  1. I uploaded all the evidences to USCIS online up untill the case approved in April 2025. Should they already see all the proof of relationsship?
  2. Do you know if the consulate has access and/or review all evidence of relationship uploaded to USCIS online account ot they just see documents uploaded into CEAC?
  3. Not just that we live together since our marriage, we travel the world in the last 20 months. We have join brokerage account, I added her to all 10 credit card account, sole beneficiary on my Life insurance, my attaorney executed a new will to leave all of my estate to her and much more. But non of those matter to the CO. I am not crazy, neither is my wife
  4. Met, marry three weeks later and I have not left. I was able to work remotely. Can they denial her a visa base on that fact and age gap? Is there a legal way or procudures to over come those issues if that is the case? I fully understand that HCM consulate is a high fraud location. I am sure any court in the US will find we have a legit marriage, but we may not have that opportunity. The CO seem to make her decision based on felling rather than looking at thousand of pages of evidences I uploaded and have the original with me at the interview.
  5. Four Months from the first Facetime call. and facetime everyday for 3 months. before I make the trip and met in person. we get marry less than amont after I arrive theree in my first trip. After the wedding , I stay there and waited with her for 20 months during the process. During that time I cam back to the US 4 times, about 2 weeks each time. we also has a big age gap but all financial are comingle anf filed married joinly tax return for thr past two years. we have five family and friend on her side sign a sworn affidavit. I have 10 family and friend in the US signed public notary sworn affidavit including all four of my children and three American business associates. During the time we live there, we have two lease contract and just moved in with her parents two days afet the visa refusal.

The CO rquire me to complete Spousal Relationship evidence form and upload to ceac.state.gov together with additional pictures due to the fact that we marry 4 months from the first facetime call. sine non of the evidence document is list in the drop down box. Shouls I choose Pther as catergory for these upload? Anyone hand on experienced on this issue, please give me feed back. Thanks

  9. Your question was the estimated wait time on your USCIS online account, therefore, my reply was specific for that question. Of course, the actual waiting time for processing could be higher or lower based the speed the USCIS processing the backlog. For better understading the cases processing checkout this site: https://***removed due to spam***/i130 After USCIS proccessing phase, then the NVC steps will begin.
  10. You have three options while your CR1 in processing and you spouse still outside the US: 1. Married filling separately: You are required to report your worldwide income only. 2. Head of Household: If you have a qualifying dependent. 3. Married filling jointly: You must report your and your spouse worldwide income. Under this option, you cannot efile your tax return becuase your spouse does not SSN. You are required to mail your paper tax return with your spouse signed W-7 plus your spouse' passport. It will atkes IRS 60 days to process paper return before they issuing a TIN, and return your spouse passport to a US address listed on your spouse W-7. In year 2 and after, if your spouse still outside the US, you can efile tax return with his/her ITIN. W-7 instruction have a long list of documents you can submit with the application, but in my experience, applicant's passport is the 100% acceptance by the IRS. and the shortest time to get the W-7 application done.

  12. The NVC instruction for submit documents stated the following: "If you are or have been married, you must obtain original marriage certificate/s or certified copies of EVERY marriage." Is this apply to Applicant or Petitioner or Both? Does anyone experiencing visa rejected at interview because prior marriage certificates were not available?
  13. You are not required to file federal income until your gross income past filling thresholds by filling status. non-taxablle income is not include in your gross income for the filling purpose. These thresholds changed every year due to inflation. Here are example of thresholds for Married filling jointly: 2022: $25,900 -- 2023: $27,700 -- 2024: $29,200. Failure to file income tax (when required) is not a crime, the IRS will assess failure to file penalty and interest. However, if and when IRS sucessfully proof in Tax Court that an individual has committed an tax evasion scheme, only then you can be convicted for Tax-avoidance crime.
