    The standard for the 3 year rule for N-400 is "marital union," meaning still married and living together. That's a higher standard than I-751, which is just good faith marriage at the outset. So if you don't want to wait 2 more years, you need to submit similar evidence again, either online or at the interview.

    You should speak to a lawyer. You have to be living in marital union to qualify for naturalization under the 3 year rule and I'm not sure you will be if there's a pending divorce. I think you'll also need to switch to a divorce waiver if the divorce is final before the I-751 is ruled on. But again, a lawyer will be able to give you real advice on this stuff.

People who received their NoAs around Dec 13 are in their 13th month of wait. According to USCIS, the lower end, i.e. 13 month should signify that about 50% of the cases have been processed. Based on the case tracker I do not think that is the case. Likewise, I doubt that by the end of next month 50% of the cases that were NoA-ed in January 2019 would be processed. They really should work hard to minimize the processing time gap. One applicant get approved after 13 months, yet another gets approved after 17.5 months. On the other hand, many people who filed with Nebraska Service Center in February, have already been approved despite Nebraska Service Center's longer processing time.  

    To be clear, none of this is fair. When Congress created the Removal of Conditions process, it envisaged that cases would be ruled on within the 90 days before the 2nd anniversary and strictly limited the question before INS (now USCIS) to whether the marriage was in good faith. As with all immigration processes, the current administration has subverted the law by adding bureaucratic steps and demanding information that has no relevance to the issues it is supposed to rule upon - as well as demanding ever more rigid categories and paper-heavy amounts of evidence of good faith. Any delay of more than 12 months in adjudicating I-751 cases further violates Congress's intent that married couples be able to naturalize after 3 years. I strongly encourage everyone on this thread to naturalize as soon as they are eligible in order to vote and to talk to friends and family so that they consider this in exercising their vote.

     

    When I talk about decent progress, what I mean is that it finally seems that some people in our cohort are getting approved. It does not mean that the absurd yearlong wait is in any way acceptable.

  4. Hey all - another update for Vermont based on the Case Tracker app:

     

    EAC19990049000-500: 3 approvals, 2 RFEs, and 38 pending. Dates of last updates for particular cases indicate that on 1/10, there was one RFE and three approvals/card mailings.

    EAC1990049500-50000: 5 approvals, 6 RFEs, and 89 pending. One RFE on the 8th and 2 each on the 9th and 10th,  1 approvals/card mailings on the 9th, 4 on the 10th.

    EAC1990050000-500: 3 approvals, 2 RFEs, 62 pending. 3 approvals/card mailings on the 10th; 2 RFEs on the 8th

    EAC1990050500-51000: 11 approvals, 1 RFE, 162 (!) pending. 9 approvals/mailings on the 10th and 2 on the 9th; 1 RFE on the 8th. Also 4 transfers (presumably for interview) on the 10th, 1 on the 7th, and 1 on 12/30. One interview scheduled on 12/27.

     

    So that's decent progress from Vermont over the last few days. Good luck again to everyone!

    I sent documentation around January 10, 2019 to Vermont, had to call in to receive my extension letter, and my case never showed anything besides "case number invalid". 

     

    Until today that is. Checked my process and as of today the card is being produced.  So it took one year ( minus a week) to get approved. 

    Congratulations! I also had to call (repeatedly) about my extension letter. I was told that they had problems with their printing contractor around late January. Eventually got sent two extension letters with different dates.

    I think the mess with the extension letters delayed my bio appointment though - we'll see if that delays approval.

  6. Hi all - longtime lurker here.

     

    I recently got the Case Tracker app - an unofficial app that allows you to track your case and also search for ranges of up to 500 case numbers at a time to see how cases around the same time are proceeding.

     

    For the range EAC1990050000-EAC1990050500, there are 66 I-751s. 1 has been approved, 2 have been RFEd, and 63 are pending.

    For the range EAC 1990050500-EAC1990051000, there are 177 I-751s. 6 have been approved, 1 has been RFEd, 1 has been rejected (in November, guessing probably a missed bio appointment) and 169 are pending.

     

    in both cases, there were zero approvals or RFEs as of a week ago. Of the pending, in both cases, there are a few that have updates within the last week for office transfers (unclear if for interview or to combine with N-400) or for interview scheduled.

     

    I think this suggests that  we are just getting into the realistic possibility of approval/interview scheduling time period for EAC folks on this thread. Good luck, everyone!

    Apr 22. Got RFIE on 864 (employer letters, taxes, paystubs) May 8 dated May 2, replied May 11, arrived at NBC May 12.

    I believe that the reason 765 got approved now was the expedite - OPT employer sent letter about how much harm it would cause to business, clients, and of course me if I couldn't keep working. Lesson is that if you have good faith basis for expedite, don't be scared to try it, and business-related expedites get more traction than personal - I tried expediting AP so I could visit family with wife for first time since we eloped, but got nowhere either with service requests or local office. Had to cancel air ticket worth hundreds.

    Fingers crossed they print it quickly, since work needs me to have the card in hand in less than 2 weeks.

  8. Just got status update - 765/131 approval. Hopefully card production goes smoothly - 2 weeks until my OPT runs out, 3 weeks until I need to travel internationally for work. Requested expedite 5/23, submitted evidence 5/27. Had an RFIE on 485 for 864 employer letter/paystubs/new tax returns a month ago; looks like they finally got around to reviewing the response.

  9. I am currently on OPT, and my EAD card is going to expire in the mid of July too.

    The HR director in my company asks me to provide the new EAD card BEFORE the expiration date. He doesn't give me a specific date.

    I don't understand why your supervisor has to have your new EAD card more than 1 month before the expiration date.

    Does your supervisor ask you to resign from the company by 6/6 if you don't have your EAD card? Or you can still work until they find someone else to replace you? Either way, it doesn't sound appropriate.

    I think you should talk to your supervisor again or the HR person in your company to explain your situation and to extend the deadline.

    I'm in a similar mess - my OPT expires soon; waiting on expedite response. Company has been very helpful, though - offered to advance me some of my salary for later in the year if I have to go on leave until the EAD arrives. It's a huge issue for me personally, though, since my wife just graduated and the plan was for us to (finally) relocate so we can be together full-time. Until I have the EAD, it will be tough to do that. And the sooner we can relocate the better, since the interview will be tough if we have only just managed to start living together full-time.

    Not always true. Many places have a policy of requiring the I-9 to be fully done by the end of the first *day*. Also, most large companies have at least some government contracts, which usually triggers E-Verify requirements too.
