best way to get out of this deep trouble or share their insight into the situation?

    When you select "Spouse" it says the following:

    You selected you are petitioning for a spouse
    You will need to upload the Supplemental Information for Spouse Beneficiary (I-130A) as a part of the evidence for this application.
     

    Hey, Thank you for your response. It looks like I did select spouse and uploaded i130a file, just found it in the uploaded documents section.

  11. Visa catagory f4. After getting passport with visa an instruction is given for paying immigration fee of 220$. Is it to be paid for every person of the family? I think it should be.It is instructed to be paid before traveling to USA.Can anyone tell me how much time it normally takes to receive the green card after paying fees? Does the process initiate before or after traveling to USA?
