  1. I also called NVC today. I thought my scan date was December 30th since that is the day they confirmed that received my AOS and IV packets but they told me that I submitted my DS-260 on January 4th (that is when the system allowed me to fill it out), and that they only review the petition once all required documents have been received. They said the 6 weeks count is starting on January 4th, just that this Friday it will make the 6 weeks. She said my case is not in review yet and that they are still within processing time. So, any ideas? I see you all have the same issue, waiting passed the 6 weeks.

    Thank you all for sharing your experience. From what I see here only one person got the case completed.

     

    My i-130 was approved on November 28th and the NVC received the documents on December 20th and sent me the e-mail with the case # and cover sheet, is that my scan date? I am petitioning for my parents. I have called twice and they say that I have to wait up to 6 weeks. But I am not sure when to start counting the 6 weeks, they said to count once they had received everything. I submitted the DS-260 on January 4th and that was the last thing I had left to do. But they received the IV and AOS packets on December 30th.  Can anybody explain to me when I should consider the 6 weeks over?

  3. Hi,

    After you have sent form 261 choosing an agent and paid the AOS fee for $120, you should wait for them to send you the invoice to pay IV fees. Only after you have paid the IV fee will NVC produce the bar coded cover sheet. Once that has happened you will use that bar coded cover sheet to send your packet and to fill out DS-260.

    I am on the same boat, waiting for the NVC to send me the invoice. I asked this same question you have to my lawyer, so you can trust the answer. Also you can find this same answer in other forums in this website.

    I have an update.

    The reason why my petitions were kept on hold as I said in my previous post was that they sent a RFE back in June and I never received it. They never updated the website. Anyways, I requested that they sent me a copy of the RFE letter and they said because the time had elapsed they could not fulfill my request.

    I am writing this to give hopes to all the people who might be in my situation. Two days after they said they would not send the copy of the RFE letter I received a copy in the mail, together with a letter saying that they were expecting my response and if I did not send it they would deen my petitions abandoned and in this case I am not allowed to appeal I would have to refile.

    I rushed to read the letter, what they said was that my Birth Certificate was a "Later registered certificate" and they asked me to provide other evidence of my relationship with my parents that would convince them that I was their daughter.

    The thing is that my Birth Certificate is not late registered, my birth was registered one month after I was born, they confused the date I ordered the certificate at the government office in Cuba with the date I was registered. And of course it appeared like my birth had been registered in 2016! What a crazy thing!

    Anyways, I took a copy of my birth certificate again, together with a new translation signed by someone else (It could have been that the original translation was faulty), I wrote a letter stating that there might have been a misunderstanding, I clarified everything, plus I attached two affidavits from my grandparents stating that they were witnesses of my birth to my dad and mom and that my birth was registered in the date that appears in the certificate the same year I was born. I included all that with translations and certification by the translator (which can be done by anyone fluent in the two languages used, except for the petitioner or the beneficiary), I also included the original RFE letter and the other letter they sent and I sent the packet next day delivery.

    Today my two petitions were approved!!!! One week after they received my packet.

  5. Thank you for your response. I made an infopass appointment last night but it will have to be on November 30th, maybe by then they already denied the petitions.

    I don't know what you mean by 'put the applicant's name on the mailbox' I did not send the evidence they requested because I never received the Request for Evidence notice. They sent it in June and it is already November and now it is that I learned they had sent it back in June because I called and asked to speak with an officer. The officer said the deadline was back in September.

    Yes, I have all the proof that I inquired and they never updated the website or responded the way they should have.

    Does anybody here know how long after you fail to submit the evidence do they deny the petition? I need them to deny it so that I can send a new packet. I hate this people, they are so inefficient.

  6. I also have a similar problem. I filed all the documents as they requested in the petition for my parents (i-130) I had been waiting months and months and every time I inquired they said my case was pending action but never updated the system to let me know that they had send a RFE. I called and talked to an officer who said they had put the petition on hold until the received the evidence they requested and when I mentioned I never received it in the mail they said my petition would probably be denied because the due date to respond had passed and they don't issue extensions. They refused to resend the RFE letter and now I don't know what will happen.

    Does anyone know how long they usually take to deny a petition if the petitioner fails to provide the evidence they requested? I just want to file again and I am SO frustrated because this was their mistake and now I have to pay for that.

    I was wondering if someone here could help me. I filed i130 for my parents PD March 24th, 2106. They sent the packet to the Potomac Service Center. It has been almost 8 months since they received the petitions but the case is still in "Case Received" status.



    I inquired three times and they first said the case had not cleared all security checks, the second time they said Action is pending on this petition you should receive a notice within 60 days. I don't know what that means.



    I also sent a request to the ombudsman to help me and they said they will get back to me within 45 days. I called my congressman and they never got back to me, I guess it is because of the elections.



    I am really desperate. I need my parents to come for when they baby is born.



    Is anyone else in the same situation?
