  1. Got an email from the embassy that they recieved our reaffirmed file on August 13th, 2006. The email stated "Please be advised that your petition has been approved. You may return to the Embassy on any working day at 8am, to continue the processing of the case." Good luck to everyone. Next step is the interview. I will keep you informed. Thanks a bundle.

  2. United States Post Service (USPS) is the most reliable because they go straight to the Vermont Service Center (VCS) while others don't. Also, the date you mailed your petition, documents, etc is considered the date the documents were constructively delivered at the centers pursuant to Federal law.

    I used the USPS to return my RFE and it was signed at the VCS supposedly by Paul Novak. I know it got there because my petition was approved on July 28th, 2006. This is one of the few times it pays to rely on Uncle Sam's mailing system.

  3. It can't be that bad because only the recalled petitions are being sent directly to the Consulates/Embassies. There are only 1100 of them and are mostly from VCS. Maybe that is why VCS have not reaffirmed any of the recalled petitions recently. I was lucky because mine was approved in just 9 days from the time they received my RFE.

    I was told that NVC complained bitterly that they were not prepared to handle all the 10,000 petitions which were on hold in all the Service Centers due to IMBRA in addition to the 1100 which they had already processed. So VCS was on notice since May 2006 that they will be returning those reaffirmed petitions to the Embassies/Consulates directly.

    I know this because I tried to change the embassy where my fiancé will get her visa from Abu Dhabi to Casablanca but the USCIS/VCS said I could not because it will require new processing.

    Sorting these petitions will not be difficult because the first three letters on the number assign to each petition identifies the embassy or consulate the case came from. It will get there within a week, I predict. I have sent an email to my embassy and they have not received it yet but they promised to schedule for interview as soon they received the reaffirmed petition. I am more worried about them using DHL than anything else

  4. It depends on the Consulate. For example, I sent an email to the US Embassy in Abu Dhabi and they replied within two hours stating that "We have not yet received the reaffirmed fiancé visa petition on behalf of xxxxxxxxxxx from NVC. As soon as we receive the approved petition, we will schedule an appointment for the applicant." Looking at your timeline, they may get mine in five days.

    They emailed me last night at 10:22 with the RFE being sent!!!!

    The trend is obvious because it shows that all the VSC cases that were opened on or about June 22nd 2006 including mine have not been acted upon. You think they assigned those files to an agent that is on vacation. Just thinking allowed. I hope he comes back today.

  9. I just wanted to say that I received my IMBRA RFE NOA today 7/1/2006 in the mail from the CSC. The date on the notice was 6/23/2006. :dance:

    I will be mailing it off first thing Monday morning.

    It took a total of 15 days from receiving my NOA1.

    I hope others will receive theirs (RFE) this quickly too.

    Congratulations. Is it true that the CSC RFE is different from that of VSC? Can you scan the CSC RFE and post here for comparison?

  10. Our petition was recalled from the consulate, and yesterday received 2 case status updates online, as well as 3 emails for each one. I was also touched today with no change to my case status. Here is the email they sent me:

    Current Status:

    On June 23, 2006, this case was reopened on a USCIS motion, and the

    case is now in process. We will mail you a decision as soon as processing

    is complete. You can use our processing dates to estimate when this

    case will be done. Follow the the link below for current processing

    dates.

    I am not sure if we will be receiving RFE's or not. IMHO the email they sent sounds more like they may just do the checks themselves, and if nothing pops up, then they may send them back. We are all just guessing here, so I am just trying to interpret what they say in their email.

    Whatever they need to do, is fine by me, just getting doing it.

    Wow. We are in the same category. I got the exact message on June 22nd, 2006 and was touched on June 23rd, 2006. I later called the USCIS on the same day and was told the processing will be completed within 30 days. But they did not say anything about RFE. Hopefully they will just do an IMBRA Criminal background check and send them back to the Embassy. Please keep us informed. This is significant progress. Did you send a request to expedite? I did.

  11. In certain circumstances, USCIS may need to issue a second RFE to some petitioners

    Just keep in mind that it wont necessary stop a second RFE once they begin the actual processing of the petition if it is found that the petition is not complete in other areas or there is documents missing etc, or they require further evidence of having met in person within the required two year period. This is something that could happen even pre IMBRA. The intitial RFE is only to bring the I-129F into compliance with the IMBRA, for no other reason.

