Thank you! However COVID means that USCIS currently requires you to prove an emergency which honestly just seems annoying and vague, so it does have me worried about getting the stamp. Would be better to receive the GC, but I think now that we filled the N400 there’s no chance of that before the end of the year is there?

Hi everyone,
We filed my wife’s I-751 in April 2019, she completed biometrics and received her extension letter that expires in January 2021. Our lawyer advised us to file N400, so we did so in June 2020. Immediately after that we received a notice that her I-751 case had been transferred to the NBC.
Does this now mean that both cases will be resolved with one interview? And if so, does this mean we don’t really have a chance of receiving a 10 year GC or her having her citizenship interview before her extension letter expires given citizenship timelines, necessitating an InfoPass appointment to keep working after Jan?
I may be over interpreting things so I was wondering what the wise folks of this community think is going on.

Well I do currently live here and will send the petition off from within Germany.I contacted the embassy and they said it is perfectly fine to move after you have submitted the application
So I am not doing anything shady by submitting it with the embassy in Germany.

Because the DCF CR1 is much faster than K-1. 2-3 months, then an interview and then immediate permanent resident status when you get to the US.
With K-1 it's 6 months till the interview, plus another 2-3 months to do adjustment of status.

I am a legal resident, she currently isn't. However, the embassy website and phone recording only specifies that the petitioner must be a resident. I will confirm this with the embassy tomorrow though.

Actually with a co-sponsor, would it be enough for me to provide my most recent tax return? Since I have an extension till June because I am abroad, I am filing that now
and can provide a copy of the forms I submit of course. And I have no W-2 as I didn't earn any income in the us.We would get 3 tax returns from the co-sponsor though.

I am still unclear on two points though:
1. Do we really have to file the I130 petition AND all supporting docs and financial docs (i.e. affidavit of support) right now?
Or do we follow the process outlined online and provide the supporting docs and financial docs once she gets invited toan interview.
2. I haven't filed my taxes yet for a year or two (didn't earn any significant income the previous year, and currently filing my taxes
for last year, all foreign income exclusion of course). I can get the transcripts within 2-3 months, so is it enough to submit theaffidavits of support when she interviews? We are also getting a co-sponsor. Do I still need tax returns even though I haven't earned
income in the US? I have a job lined up in the states so I can submit my letter of employment. I also never got any tax returns.
I assume I have to request them using the online feature?

Are you sure it'll be in frankfurt?
The embassy phone message says the response and interview will be sent to the embassy in spouse's country. I'll call and ask on Monday.

Oh ok! And how long does it tend to take after the interview? That makes this option seem a lot less appealing of course.

And really, she would have to wait in Germany? She couldn't just return to Canada? That's a good point,
hadn't considered that.

This just seems like by far the fastest option, or am I wrong?
I have been reading a lot of immigration options and am franklya bit shocked at the wait times. Especially since I am sure the
applications are just on a pile somewhere and this is not because
of any security concerns at all.

Yes exactly. Still a lot faster than a 12 to 18 month wait if we don't do DCF.

No, not currently. She was a resident though, and the embassy does not specify that the spouse has to be a resident
when filing the petition.

We have lived together before for multiple multi-month stretches.
Currently we are not living together however since I am in Germany
and she is in Canada for a post-graduate course.
I have visited her in Canada twice, and she lived in Germany for a total
of two years, most of which we spent together. We have both moved around alot
for school and work.

Hi!
My fiancée and I are considering getting married in Europe and then applying for a CR-1 visa forher (I am a U.S. citizen, she is a Canadian citizen) through the embassy in Frankfurt (I am also
a German citizen and resident). I have three questions regarding this process:
1. Do I have to remain a resident of Germany after filing the I130 petition in Frankfurt?
Is it enough to have a mailing address in Germany while already moving to the U.S.?
I will be accepting a job there soon.
2. How do you prove your marriage is bonafide shortly after getting married? We have plenty
of proof that we are in a real relationship (over 3 years now, lots of joint travel receipts, pictures
with each other's families, friends willing to sign affidavits) but it is hard to prove our marriage
is bonafide since it will take place shortly before the application. We have been engaged since
late last year and have an engagement ring and photos, would that help? Facebook chat
transcripts?
3. The way I understand it, you file the I130 petition by mail with the embassy. Is that correct?
