  1. Good morning! I am currently adjusting my status from k1. Sent AOS packet last February 2017 and after waiting for months I got an RFE from uscis asking for my wife’s ITR for 2016. The problem is she needs to make an amendment on her ITR because of an error, filed “married” instead of “single” (we got married 2017). Can I just send her ITR now and do her amendment later? Will there be a problem? Thank you

  2. Good evening! I am adjusting my status from K1 visa. I received an RFE from USCIS asking for my income tax return but I just arrived here in the US last November 2016 and got married January 2017 so I haven’t really worked since I got here and still no job until now. When my wife(the petitioner) filed her ITR for 2016, she added me on it but I was told that she should have not added me since we got married January 2017 so now she needs to make an amendment for her ITR. But the problem is we need to send the requested documents by January 2018 and we are running out of time. Any suggestions? Can I just write a letter to the USCIS and include it when I send my RFE? Please help :cry::clock::help:

    Bingo. You weren't a spouse before the end of 2016 and should not have been on the 2017 tax return at all.

    USCIS is probably wondering how you filed with them that you got married in January but your wife essentially told the IRS you were married before the end of 2016 by putting you on her tax return as a spouse.

     

    Hard to fix that without re-filing correctly with the IRS

    She added me on her 2016 ITR as a dependent. Should we get an amendment with a cpa?

    Clarify:. Earlier post said you arrived K1 Nov 2016, but above says married Jan 2016.  Did you mean marrie Jan 2017?  You would not be on a joint 2016 return if you married Jan 2017 and would not arrive on K1 in Nov 2016 if you were married Jan that year.

    Sorry correction, I meant we got married January 2017

    IF:  You got married before 12/31 and you and your wife filed married/joint for the 2016 tax year they might be looking for your overseas income to be combined with hers on the joint return.  It's normally declared then reduced by $100K or so leaving you with no tax penalty but a properly filed return.  Without knowing your situation the guess is that they just lost it.

    We got married January 2016. So I just need to send a copy of my wife’s ITR for 2016? She included me on her ITR as spouse but I didn’t have work when she filed it.

  6. Hello everyone! I filed my adjustment of status for K1 and got an RFE and one of them says “Submit photocopies of your completed tax returns (Form 1040 and all W2s) for tax years 2016.” I just came to the US last November 7, 2016 and haven’t worked ever since I came here. What should I do. :(

I got an RFE from USCIS when I filed my AOS in which they requested for me to submit Form I693 Medical Examination (It’s because nothing was marked on the summary of my DS3025) So I went to see a CS and have them transcribe my DS3025 on the I693 form and also got some vaccinations that I was missing.  On the results of my Part 9. Vaccination Record (page 12 of 13 of Form i693) this is the one that was marked: 

    [X] Application may be eligible for blanket waivers as indicated above

    [  ] Applicant will request an individual waiver based on religious or moral convictions 

    [  ] Vaccination history complete for each vaccine, all requirements met

    [  ] Applicant does not meet immunization requirements 

     

    Did they mark the right one? Or should the CS also marked the “Vaccination history complete for each vaccine, all requirements met”??? I just want to make sure everything is okay before I send it and don’t want to get another RFE:(

In some countries, like The Netherlands, you receive a little white envelope that tells you to submit with your I-485. Otherwise, make a copy of your DS-3025 if it’s marked complete and send that. 

     

     

     

    I submitted my DS3025 with my AOS application but there was no check on either “complete” or “not complete”

I got an RFE for my AOS from K1 today and  it is asking me to send a “Form I693 Medical Examination” but I’ve been reading forums saying that I do not have to as long as I filed my I 485 within one year of an overseas medical examination and the panel physician did not find a class A medical condition during your overseas examination. I filed my I485 within one year of an overseas medical examination but I have confessed to the panel physician during my examination that I have tried marijuana but one time only and did not do it again ever since. So do I need to do a new medical exam then now that I am in the US? Please help