    Yes, I read this to mean bascially that just because you KNOW you'll be getting an RFE for IMBRA, does not mean its the last you'll get, as they havent necessarily covered the rest of your petition for all required documents and fields. I read it to basically say that this RFE stands independently of the general RFE process, and to not make an assumption that your petition is finished after its return.

    Although I do definately think its each and every petitioner's right to include anything they like/feel/want is important to their case, I personally will not go beyond the initial fullfillment of the RFE as God knows they are wanting to undo this backlog, and frankly wont care. I'm going to have to assume they want my March NOA'd papers out of there, and not give any extra reasons for looking at it!

    I (and an attorney) came to the conclusion that the RFE did not cover the IMBRA law.

    Especially regarding protection orders or restraining orders as they are not arrests or convictions and these questions were not even asked.

    It did cover question 1 with a yes or no so I was not redundant about that. To avoid another RFE regarding the IMBRA law I added my affidavit to cover it. Too much? Not following the rules? I followed the rules and filled out a form and I am a month behind. Doting I’s and crossing t’s. 5 minutes.

    I think you and your lawyer are misinterpreting the law. It is easier to just give them what they asked for. For example, the section dealing with arrests, temporary order etc., apply to the International Marriage Broker only not to you and I.     I did not mean to be condescending but please read the "Reporting Burden" below which is part of the instruction on the I-129F.

    He swore to an “arrest and conviction” that was no way requested in the form. How about the things he must have done but was not arrested because the police did not see him do them or someone did not report him. He should have sworn to those too. Where does it end? I am just saying that we should keep it real. We have already given these guys too much information in my view, why give them more voluntarily.

  14. I was not told that I would be sent an RFE nor have I received an RFE. I am not sure we will be sent an RFE because the cases of my friends whose visa were approved in error after March 06th, 2006 like mine but had gone through thier interviews were not recalled nor were they sent RFEs.

    So there may be an issue of Equal Protection because all the K-1 visa petitions approved in error and sent to the embassy are not being treated equally. That is what I think they are grapling with. They might just send these cases back, issue the visas to the 1100 petitions that were recalled and let the foriegn fiances fend for themselves baring an exreme circumstance.

    petitions were recalled because they were not compliant with the IMBRA even those scheduled interviews..and even those that had their interviews already but were under 212g and not yet given their visas were recalled. It was clearly stated in the telegram from DOS to the consulate posts that those already issued status (their visas) would not be recalled..hence those ones you mention.

    You will be sent an RFE of some description before your petition will be reapproved and sent back to the consulate. Otherwise this was a pretty pointless excercise, wouldnt you think.

    I beg to disagree with you. They recalled it but they are not sure what to do with them at this time. There is a law in this Country. In this country even the USCIS is not above the law. You don't know what you are talking about. I am sorry. They may just do a background check on thier own and send most of them back. I called them and they told me that my case will be completed within 30 days. What would you say about that. This is not Australia.

  15. Has anyone gone thru their interview only to have them deny the k-1 after because of IMBRA related recall???

    My K-1 visa was aproved on April 04th, 2006, sent to the embassy and interview scheduled for June 07th, 2006. on May 22nd, 2006 interview canceled because of IMBRA and returned to vermont on June 05, 2006. They did not do anything until I sent request to expedite on June 21st, 2006 by fax to Vermont. The request approved on June 22nd, 2006, file reopened and I was updated via email and they touched the file again yesterday. Also, on June 22nd, 2006 I wrote 3 powerful senators (2 from my homestate) who have oversight over the USCIS, and they have already contacted or in the process of contacting the USCIS on behalf.

    I don't think they should approve a visa to a pimp or a man who has a history of abuse without letting his foreign fiance know.

    I have seen many South East Women here in Houston abused by men who married them from say Thialand, Malaysia, etc. Some have their children taken from them and left to fend for themselves. In some of these cases these women were not allowed to go to school, etc. For these cases IMBRA is a good thing at least it gives these women notice of what they are getting themselves into and with the pamphlet from the embassy they can get the needed help. IMBRA may not catch these kind of men at these time because these women never call the police of file complaints some due ingnorance. Hopefully the pamphlets will help.

