  1. I'm wondering if the following events would be considered B2 visa abuse to a consulate officer when a B2 is up for renewal (the foreign national was awarded a three-year multiple entry visa to the US).

     

    First year;

    One trip to the US for six weeks paid for by the foreign national themselves involved sight seeing in multiple cities.

     

    Second year;

    Met and got engaged to a USC.

    USC filed an 129F/K1 petition.

    Four trips to the US over eight months all paid for by the USC.

    USC cancels 129F/K1 petition right before the K1 interview deadline due to suspected fraudulent intentions.

     

    Third year;

    Foreign national meets another love interest via the internet.

    Makes six trips over the course of six months to the US all paid for by the new love interest.

    *Foreign national cannot afford to pay for their own trips to the US.

     

    Four months remaining on current B2, trying to renew it again for another three years.

     

    How would a consular officer assess the use of the foreign nationals current B2?

  2. @DrEllaNJ - The situation with my friend's friend is simply a microcosm of what's going on in America right now in general. I'm here because ever since Trump's inauguration (I didn't think he was going to win btw) I've been fascinated by what's been going on with immigration reform.

     

    @KierenHby - "The US tends to be a tad liberal..." Again I think this was under previous administrations. Curious to see how all this is gonna end with her under Trump's if at all his administration does what they said they'll do.

  3. Curious as to what route they (the LPR and the foreign national) would take.

     

    It's a tough situation I'm in. I'm fully supportive of my friend who've I've known for a really really long time and she's being supportive of her friend who is the foreign national of topic. But I'm not at all supportive of her friend at all :/

     

    On a political side note, I'm in full belief of a diverse America, I'm all for foreign nationals immigrating to America but I believe they have to do it the right way. What this girl is doing is wrong. I think the saddest thing is this kind of thing is a regular occurrence these days.

     

    50% of illegal immigrants are visa over stays, all working off the books, all looking to adjust their status somehow. Some do it the right way, some will lie, cheat and steal. I hate to say it... maybe Trump was a good thing :unsure:

  4. @KierenHby - Yes she is now. She is supposed to go back to her home country this weekend actually but to be honest I'm not entirely confident she will despite being told by CBP to and having a return flight ticket.

     

    Which again is the reason I'm here on this forum. Wonder what's going to happen to her if she doesn't return home as she was supposed to and stays in the US while her B2 expires and tries to adjust her status some other way with an attempted marriage fraud on her record with USCIS.

    I'm curious about how all of this will turn out given the new stricter immigration policies. I truly do wonder how the new rules would effect a case like this compared to the old administration if at all. 

     

    All the attention on Trump's immigration reform is on the Mexicans illegally crossing the border, the 9 banned countries and H1B visas. There's not much said about visa overstays and status adjusters and k1/k3's.

     

    The foreign national in question I'm sure won't be outside the U.S. when her visa expires. She'll try to adjust her status some how from within the U.S.

  6. @roel - not sure if they put the "no AOS" in her passport or not, would that make a difference when she goes to renew her B2?

     

    @macUK - She obviously is "desperate" to come to America so yes by the sound if it she will be trying other ways now.

     

    @az2014 - Who said anything about me helping her? I hardly know the girl. I'm actually here out of curiosity to see how successful her future attempts would be at renewing her visa, getting a new one or adjusting her status because I personally don't feel that she (and others like her) deserve it.

     

    Update - I was talking with my friend earlier tonight actually, turns out her friend is now involved with "a very wealthy and well-connected LPR from South America" who knows about the attempted marriage fraud and who is trying to "help her adjust her status some how."

     

    This would be unfortunate if this would happen.

     

     

     

     

  7. My friend's-friend (a foreign national) got caught trying to defraud a USC (attempted marriage fraud) using her B2 visa.

     

    The USC found out and cancelled the 129F petition before the K1 could be issued. A red flag was issued on her visa and she is stopped in secondary inspection every time she enters the U.S., questioned, inspected to ensure non intent to immigrate but ultimately let through. She still however has 6 months before her B2 expires.

     

    She obviously wants to renew her B2 or try to adjust her status some how from within the US with a new petitioner (TBD).

     

    What are her chances of renewing her B2 (or getting any other visa) or being able to adjust her status from the U.S. with an attempted marriage/fraud on her ledger with USCIS and CBP?

  8. Sorry I mean to update this days ago...

    All is well, he did indeed have a "red flag" on his visa because of his history. He was detained for 6 hours, questioned and released and had an old girlfriend pick him up that we didn't know about and spent a couple of days with her haha.

    He had an assault charge 20 years ago back in his home country for getting into a really bad bar fight when he was younger which left the other guy in pretty bad condition. I a lot of time has passed since then. I don't understand how something he did so long ago still would effect his ability to come into the country now that he's an old man.

    Which brings me to my next question... once you have a flag on your visa will you always be detained and question upon every entry? I was told that this was the case and just wanted to verify that information here.

  9. If a foreign national with a B2 visa is denied entry into the US and sent back to their home country would that entry and exit attempt show up on their i94?

    If not is there anyway to find this information out?

    I have a distant relative that was supposed to be here two days ago. It was supposed to be his first visit to the US but has a criminal history. We are wondering if he was detained, questioned and denied entry and sent back.

    Any information would be helpful, thanks.

  10. Can you elaborate or better yet I'll ask this...

    So the blank departure date is just a dummy date but it does show that I did indeed depart correct?

    What If I didn't depart yet would it show a dummy date or would that only show up with an actual departure?

  11. What does it mean when the departure airport is missing and the departure date is the same as the arrival date on an I-94??

    For example;

    Departure 2016 March 22 "Blank"

    Arrival 2016 March 22 Los Angeles, CA (LAX)
