Yeah, Nigeria is going to be a tough one to overcome unfortunately. My husband was denied fiance visa but for other reasons. A lawyer told me to get married and file spousal visa. That's exactly what I did, what else can you do? In a bonafide relationship you want to be together, wherever you end up. Good luck to you.

I am reading a lot that the petitioner is either being called or is going into the interview with the spouse. I have read this several times now. I clearly read on the instructions for the interview that only the spouse is allowed in, not the petitioner. I'm speaking in particular about interviews in Amman Jordan. Can anyone she'd some light on this?

So I have since figured out why they said no waiver was available when we first filed. When we filed under the fiance visa he was not eligible for the waiver. Now we are married. Being married he is considered a relative and therefore eligible for a waiver.

I just wanted to give an update. My I 130 has been sent to the Embassy in Jordan. I saw a bro bono lawyer who actually told me I have no chance of getting the visa for my husband for the simple fact that he has this arrest record. I spoke with the original attorney I first spoke with who said if he has not been convicted or plead guilty, he IS ELIGIBLE for a waiver. This was what I was thinking because it clearly states "conviction". No where in the police report does it say convicted or guilty....this is the main problem. I also believe I was correct when I said he was deemed not eligible for a waiver when we filed for the fiance visa whereas now he is the spouse and considered family. is this correct?

I believe the lawyer said he is eligible because he was not found guilty, the charges were reduced to threatening. I also have extreme hardship which he said could help. I take care of my elderly mother, my son is disabled and requires a special school, my son has a service dog, I suffer from mental illness and require medications and psychiatric monitoring and treatment. None of us speak Arabic which is why I cannot relocate my family there. My disabled son's father lives in USA.

The crime originally was "Murder Crime in Association". It was then reduced "offense of threatening with using the are". This occurred in 2012. I was wondering if the rules are different for married vs. fisnce eligibility of a waiver.

I filed a 130 spousal visa. We previously filed for fiance visa and it was denied due to a criminal charge on my now husband's record. They checked at the bottom of the page, inadmissible not eligible for a waiver. We went ahead with the marriage because what else is there to do? A lawyer reviewed the paperwork for his criminal charge and advices us to file marriage visa and a waiver but I'm not sure when to file. We have filed our 130 and received approval. I'm not sure if I should have filed the waiver with the 130 or should I file it before or after the interview?? Please help.!!

I contacted a lawyer. He suggested wait to get the letter to find out why we were refused. He states that I should go and marry him there in Jordan, the process is easier and cheaper. So now we paid all this money for k1 visa only to start at the beginning? I'm so disappointed.

So I checked the CEAC site today and it says REFUSED!!! What can be done? I'm not sure why they refused the visa? What if we marry in his country and file marriage visa? Any suggestions?

So my fiance had his interview. They asked him to return one more paper, as he has a criminal record. They asked for a court paper and Proof of relationship. My question is they asked him to drop off these papers by Aramex. Does this mean we are delayed? Will they send back the passport and tell us what to do next OR is it possible we will actually get the visa in this way?

Ok, so my fiance had his interview today in Amman Jordan, US Embassy. He apparently did not have some court documents? I'm not sure what they are asking for? They wrote on a paper 2010 and Proof of relationship. We are muslim, I have seen him once but we have not spent extended times together as this is not acceptable in our religion. I don't believe he told them that...ugh...I'm so upset that I didn't just go to attend the interview with him. Anyways, a few years back he was involved in an altercation in which his friend shot and killed someone. He along with his friend were arrested. He was held in prison for 2 years. He did go and get police reports but is there a specific paper they want?
Would you recommend me getting a lawyer in US at this point to help intervene? Or should I just go to Jordan and attempt to submit this additional paperwork with him?

Does anyone know if it's possible to get the K-1 approved without the Police Certificate and police paperwork. My fiance is having a difficult time getting this paperwork. His interview in in 2 1/2 weeks. I'm wondering if he doesn't manage to get the certificate should he postpone the interview or just go forward with interview and explain to them he wasn't able to get the paper. Maybe they will just tell him to come back when he gets it? He does have some criminal record and has been in jail but nothing for drugs, killing or anything like that. Anyone have suggestions.??

I am wondering if I need a document that proves my eligibility to marry. I have filed a K-1 visa for my fiance in Jordan. I have a divorce paper from my 1st and only marriage. My fiance says I need to get a paper that shows I'm able to marry, that I'm not married in the U.S. I was only married once and the marriage occurred in Jordan.

I am thoroughly confused!! I got an email that says my paperwork is now at the embassy in Jordan and I can schedule my interview. When I click on the link it sends me to a page. I started to put in the info then realize it wants my fiancee information, correct? Well he doesnt have access to internet, how can he schedule the interview.?? Then it asks for DS 160 munber?? what the heck is it asking for?? Im so upset..I have no clue how to get all this done!!

This paper reads: "Notice Type:Approval Notice" Valid from 10/20/2016-02/19/2017.
What are these dates? I haven't received anything else. I called the Uscis, they said my paperwork has been forwarded to NVC.??

I submitted the paper that he gave me. It says "General Ifta'a....Grand Mufti. And it's says...it says.."thus she is not his wife.."... It clearly says this so I'm not sure why I went they were saying I'm not divorced.

Hello, My question is a little complicated. I was previously married in 2000. I seperated in 2010. My ex states that he went to his country, Jordan, and filed a divorce because that is where we were married. We both live in USA. I went to Jordan in 2016 and tried to get married there to my fiance and for some reason theyou are saying I am not divorced. I have the paper translated into English and it states.." wife is considered divorced from husband". My fiance is saying my ex is suppose to pay me money and that's why they don't consider me divorced. Now, I have petitioned for my fiance to come to USA to marry me. In the meantime the state if Florida is pursuing child support from my ex, they said the only way they will stop is if a court gets involved. So now my ex filed for divorce here in the USA, NY where he lives.
Basically I want to know if this will create problems for me. I have received the letter of acceptance from California just this week. Should I get an immigration lawyer?

I'm going, just for moral support...and of course because I miss my husband. 🙂 If they let me in or call me in that would be fantastic...but I'm not planning on it.
