Yes we have a divorce decree , (“Extrait de Divorce” – Applications for this document need to be submitted to the La Mairie’s office that has jurisdiction over the region where the divorce took place) that meets the document requirements outlined by the State Department. However, the embassy staff turn the beneficiaries away stating they will only accept Jugement de Divorce”from the “Greffier de Tribunal Civil” where the judgment of divorce was pronounced. 

    Has anyone else experienced the embassy not accepting the documents?   If anyone has any experience in this area that would be helpful, and how you navigated the process.

I'm curious if anyone has any experience or knowledge about document requirements.  My beneficiaries attended their visa interview, IR-2 category, and were given a deficiency checklist for an original marriage license and original divorce decree. We provided both documents but they are now being told the divorce decree must come from a "tribunal court" (Senegalese equivalent their highest court) and not the local City Hall.   This information is not written on a checklist they agent at the document window will only give this information verbally to the beneficiaries when they present the documents at the embassy. 

    I've reached out to the Congressional Liaison and they were given the same information that is on the checklist and are being told the divorce decree only needs to be an original. 

    Has anyone else experienced the embassy not accepting the documents?  We have tried to have a divorce decree issued through a "Tribunal court" and we have lost $5k paying lawyers and never getting anything or on a court schedule. If anyone has any experience in this area that would be helpful. 

     

  3. Last month I had my senator request an expedited interview with the Dakar Embassy on behalf of my stepchildren due to displacement issues coming in Senegal. Our request was denied citing it would not be fair to other families waiting. I have contacted NVC to request an appeal of the expedite denial this week. My question is has anyone had any success appealing and denied expedite? If so were you given criteria of the Embassy for granting an expedited interview request?

    That is what I am inquiring about in my post. If there could possibly be anything else requested? My spouse previously went through the process, the children are now wanting to immigrate after. Is any consideration given to the fact that the primary parents application was approved already?

  5. I recently filed the I-130’s for both my stephchildren to join my spouse and I here in the US. Previously I filed for my spouse and it required mailing in full packages of documents. This new process was a bit strange just filing the form online and attaching the marriage certs and birth certs. I fee completely deficient with information. 

    Can any provide any advice or tips. We have been through this process before with my spouse, but just would like to know if we should prepare for anything out of the ordinary. 

  6. I don’t polies for my spouse and he has his visa approved. In the process I was assigned to an overseas work assignment for three years. I am on an a-2 visa in South Korea and want to bring my step kids here while we wait for USCIS to approve the US immigration. Has anyone had any experience with this type of process? I have been reading and it looks like it could be possible if the Korean immigration adds them under me as their sponsor.

  7. My spouse's petition has been approved, he has his green card and is living in the US. We are wanting to file for my stepkids now to come, but I have taken an overseas duty assignment for the next five years. Does anyone have any experience with this? I am on a work Visa in South Korea, but will return in approx. 2023 after this assignment. How would that hinder the process of the I-130 for the stepkids, if in fact it will. My spouse is working at a warehouse in the US to get some familiarity with US life and to have some work history, but he will be moving to Korea permanent in January 2020. Does anyone have any advice? 

  8. Your case makes me hopeful! I received my response from USCIS and they have sent the case back to the Embassy in Senegal. Seeing your timeframe from the appeal decision to the issuance is about 4 months, I am gauging myself on that for us to hear something for scheduling (but you never know).

    Congratulations again! Now time to live life, something so many people who don't go through this process seriously take for granted.

  9. Our case was reaffirmed by USCIS back to Dakar this August. Hoping it will arrive at the embassy in the next three months for interview scheduling. Beginning of the federal FY so fingers crossed they get him in and issue the Visa this go round with out the extra shenanigans.

    I'm pretty sure you can get your logs directly from Viber.  Try contacting the company directly.

    Thanks - for Viber, I actually found an export of for a period of time that I submitted to NVC and my spouse took to his interview. I will have it all translated, at least the part in French and Wolof, to show we communicated prior to marriage.

    My husband is going to have some affidavits from people over there prior to marriage, and that attended the marriage and know us now. I  didn't think about getting any from people here, but I see your point. I can get some from multiple people that knew we were intending to get married and prior as well.

    Social media stamps...not so much. It's funny most people share that with the world, but me not so much. Even after marriage I have posted very little, just some sporadic shares with family. My best bet might be the friends and family members that knew and know us. He actually speaks with multiple family member through chat platforms. And he and my oldest chat reguraly online. my stepchildren also message with my oldest son on their own. Strange but we have tried to function as normal as possible in this very abnormal family we have created.

    Any other suggestions are welcome. In my mind the packages I sent were overkill, but clearly I was deficient.

  11. I don't have the final answer from USCIS but a letter was mailed to me on May 17, 2018 stating USCIS is revoking the original approval. My spouse interview in June 2017 in Dakar, and his case was returned to the state department. At the time of the interview he stated the lady told him all our pictures are in the same place. He told her that was not true, if she wanted he could tell her where all the photos were taken and at what time. She ask him at that time why he had my passport. He explained the passport was no longer valid because i changed my name and a copy of the newly issued passport was in the package to show the name change, that old one was submitted for the stamps and documentation.

    I have been reading other people's post, and the one thing I keep seeing is people state they send copies of their chat logs for documentation when this happens. I have a little bit of a problem, I upgraded my phone and my Ipad since we started dating (ipad Pro came out as the did the iphone X) and I just downloaded whatsapp and viber again. How was I supposed to know that stuff would be the crux of everything. I am not even sure my husband knows how to export his chat logs on his phone. I do have some Western Union transfer receipts, from prior to marriage to show when I helped him after his automobile accident. Which we wrote a long letter initially when we applied stating we only decided to get married after that life changing event.

    Even though I don't have their response, I am sure it will be for validity of relationship. (Seems to be the majority of the returns from Dakar Embassy in my opinion.) Any ideas what I could send to their request.

    I have returned to Senegal twice since his initial interview for varying lengths of time. Unfortunately someone suggested I go and stay for a month or more, but that is just not a feasible idea. The only reason I didn't just move and live with my spouse is because I am in the middle of a career I have worked hard to establish. I'm a typical American and I take the standard weekly/two week vacations, which work since I am in charge of a unit. I'm a lowly federal employee, and leave isn't distributed in abundant amounts.

    Any thoughts would be well received.
