  1. Yesterday, I visited USCIS local office. I asked them a question about joint filing for my wife and step daughter (both on conditional green cards) They both came at the same day , same time. 

    "Do I need to file two separate applications one of each ? 

    They said one application is good put child's information on (Part 5. Information about your children).

    I told them I had to file separate applications when applied for CR-1 and CR-2 visa.

    Again they said that process is different than ROC process and also they said one filing fee and one bio-metric fee.  

     

    I just want to make sure that "Is one application is good enough for both ? OR  do I need to file two applications and two separate fees? "

    Update to Form I-797 Receipt Notices for Form I-751 and Form I-829

    As of June 11, 2018, petitioners who file Form I-751, Petition to Remove Conditions on Residence, or Form I-829, Petition by Entrepreneur to Remove Conditions on Permanent Resident Status, will receive a Form I-797 receipt notice that can be presented with their Form I-551, Permanent Resident Card, as evidence of continued status for 18 months past the expiration date on their Permanent Resident Card.

    We are making the change from 12 to 18 months because current processing times for Form I-751 and Form I-829 have increased over the past year.

    Additionally, we will issue new Form I-797 receipt notices to eligible conditional permanent residents whose Form I-751 or I-829 was still pending as of June 11, 2018. Those Form I-797 receipt notices will also serve as evidence of continued status for 18 months past the expiration date on petitioner’s Permanent Resident Card.

    As a reminder, conditional permanent residents who plan to be outside of the United States for a year or more should apply for a reentry permit by filing Form I-131, Application for Travel Document, before leaving the country. Read more information on our Green Card webpage.

    I don't know anything about rescheduling biometrics or any USCIS appointments because I've never done it. I think in the biometrics letter, they do have instructions for rescheduling. You would have to wait until you get the letter to see what it says. But I personally would not try to reschedule. I would just show up at the scheduled appointment to avoid any risk of something going wrong. You just never know with USCIS. 

    Thank you so much for all your information. My wife should not travel after October 26th (28 weeks by then) . So, I had to book the tickets 3 days before.

    I have heard that we can request for different dates / post pone for biometrics ? Is that true ? Please let me know.

    If they get biometrics appointment by before October 22nd, we are good. Otherwise, we may need to request for different dates.

    She is carrying a baby. Due to some health issues, our parents will not be able to visit us. So, she needs help from her parents before and after baby born.

    Yes. I will be back in 2 weeks. So, I will be home for checking the mails. After filing for 'ROC', we will visit local office for extension stamp on their Indian passports. Please let me know if there is any other option.

  8. I am going to file Advanced Parole for my wife and step daughter. They are currently on 2 years green cards which are expiring in Dec 5th, 2018.  ( I am going to apply for "Removing Conditions" in early next month).

    They will be travelling on October 22nd, 2018 and coming back on April 3rd, 2019. 

    I have attached the following documents:

    • I-131 application
    • Filing fee by check
    • 2 2*2 photos
    • Green card copy 
    • Driving license
    • Letter from her physician

     

    Do I need to provide any other documents to file I -131  ?  I live in Denver, CO. Please kindly provide me some information.

    I know, it's not accurate. I have noticed immediately. I have been trying to update the title, but was not able to. Please send me the step if you know/made any changes in the past. I am trying to learn about the system. When you send any suggestions the next time, please forward me any useful information regarding this post, that might helpful to me.

    If it is a biological daughter, then they would have gained citizenship (if a minor) upon entering the US on the immigrant visa. At that point they would either apply for a passport and/or file an an N-600 (although the passport is far superior, faster, and cheaper than a naturalization certificate).

    Yes. She is my step daughter. They ( wife and step daughter) are on 2 years green card and the GC will be expired on December 5th 2018. I am going to apply for "Removing Conditions" after September 5th. 

    So, I don't think I could apply for US passport.  

  11. I am trying to apply visa for my in-laws( mother in-law and father in-law). However, there one letter mismatch with their last names. 

    What proofs do I need to provide ?

  12.  My wife and my daughter are on "Adjust-mental Of Status" green card. I am going to apply for "Removing Conditions" in month of September. My wife is pregnant and she wants stay in the last 2 to 3  months before the baby is born and she wants to take my daughter with her. 
    Can they go to India ? How long they could stay in India ? Do they need any advanced parole for staying in India more than 90 days or so.

Honestly, what we have seen is that it's possible for this to become a seemingly neverending cycle; something isn't reviewed within six weeks so they send it again for supervisor review which starts another six weeks. However, it seems like the majority of cases are decided before the six weeks of the first supervisor review is up.

    I am from Denver. Which US representative I can contact ?

    I called the NVC and asked them when I can expect to complete to review the case, the representative said the case is now in supervisor's attention and it may take up to 6 six weeks.

    Can you help me how I can contact ( "US Representative Adam Smith's office for assistance (WA)" details and what I need to tell him) ?

  15. After we got RFE from NVC, we have sent all the required documents in proper way on Aug 6th. NVC has received the documents on Aug12. When I called NVC, I was told it would take up to 6 weeks to review the documents and by last Friday (Sep23, 2016) the six weeks were completed but we haven't gotten any updates on our case.

    I was told our case in supervisor's attention, when I called NVC this morning. Does any one have ideas how long it will take to review our case ?

    Please share your ideas and thoughts.
