    Ok I can definitely do that and also call them on Monday to see if they need anything else. Is there any particular address and dept to mail it to ?

  2. I am a US Citizen and had married by spouse under the K1 process. She arrived in the US, we got married within 90 days and sent in the rest of the paperwork for the conditional green card. 6 months in to the marriage she decided to return back to India and we ended up getting a divorce. Recently I received a mail in her name from the USCIS reminding to file for I-751 to remove the conditions on her green card.

     

    What do I do at this point ? The divorce is finalized and she left immediately back to her parents in India after that, It was a no-fault divorce. Should I just call USCIS and let them know she no longer resides in the US ?

    odds are uscis will consider her to have abandoned her residency if she is out of the us for a year. did she have advanced parole when she left?

    Never got advanced parole, it was lost in the mail and then the 2 year conditional green card came. At that time it had been quite a lot of time since she had gone back to India

  4. Needed some tax advice. I got married to my wife last year and she came here on a K1 visa. We have applied for her AoS in November of 2016.  Ive done some reading but it is still quite confusing as to the best way to file taxes for 2016. Do I need an ITIN for her ?

     

    Right now, here is where we are :-

    1) I am a US Citizen, working

    2) She was not working at all last year abroad, so income is 0

    3) She has a Social Security # but no EAD

     

    Would MFJ work best or is still a better idea to file MFS.

    In my case for Houston, on the first page it says there are 2 records, while the other lists a lot more.
