"has anyone gotten approved because of the "180 days" rule yet? as in approved for GC, but name check is still pending? and if so, did you get a 10 year GC or 2 year GC? i'm eligible to get a 10 year one, but wasn't sure if they approve the GC and the name check is still pending, if they were just issuing 2 year GC's even for people that are eligible for a 10 year one? "

    my husband was approved after a 3 year wait right before the "180 day rule" was announced. we dont know if the name check was approved or not. we just got the standard welcome to america, greencard ordered letters. he got the 10 year one. i still wonder today if he was approved and out of name check or just fell into the 180 day rule. guess we will find out later when he files for citizenship.

    lal, have u heard anything yet from your fingerprinting appointment?

    No, but we expect a few months wait since fingerprinting as that is what seems to be normal. The only thing that makes me really uncomfortable about all this is that we dont realy know if we are done or not. Previously, if you got stuck, and were adjudicated, you knew you cleared the check. That is piece of mind. I wish we knew.

    In my case I don't care even if they are not done with my background check. What bugs me is I have a clean record since the day I was born. I came to the country legally, lived legally worked legally, I can go on and on. I am waiting because FBI doesn't have time to look at my case. After I get my green card I am set.

  3. So would anyone care to make an educated guess what the percentage of name checks that are finished by the time of the interview?

    According to a report released in June 2007 by the ombudsman for U.S. Citizenship and Immigration Services , 64 percent of the 329,160 FBI name check cases pending from USCIS have been waiting more than 90 days, and 32 percent are more than one year old. There are more than 31,000 cases that have been pending longer than 33 months.

  4. On form I-765 question 11 it asks, Have you ever applied for emplyment authorization from USCIS? Which USCIS office? Date(s)? The question I have is what do I put for date?

    I filled form I-765 on 07/06/2006

    I mailed it on 07/21/2006

    USCIS received on 07/24/2006

    Card was approved on 10/12/2007

    Which date do I put?

  5. Shami are you still waiting to hear something? Have you received any emails or anything? I can't imagine waiting that long without any word! This is going to drive me crazy.

    Lucy N Bebe, we have gotten RFE's. They are both related to the sponsor I-864. My wife did meet the salary requirement of $18,000, but they said we needed a joint sponsor. So, now her parents are the joint sponsor. It seems like they are just dragging our case. We were considering writing to our congressman if they drag this on much longer. We wish USCIS would just come to our house and make inspection visits if they are suspicious.

  6. We had a very similar experience in Cincinnati, Ohio. Our interviewer became suspicious from the beginning. He interviewed us together, then separately, then called me in for another separate interview. He was obviously trying to get us trapped in our answers because he was asking us specific dates of when we saw each other, talked on the phone, etc. His first question was how did you know he was the one for you since you only knew each other a short time. This began his suspicion. Also, our wedding was simple (i didn't even where a white dress) and we didn't have a professional photographer so I put the wedding album together and he criticized it saying " when did you put this together?" In the end, we asked whether it was aproved, he said " I have to do some security checks, you'll be notified by mail. I have lived in US legally for 10 years, paying taxes all ten years. Never committed a crime. Entered the country legally, too. So, what security check is he talking about? He didn't even ask about important things like our documents. He asked stupid questions like did our church help arrange our marriage. We are extremely bothered, but in the end our relationship is on the up and up, nothing to hide. We married for love, so we figure there is no way they can deny. My wife is a US citizen and has all the rights therein to go to congressmen and such.

  7. We got a RFE that stated:

    Please submit an I-864 for your joint sponsor with an original signature. The I-864 you submitted is a copy and does not contain an original signature as required.

    What does this mean? Every form we submitted were photocopies, because in the USCIS Assembling applications tips they state to send photocopies. So why are they asking for original signature?

    Also they sent us an I-864 form to us. We already have the filled original form with my father-in-law's signatue. Why can't I sent it? Why do I have to send a new I-864?

  8. I am using my wife’s parents as joint sponsor(s) for I-864. I have two options:

    1) Use my wife’s dad as the only joint sponsor. Which requires filling one I-864

    2) Use my wife’s mom and dad both as joint sponsors. Which requires filling I-864 and I-864A.

    Here is my question. They filed their taxes jointly. For example, Mom made $40,000—Dad made $50,000. Their taxes say $90,000 combined. Question 23 on form I-864 asks what the annual income is. If I only use Dad (option 1 above) as a joint sponser do I put $50,000? Will USCIS wonder why I didn’t put $90,000.

    $50,000 contains his pension, 401K, social security, and part-time salary. He is retired, but also still works part time occasionally.

    If I use option 2, (both parents) what should I put for annual income for form I-864 and I-864A?
