  2. Hey Frds in VisaJourney who are still in CR1/IR1 process,

     

    I have a big concern about 864a. The instruction said that this form is for those household members who are going to share his or her income /assets to support sponsored immigrants along with the sponsor. But I also heard that whether or not the household members have income or assets, they must fill 864A to indicate their consent about sponsoring. 

     

    Now, the situation is, I am the application, my husband is the petitioner, and my sponsor is a friend of my husband. Her husband is still a student which means he hasn't have a job yet to earn any income to support me along with his wife. In this case, should he fill this 864A?  I am totally lost.

     

    Thanks in advance. Any suggestion or advice would be big grateful.

  4. I have applied my ssn before when i was in the US, and now while I am filling with DS-260 form, the last page question is about  Do you need a new card issued? 

    What should I choose? Yes or No?

    If I fill yes, will the SSA issue a new card with a new SSN on it? I don't want a new number which will cause lots of problems on my credit record or something like that with my old one.

  5. Never heard of that before.

    This sentence is for K type visa as far as I concerned, so there is nothing to do with CR/IR type visa, therefore you don't need to worry about that.

    And, I lost my passport on which had my F1 student visa and J1 visitor visa so i don't have my old passport any more, don't even mention police report or something. If you lost something, there is impossible to cal 911 to get a police report right? It doesn't make any sense.

    So don't worry too much about that.

    The only way the spouse of a sponsor will be required to fill an i864a is if their assets are being considered for your petition. My mother inlaw did not have to fill a form, my father inlaw alone filled the form and they were classed as "Married, filing jointly" because of her previous work history but she was unemployed at the time of my petition.

    So, no....the spouse of a sponsor is not required to fill a form once the sponsor themselves is financially able to support the beneficiary ;)

    My joint sponsor is my friend and her husband is a student so her husband doesn't have any income even they are fill tax return together.

    So after your explaining, I think he doesn't need to fill 864A form. :)

    But I also heard of that a sponsor's spouse have to file out I-864A even if that sponsor has enough income to support the intending immigrant alone.


    Does sponsor's spouse have to file out I-864A or not?

  8. I am so confused about household members, who will be counted into household member?

    I read through USCIS webpage it is said like this:

    • Household members are the spouse or other relatives who live in the sponsor’s residence, who are already supported by the sponsor and/or who will contribute income to the financial sponsorship of the principal immigrant and his or her family members.

    My question is this: What if a relative (such as parent or adult child) lives together with the sponsor but they report income tax separately as well as this relative won't contribute his or her income to meet the financial sponsorship for the principal immigrant. Should he or she be counted in a household member?

  9. "Notice Was Returned To USCIS Because The Post Office Could Not Deliver It " YAH, just like the topic here, USCIS gave me a surprise.

    Thing is like this: I sent out my file on 2017-07-07 and luckily I did receive a text notification from USCIS told me that my file was delivered and gave me a case number.

    However, I've not received any hard copy letter NOA1 from uscis so far. On 2016-08-08 I refreshed my case online and got this Notice Was Returned To USCIS Because The Post Office Could Not Deliver It .


    I called back to confirm and request to remail me again, but I think USCIS or USPS screw it again. Because it''s almost a mother until now, I haven't get a single letter from uscis.


    Should I call back to them asking a copy once more or should I apply an address changing application online?

    How long will it take to change an address, how many days do they need to process that?


    Any suggestion will be great helpful to me.

    I know it's stupid but I still wanna ask this:

    After 3 days my husband filed out I-130 case to the assigned USCIS Lock box, he got a text notification from USCIS indicated that they got our case and gave a case number.

    But I just wonder that was he supposed to receive a email notification from USCIS? Is that normal that he just got a text?

    Fiance means you haven't married yet right? I think he can get his B1 visa as long as he doesn't show any clue that he is engaged with you when going for an interview. Just being a visitor to travel to the US or a friend to visit you or something like that. BUT, he may get some troubles when applies adjustment of statue in his future application inside of the US border. (Just Maybe)



    Because B1 visa is just issued for those people who only have traveling and visiting purpose, getting marry and applying adjustment of statue violates that rules, thus USCIS may deny his future application when applying green card inside of the US border. (Just maybe, I heard of that many people get marry with their citizen fiance in the US with tourist visa, that's fine, also they usually apply a family-related visa outside of the US in case of getting denial by USCIS)



    K1 is good for him, that is the most suitable visa type for him to reunite with you.

    Yes she does need to go through the interview at the US embassy located n your mom's home country.

    --How long does it usually take to get her permanent card in the mail? How long will the permanent card be valid for?

    It will take 4-8 weeks to get her PR card after she touches the American soil. But it depends on case by case, you can track the Green Card procedure by your IOE number.

    PR card has 10 years valid period.

    ---Also, how long after receiving her temporary card will she be able to start the naturalization process? And how long will this process take?

    She can start her naturalization process after 5 years she gets her PR, as well as during this 5 years she needs to stay inside of the US border enough time to make her eligible to apply citizenship and she also needs to pass naturalization test. ( check up USCIS main website to ensure that, I forget the exactly time sorry dude)
