Are you sure it is the approval notice or just the NOA1 to inform you that they have received your documents?

    Its definitely the approval notice. It says it on the right near the top;

    Notice Type: Approval Notice

Section: Person admitted to US as fiance(e) or child of fiance(e)(K-1/K-2)

    COA: CF1

Also when I called USCIS they confirmed it had been approved

  2. Hi,

I received my approval notice over 40 days ago in the mail. Was pretty quick and I didn't have to interview (entered in April on a K1, Married in May, submitted AOS End of July). But as of today its been 41 days and I still haven't got my Green Card in the mail. Has anybody else on here had theirs take so long from getting their approval notice?

I called USCIS at around the 4 week mark and they told me it could take up to 60 days. But my case status hasn't been updated online either

    Thanks,

  3. Hi All, I just reveived a I-797 Notice of Action in the mail for an approval for my Adjustment of Status application.

This is really exciting news but also very confusing. I applied for Employment Authorization at the same time as my adjustment of status (as is common) and I've heard those usually take less time to get approved than adjustment of status. I also expected an interview date instead of just an approval. So I'm not really sure what to make of this. Can anybody shed some light on this for me?

    Here are my immigration details:

    Visa Type: K1

Date of Entry to USA: April 12th 2017

    Marriage Date: May 6th 2017

    I495 filed: Mid July 2017

    NOA1's Received for I485 and I764: July 31st 2017

    Biometrics Appointment: 25th August 2017

Since then I have been waiting for my employment authorization to come back, and expected it sometime in the next few weeks.

I have also attached a picture of the notice I got today.

    Thanks for any help!

  4. Hi,

I recently moved to the US on a K1 Visa and am working on my Adjustment of status application. My wife and I got married and bought a house however for a number of purposes, we are continueing to use my wife's parent's address as our place of residence. These purposes are for my drivers licence so I can stay on my wife's car insurance and for the address my bank uses as our bank provides our car insurance and they will only do that if all policy holders are florida residents.

The problem is, the house we bought and technically live in is in New York. So my question is if I put the Florida address down on my AOS application will the following interview/biometrics appointments be assigned to locations close to that address, or will I be given an opportunity to pick the location, allowing me to pick a location closer to our New York address?

Secondly, will it harm my application to put our address as our New York address, even though the K1 visa was applied for using the Florida Address?

Thanks for the help, I hope my question is easy enough to understand?

I tried getting a drivers license through my I-797 NOA1 from AOS. Honestly, with all the hassle that came, I don't even recommend it either. Verifying me was taking almost two months for them.

I'd say, wait for you employment authorization card and apply for a license. Easy peasy and you walk out with a valid drivers license.

hmm, fair enough. The reason for the rush is that currently its costing my future In-Laws a lot to have me on the insurance for the car they are giving to me, so time is really of the essence on this one. I'm planning to fly back to FL for a couple of days to get it done but I want to be 100% sure I'll be able to take the test so I don't have a wasted trip

Generally I think I have seen most people be married first, then apply; but not entirely sure if that is the case for Florida..

Same goes for the 61 days or fewer thing... most people I have seen if they get a driver's license while on their I-94 through the K-1, the license expires at the expiration of the I-94, then they have to go back to get a new/renewed license showing they applied for AOS.

    Thanks for the info!

So if most people get a new/renewed licence after applying for AOS, does that mean I can go and get my licence for the first time after I have applied for AOS? This will be well within the 90 days of the I-94 but less than 61 days?

  7. Hi all,

I recently moved to the US with my K1 visa and everything is going great apart from one small problem; getting a florida drivers licence. I went into the local DMV the day after I moved and my local office processed my application and let me sit the written test which I then passed. No problems there. I went back to the desk and they told me the earliest they could do a practical test was 3 weeks, which didn't work for me as my fiancee and I were driving up to New York 4 days later, and staying for at least a few months. So we went to the county across which does walk in appointments, but they told me I couldn't sit the test as one of the requirements of the K1 was to be married before they could give me the licence. They also told me that i'd have to come back and get the licence with no fewer than 61 days left on my k1 visa.

So my questions are as follows:

Do I have to be married before I can get my licence or is this guy incorrect?

Will I be able to get my licence if have fewer than 61 days on my visa?

    thanks

  8. Hi All,

I went to have my interview yesterday for my K1 visa at the US embassy in London, all went smoothly and I got an approval!! I know it will probably just take time but I'd be interested in knowing what happens and some timescales for updates to my case on CEAC.

