  1. A change of nationality does not change your identity. If it is a lifetime ban, I would say it must be of serious reason. The CBP has record of any entry attempt which I could attest based on my personal experience. Way back in 2014, we did a wrong turn from Niagara Falls, Canada which led us to the US territory after the bridge. We were held for almost 2 hours after explaining that it was not our intention to cross the border. After they checked our documents and they said “wrong turn happens”, they escorted us back to the Canadian soil without any stamps on our passport. I thought they did not record that as an entry but I just found out lately, after 4 years, when I printed my i94 after my K1 visa entry last Feb. 2018, voila! it showed that my first entry to the US was that wrong turn incident. So, to say that they have no record of the ban, I am sure they do.

    Since you are submitting your application online, you just need to include a copy of the Official Receipt from HK Police Headquarters as proof that you already requested the CNCC (Certificate of No Criminal Conviction). The HK CNCC takes weeks or more to process and is directly addressed to the office/agency requiring the document.

Since all our documents will be submitted online, should we submit it too or the police department here issuing the clearance will submit it directly to the US Embassy here in Hong Kong?     Thanks for the prompt reply. Just so frustrating that we have waited so long, more than a year since we submitted the application, then we finally got a reply that it has been sent thru the courier service when in fact it’s still in the Consulate.

     

    While for you this process has been a marathon, for us it has been a walkathon.😊

    May I know if you already got your visa? If not, do you already have the tracking number?

     

    I am asking because you had your interview last Wednesday and you were approved. I have been waiting for my passport and sealed visa packet since I got a reply to my Public Inquiry last Feb. 02, Friday, that it has been sent thru courier service but until now no tracking number has been given. I already checked at Canada Post and they told me that it has not been picked up from the Consulate yet since no tracking number has been assigned yet. I wonder what’s going on?

     Surely the K1 and IR1are different. But both received letters from NVC which is an Immigration Authority with the details of the petitioner and the beneficiary. The NVC letter my fiancé received did not clearly indicate that the production of a Police Certificate is required but I used that together with the Notice of Action 2 (NOA2) and the Hongkong Police accepted it. Actually, the Hongkong Police Certificate of No Criminal Conviction (CNCC) is sent directly to the office requiring it, in my case, it was directly sent to the US Consulate Montreal. It took 6 weeks to reach US Consulate Montreal from the date my sister in Hongkong applied for it on my behalf. In your case, I just don’t know where your CNCC should be directly sent, to NVC or to where the US Consulate  your interview would be. Below is the NVC letter we received.

I also worked in Hongkong before.  I used the NVC letter to support my request for Hongkong Police Certificate of No Criminal Conviction (CNCC). If you have a letter from NVC requiring you to provide Hongkong Police CNCC,  then you can use that. One of the documentary requirements is A photocopy of a letter from the relevant Consulate / Immigration Authority / Government Authority, which contains his or her name and clearly indicates that the production of the Certificate is required.”

    The thing is, if she gets the Hongkong Certificate of No Criminal Conviction (CNCC) before she leaves Hongkong, it might not be valid anymore on her interview date.Unless her interview schedule is within one year. 😉

My Fiance, originally entered into HK under her maiden name.. went back to Philippines to marry,  and then came back to HK with her Married name/passport 2 years later. Now, shes afraid to ask for her clearance papers as she feels she entered back into the country illegally.  Oh by the way, her original passport has a different year of birth so she could work in Lebanon at an earlier age. The request for the Lebanon police records have already been requested. 

     

    Not sure if I worded this correctly or not, but thats the jist of it. Same person, 2 different passport names, 2 different dates of birth. She feels that she wants to take care of this mess once she returns back home.. suggestion or comments?

    What's wrong with using your maiden name? Also, when she came back in Hongkong, if she used her married name, she must have declared also her maiden name on her new passport. When you request for HK CNCC, you fill in a form and there you need to fill in "other names used".  As for the discrepancy on the date of birth, follow what's in her recent passport coz that's her travel document and I assume it's based on the birth certificate and marriage contract submitted when she applied for that passport. I hope I make sense😉.

    how long does it take for you to receive the NOA 2 btw?

    We had our NOA 1 dated Jan 5 then NOA2 April 10. You may refer to my timeline. Good luck!

    We have similar situation with your fiancé. I worked in Hongkong so I need to obtain Hongkong Certificate of No Criminal Conviction too. I downloaded and filled in the application forms from that site and had my fingerprints taken by authorized fingerprint agency here in Montreal. Then I sent my application to my sister in Hongkong with authorization letter thru Canada Post Express Mail, I paid 65 CAD but it was delivered within 5 days. Then my sister applied on my behalf and the police officer told her it will take 6 weeks to send the Certificate directly to the US Consulate in Montreal. My sister requested in May 11 and the US Consulate Montreal received it before June 20 since as soon as I saw they updated our case at CEAC, I emailed them to ask if they did receive my HK CNCC,  they immediately confirmed receipt. 

     

    My work permit is also expiring in Feb. 2018. My advise, when your fiancé sends the Packet 3, make sure he includes a copy of his work permit to establish his status in Canada.

    Did your CEAC status show "Ready" when you had emailed your Packet 3 documents?

     

    Yes, As soon as our status showed "READY" at CEAC, I emailed our packet 3. Resent it a week after. I just got the auto-reply on both times and saw that everytime I sent the Packet, it showed updated on that date they received my email.

  14. Hello everyone! I am hoping someone in the group could enlighten me with the confusion I am going through now. Our K1 visa application was approved April 10 and was forwarded to US Consulate Montreal since I am working here in Canada. Patiently waiting for the Packet 4 to be able to schedule medical and interview. We are having a co-sponsor but the confusion now is that though the US Consulate in Montreal accepts co-sponsors, my being a Filipino citizen beneficiary does not allow me to have a co-sponsor. Does it follow that since the US Consulate in Manila does not accept co-sponsors for K1, other US Consulates would also not accept co-sponsors for Filipino beneficiaries? Please anyone help. Thanks so much in advance for any comments.
