It happens all the time. However, under VAWArules you will not find out if the petition was approved. I can say she must be able to prove that she has been changed suffering in some certain ways or suffers from PTSD. You have to kind of understand that this process is beyond anything you can control. It does not give you a criminal record or show up in employer data bases. Please try to relax, no one likes false allegations made against them, but in this case there is nothing you can do except submit your side of the story along with proof and move on.

Sorry about your situation. Well what should be done is immediately write to USCIS canceling your petition, be sure to sent any letters to USCIS certified mail, return receipt requested so you have proof of delivery. As a precaution drop the same letter at the local office via Info pass, this way you have covered all the bases. Buy her a ticket home and if you can afford it give her some money to help her start over, she gave up everything to be with you, not a million dollars but some, give it to her when she gets on the plane home. Also, watch out and be very very very careful about a abuse claim to a domestic violence claim, life can be difficult if she does this. File for divorce in court send her the papers in her home country and you are done. Always remember divorce laws vary from state to state and you should consult with a attorney. I agree with Aaron. If you sue, you might win, it will take about two years or however long it takes the feds to put your case on the docket. Is it really worth it to put yourself through this? And even if you won would your ex be able to pay? Can you afford another attorney? If needed on the federal level?

When you send your letter be sure to send certified mail signature required and maintains all copies in a separate files.
