Thanks for the information, that is what I have recieved from my lawyer. She has 13 days to file for divorce. Since she is on a 4 day bender, which will probably end today, since she is broke. My guess is that she has not spoke with an attorney yet.

My original question was about re-petitioning. If I understand the reply, if she leaves, without overstay, we can successfully petition again. Your advice maybe accurate, but the basis for having her deported is so she can get the help she needs, whether she is willing or not, which she is not willing.
In addition, she does not have the knowledge, finances or capacity to even find a lawyer much less mount a defense. Finally, there is the children and as long as she is tweaking in the house in their presence, she is endangering them.
She is done here for now, the law is on my side and I will spend every dime I have to get her the help she needs. If I give in, I will kill my daughters mother through weakness.