    I have read most post here. I don't think they are such characters here, thank God. I support the Violence Against Women Act (VAWA) which was amedned to include IMBRA and I still do.

It might not be needed now but nonetheless it puts the USCIS on notice that we are not going to take it take it anymore. So these things work.

    Our case was returned to USCIS on June 05th, 2006 and nothing was done to it until now. Good luck guys, I will keep you posted. This community has be very informatives and helpful to us. Keep up the good work guys.

    Thanks for sharing this. It seems odd that no question relates to the limitation on the number of application you had filed or had approved in the past two years. I guess because it is unenforceable in that it attempts to apply the law retroactively which may be unconstitutional since prior to the effective date of March 06th, 2006 no such limitation existed. They are only requesting that you voluntarily seek a waiver if you know that you have filed more than two K-1 visa before March 06th, 2006. I think it was intended for the post March 06th, 2006 serial applicants by then there will also be database to verify their accuracy

  18. It is not a conviction. Deferred adjudication means that the judgment of guilt was deferred pending completion of the conditions of the agreement you entered with the prosecutors. If successful as you were, the court will dismiss your case. As such you are not convicted of the alleged crime. But if you violate any of the conditions (terms) of your agreement, you will go back to Court and after a hearing the Court may adjudicate you guilty of that alleged crime, then you will have a conviction. In your case you were not convicted. So the answer will be NO.

    Nope, I just found out they aren't. My friend who works at the lawfirm I am using as representation just came over for breakfast and told me that even though they were able to get them to start sending out RFE's sooner than 30 more days, the RFE's they are sending out are the ones they have on hand, and are most recent first which can take a month to get through. Then they will start sending us RFE's and will be processed in the order the RFE's arrive. So it's as if the NOA2 no longer matters. Once it goes back to the embasy, it will be put in the que in the order it was recieved in the very back of the line. So another 2-5 months wait once it arrives at the embasys before we get our interview dates.. So it's almost as if we haven't even applied yet. I expressed my outrage, and he explained that this is the kind of game they try to play. You ask them to do something and they do it half assed IF they even agree to it. So the next thing they are going to do is try to setup some meetings with some key folks (I have no idea who they are) at the DHS and work with them on implementing a true FIFO system to prevent this from happening again when they add other new hairbrained laws.

    Okay, me again. My knowledge of this deal is that it was done by people who really don't want to see men getting foreign women. They don't think it is fair, they don't like it.

    I'll take issue with this. That is simply not accurate. As frustrating as everyone is feeling about the delays, let's be sensible about this. The days may soon be over for Mail-Order Bride services. That doesn't mean if you're an American dating a foreign woman, you can't bring her over. It just means if you bought her out of a catalog, you're going to have some 'splainin' to do to immigration. Illegal immigration is a whole other issue that is being debated and dealt with by politicans right now - let's not try to compare.

    No in many ways that statement is accurate. There are many politicians who are exactly that way regardless of mail order or not. They are so xenophobic that they will be making it harder and harder to get anyone here. What StevenJinky said was just one group of the many xenophobe's that are causing such problems for us.

Further, the USCIS had the RFE template approved on June 13th, 2006 by the OMB. Following that they will reduce the template into the format required to get the needed information(s) from the specific applicant, then they will mail them out.

    In my estimation the 1100 applications will completed soon (starting June 19th, 2006) and will be done in block and sent back to the embassy within two (2) weeks of the receipt of the petitioner's response because most of these people have paid the $100.00 to the respective embassy banks and done their medical which expires in a year.

    There seems to be misunderstanding of the intent of IMBRA. The intent of this act is to have your foreign fiancé fully informed of whom you including your criminal background if any. Upon which she has to decide whether or not she wants you no matter how bad or how great you are. That decision is totally hers. So the best medicine is full disclosure before you apply for her.

    This is a little daisy for those whose petitioner whose applications have been approved and their fiancé’s invited for an interview. They are forced to disclose these bad records to their fiancé even if they don’t want to because the cat is out of the bag already. I think the RFE meant for these 1100 petitioners must have a place to give these guys a face saving means of backing out because one does not give up his constitutional right to privacy to marry a foreign wife especially without notice. That may be why it taking a little longer to send these ones out.