I've read that for London, my case will go into Administrative Processing for a few days before being issued. However even though my interview was yesterday (March 7th), my CEAC page looks like this:

    Status: 'Ready'

    Case Created: 16-Dec-2016

    Case Last Updated: 07-Mar-2017

Is this normal for a K1 visa in London? And if so, how long roughly before it goes into AP. I was told by the case officer I should get my passport back in 'a week or so'

    Thanks everyone!.

  9. Thanks again everyone for the great insight and advice into the process. I'll admit, I haven't done much exploring into different options and routes to take. Obviously I'm not going to jump into anything sooner than we are both comfortable, but I will be seeing her for a month, and I feel like if we get along as well in person as we do online after a month, my mind will be set on whether I want to marry her or not.

The reason I have been searching for a job in the US is so we can avoid going the 'marrage route' to living together as we both agree that we want it to be done because we are ready, not because we can't stand the LDR any more. That is one of the reasons for keeping it a secret from family for now. The second reason, is because both of our families wildly disapprove of long distance relationships, yet alone making a decision to marry (which after this trip we will both be ready to or not). Its not to violate any sort of marrage of convienience, we both are genuinely in love with each other and can prove it. (no exaggeration here, there hasn't been a 6 hour period in the last 12 months that we haven't been in a skype call / facetime call).

However, all things considered, I think our best route is to go for a K1. We'll see how the trip goes in a month, then at the end of it decide whether to file it then, or after another trip. In any case, it seems like there will be less scrutiny from immigration, and probably an overall shorter wait time, i'll just have to figure out a way to support myself for 3-4 months while I get a work permit and job

  10. Thanks everyone!! All really useful and relevant information.

To clear up some confusions, we will be meeting for the first time in a month. While I am over in the US visiting her, we plan to start the visa process. Whether we go the K1 or CR-1 route now comes down to the great information here, and what we feel is best. I can easliy use the property as the asset requirement (its valued at close to £300,000) and pulls in the equvalent of $25000 a year in rent.

Its probably time for a little more background. I have been looking for a job in the US for about a year now, and have been unsucessful. (not surprising really as what company wants to hire a graduate and have to pay $25000 to get them over here). So we decided to go the marrage route instead. We both agree that we want to get married, just from a family standpoint, both of our families would rather us wait. So we plan on getting legally married soon, but keeping it hidden from our families until she finishes college. That means affivavit of supports from her family are off the table, and hence the questions about self support.

I'd ideally like to work as soon as I can once I get to the US so going CR-1 may be better in that respect, but I can also support myself if needed.

Why are the CR-1 requirements much tougher? What else do they want to see that they don't for a K1?

Thanks again for all the wonderful information

  11. Yes, it's perfectly legal to get married as a tourist in the US, as long as you intend to return home without overstaying.

The K1 would probably also work for you. The London embassy is known to be very easy on K1 applicants.

That certainly is good to hear! I have another few questions if you don't mind me asking?

With the knowledge that a K1 may be faster and easier, would it be a good idea to apply for one now, before I visit her in a month? would that accelerate the process, or make it harder in the long run?

My S.O. in the US is currently a student, which to me raises questions about whether she would be able to support me while I find a job. What would be the best way to show that I could support myself? I own a property (outright, no mortgage) that I rent to students pulling in £1600 a month, and will be entering full time employment in August (I have an accepted job offer).

Following up on that question, would it be a good idea to set up a joint bank account in the US with her (married or not) and pay some savings into that account every month?

I know i'm asking a lot, I just want to learn as much as I can before starting the process. Thanks a lot for your help!

  12. Hi hi,

Bit of background before I get into the details; I'm in a long distance relationship (as many of us are) with a girl (23F) in the US. I'm 22M, living in the UK, and i'm going to see her for the first time in 3 weeks. We've been together for a little over 2 years and now that i've graduated university, I want to live and work in the US. (my trade is Computer Science for anyone wondering). I'll be going to see her for just under a month, and my question is as follows:

Considing I am travelling to the US as a tourist, would it be breaking the terms of the visa waiver program to marry her while i'm in the US, then have her file for the I-130 when I get back to the UK? I've been browsing the forum and it also looks like it may be faster to go the K1 route in that case, but I have also heard that my application could get rejected since this will be my first time in the US and first time visiting her?

So in short, i'm looking to marry my girlfriend in a month, then return to the UK while the Visa is processing. Am I allowed to do this, legally, without affecting the liklihood that my visa will be accepted.

Thanks for any and all advice,

    Scott
