  1. I received my letter of what they want me to do, they think my husband doesn't speak English; not sure why they think that, maybe because he asked for an interpreter. They read some emails where he sent me poems, the emails didn't say I wrote this for you...whatever, I have been through our emails and I found an old Skype log (06-08/2010) the is 307 pages long to print and i have 79 pages listing our email correspondence that isn't even counting the Yahoo logs we would have. My question is for the emails, any suggestions on what i should provide? Some from each year (back to 2010) or recent ones? I don't want them to get mad if i send too much and certainly don't want to send too little. Also, does anyone know how to get a Yahoo chat log? I appreciate any help you can offer.

    ​Hello! I wanted to take a minute to answer your question. I worked for USCIS for many years so I am going to sugar coat my answer a bit since I can't see your RFE or your documents or have anything case specific ...

    ​When it comes to an RFE you must provide everything they are asking for OR proof that what they are asking for doesn't exist. You must also do this within the timeframe you've been given. There are NO EXTENSIONS to a RFE. As far the amount of documentation you're providing goes, think about it from the governments prospective. You are proving your evidence of relationship to us. The longer a relationship has existed means more time to establish important characteristics. So providing older emails would be a good idea. However, what documents and how many you provide are going to be up to you. If I can be of help, let me know.

  2. U​nfortunately, once a notice is returned by the post office USCIS simply holds onto it at their facility for up to 180 days or until the customer/atty of record requests it be re-sent, whichever comes first. When you contact customer service, they have no knowledge of why the post man (or woman) returned the document as undeliverable. They are simply there to assist you with getting the document re-sent. Once the request to have the document is submitted they'll provide you with a response timeframe .. if that timeframe passes and you don't hear anything or get anything, you would follow the directive given and most likely call them back. Anytime a notice is returned it is VITAL to the processing of your case for you to take action on having the notice re-sent to you. It is likely time sensitive. Case status online will provide you with details concerning how to complete the request to have the notice sent back to you or how to contact customer service.

  3. You should be receiving ASC apt. notices within 30 days of the date you receive the receipt notice. Once you make the inquiry through customer service you should get a response within 15 days. Sometimes it can take up to 30 days before another inquiry can be made if you don't get a response but receiving a biometrics notice is a pretty typical procedure unless theres been a lot of office closings or a major event like an earthquake or something that has caused a major delay with the scheduling of apts. ALL DACA applicants require biometrics.

    I'm filing through marriage, and I put the package together and did not want to go through an agency or attorney, which I regret a bit after receiving RFE.

    I received the yellow letter "Request for Initial Evidence (I-485)", I responded with my sponsor's 1040 (which I might have forgotten to include when initially filing”.

    I knew my sponsor had an income over 50k then later I found out that he had 35k business expenses that made the adjusted income about 15k (lower than poverty line).

    I included for evidence of assets my sponsor’s annuity policy (contract) which is 20k a month. Also I included a copy of my sponsor’s recent bank history showing monthly deposits of 20k. For evidence of assets I also included a 1099s form showing income from real estate sale for last year (2015) of the amount of 55k.

    I’m hoping they do accept the annuity contract and the 1099s form.

  5. Hello! I wanted to take the time to quickly answer your inquiries regarding your recent filing with USCIS. I'll answer your questions the same way you had them numbered in the post.

    1. If you filed the adjustment packet in June and are filing the I-765 now, no, it should not delay the adjustment process. The I-765 application takes an estimated 90 days to process and the AOS application will sill take longer than that, starting from now. (Question: did you file for AOS based on family/marriage?)

    2. There is no filing fee for the I-765 when filing based on concurrent or pending AOS - HOWEVER - because you didn't file them together, you would've wanted to have gotten the receipt for the I-485 and attached a copy of it to the I-765 to keep it from being rejected as proof of what you were filing it based on.

    3. There are stricter employment terms when working on OPT vs. when working on an EAD based on AOS. If you have specific questions regarding your employment terms based on OPT, you should contact your designated school official.

  6. Greetings!!

    It is my first post but I am a bit worried that I have made a mistake.

    I filed for AOS in June 2016, when I sent the package I did not include the I-765 as I already have EAD through my OPT which expires February 2017. While waiting for the process I received an RFE which I responded, understanding that it will delay the process.

    1. I was wondering if I was to file for I-765 now separately with it delay the process even more?
    2. Will I need pay the fee as filed separately or is it still included with my I-485 fee?
    3. Are there any employment terms difference if working through OPT EAD vs EAD through AOS?
