Damn,. I booked my flight for Monday cos it was a descent price!

I dodnt even think about this. As soon as I saw issued I figured I would be ok.

If you get an email from DX on Friday that your passport will be delivered Monday, you could try calling them to get it moved to Saturday. We were able to move ours from delivery to my work on Monday 3rd Dec to home delivery on Saturday 1st Dec, even though they don't publish Saturday delivery as an option.

My guess is it's taking longer because of Thanksgiving closures at the embassy. She was told after her interview that she passed and should expect her visa in 1-2 weeks. Just seems excessive now compared to others timelines I've seen on here.

My husband interviewed on Nov 21st and his status changed to "issued" today. We are different visa types so I don't want to alarm you, but I'm not sure the delay is due to Thanksgiving...sorry you are going through this.

  3. Have a look at https://www.uscis.gov/us-citizenship/citizenship-through-naturalization/naturalization-spouses-us-citizens

Generally your wife would need to "have continuous residence in the United States as a lawful permanent resident for at least 3 years immediately preceding the date of filing the application", but there is an exception if your job is military/government and will take you abroad for 1 year or more.

  4. My husband was just approved at interview via DCF in London. I have also lived in the UK for five years and will move back to the states with him when we get his passport back.

As others have mentioned, the requirements state you need evidence of intent to re-domicile and a joint sponsor, unless you are keeping your same job, already have a job in the US, or have $60K+ in assets. None of these applied for me so I had a joint sponsor ready plus an "intent to domicile" letter.

In the letter I outlined that I have maintained my drivers license and a couple bank accounts, plus included correspondence about staying with my mom when we first arrive and selling our house in the UK...in the end this was not needed as the only question he asked was, "what's the plan for going back to US?" He was satisfied with me stating we were going to stay at mom's and look for work.

He also gave back our joint sponsor I-864 and said he was satisfied with my affadavit...still not sure how I got away with this as my last three tax returns show a whopping $20 of US-based income.

In short, you'll need to get your paperwork in order, but London will not make you move back to the US ahead of your wife.

We haven't gotten a reply back either (we sent the request 2 weeks ago)

I'm not sure what to do at this point.

Not sure when your interview is, but just to let you know they let me in with no issues!

I didn’t get the feeling I was on the list, but they just took my passport and confirmed I was his petitioner.

I was allowed to participate in both the document check and consular interview.

For one thing, they are talking about the current petition that has been received. Don't confuse them because they might not understand and will cancel your current case. Don't muddy the waters.

Yeah, that's why I'm not going to mail them anything. I'll update after the interview if they ask anything about the previous petition.

I wouldn't bother with a letter. The petition expired and he didn't apply for a visa. It's over. You have a new case now which is allowed.

Thanks! I wasn't worried about it at all until I read the case number letter, which says we must write to them if we wish to withdraw the petition (the first time around the letter never came and we got the case number by emailing them).

Then again, I suppose the petition expiring carries more weight than a letter from me!

  8. I filed an I-130 for my husband a few years ago. It was approved and we received our LND case number, but we had to postpone our move for work reasons. By the time we were ready his CEAC case status had changed to "Expiring Soon". We didn't have a reason beyond our control (as defined by USCIS) so we re-filed and listed the previous petition as expired on the new I-130.

We are now at the interview stage with the new petition and we are getting our documents together.

I never officially withdrew the previous petition so I am planning to write a letter asking that it be cancelled and bring it along to the interview, just in case they request it.

Is there anything else they might need relating to the previous petition?

    Thanks in advance.
