I think before you send anything, you should make an infopass appointment. Take your green card, passport, and copies of all you documents that you sent to USCIS to show it was their error. Ask them about the RFE to verify if it was a mistake or not. Then ask them to stamp your passport with an I-551 stamp. You can use this stamp to work and travel also. Make a copy of the incorrect green card for your records, then fill out the I-90 and send the green card back with signature confirmation. As soon as it is received make a copy of the online delivery confirmation asap, because after 3 months (if using USPS) they will purge the confirmation from the computer system. We sent Hachemi's back and they claimed they never received it until I produced the confirmation and they put in an inquiry on it's whereabouts. We still have not received his corrected green card, but we have a stamp in his passport that is good for one year. Good luck!
Meriem
Hi Meriem, thanks for the advice. I agree that I should make an infopass first. I've already set an appointment for this wed. and will ask for that I-551 stamp. I will also remember to make a copy of the online delivery confirmation as you've suggested in case those people mess things up again. I hope that we can finally get this confusion straightened out! Thanks again and hopefully your husband will get his corrected green card in the mail soon.

Does that RFE sent out before your interview, but since you passed the interview and got all different kind of notice and GC, maybe it's not a problem,i dont know, how other guy think?
Regarding the I-90, it may take a month or longer? We are going to do the I-90 too if still not hear anything of GC next week. Good luck
Hi Linda, the RFE was sent after the interview and also after I got the email that card production was ordered. So I was really surprised and confused when I got the RFE.
Re the approval notice and welcome letter, I think the "approval notice sent" email refers to the welcome letter that they mailed. Hope you get your green card in the mail soon...

Hello everyone,
I had my AOS interview last Jan 22nd. I got the "Card Prod'n. Ordered" email on Jan. 31. But surprisingly, I also got an RFE in the mail. The RFE says that in order to complete the processing of my application, my husband has to complete & submit the enclosed I-130 form and a G-325B ( note: husband was never in the military). Then on Feb. 7, I received another email. Its the "approval Notice sent" email this time and I got my greencard a day or two afterwards.
This is just confusing me. Am I really approved or not?!
What's also irritating is that there is a mistake on my greencard (wrong middle name).
Well, what I intend to do is to complete and mail the I-130 and the G-325B (put N/A on all those qxns referring to military service) and a letter explaining that hubby was never in the military. I will also send them a copy of the originally submitted I-130 form, the approval notices of my I-130 and I-485, copies of birth and marriage certificates, copy of my husband's US passport, copy of my G-325A.
I know they're only asking for the enclosed I-130 form and G-325B and didn't say anything about mailing in any of the other stuff but I'm just too scared that I want to mail in whatever docus I think they might need for reference. What do ya guys think?
As for the greencard error, I will submit the I-90 and return the greencard. How long does it usually take for those guys to issue the correct card?

thanks for the advice kim and james!

This is weird! I just checked into the G-325B form that they want my husband to submit and it's asking for Date of entry into service, etc. Do they mean service in the Military?...My husband has never been in the military!!

Last Jan. 22, my son and I had our AOS interview in Baltimore. The IO said she'd approve my son's I-130 and recommend approval of our AOS. A few days ago, we got an approval email for my sons' I-130 and then an email saying Card Production was ordered for me (but none yet for my son). Yest., we got 2 letters. One was my son's I-130 approval and the other one was for me, but surprisingly it didnt have the good news i was waiting for. Instead, it was an RFE asking us to complete and submit a duplicate copy of the enclosed I-130 petition and G-325B. Really irritating! Why would they need another I-130 when ours was already approved back in 2006? Has this happened to anyone? Also, should I just write updated/current information on the new I-130 instead of transferring the old information which was written on the one we originally submitted?
any insights/info will be much appreciated...thanks in advance!

Muraari, we had the same interview date in Baltimore. I too just received an email saying card production was ordered for me and it was also just one single email...hope we get that welcome letter within the week or next!
Hi Lena, we too received an approval email for my son's I-130 but no news yet with his AOS application. Have you heard anything yet?

Hi everyone,
My son and I are also having our AOS interview tomorrow morning. As per the supporting documents to prove a bona fide marriage, we are bringing the following. Will they be enough evidence to satisfy the IO?
• Photos (about a hundred pics taken over a period of 9 years)
• Bank statement of savings account – we have only one statement because the account had only been opened very recently
• Husband’s Health Insurance with my son and I as my husband’s beneficiaries
• Photocopy of his credit card and my extension credit card
• Photocopy of my credit card and his extension card
o The credit card statements do not show the names of the extensions, so I didn’t bother to make copies. Is this ok?
• Bank wire and remittance receipts during the time that we were apart
• Emails, phone logs, cards
• 2006 Tax return – filed jointly
• Cards and letters from friends and family addressed to both of us
• Tax refund check with both our names
I acquired a life insurance policy when I was still single but have completely forgotten to add my husband in the list of beneficiaries when we got married (I even forgot to change my name). Our son is a beneficiary with my husband (his father) as the trustee. I am in the process of adding my hubby as a beneficiary. I wonder though if i should still show the policy as it might raise questions as to why I hadn’t done the changes sooner.
My name isn’t included in the apartment lease and utility bills because we are planning to move sometime soon and also, I just got my SSN.
I also don’t have exact copies of the application forms we sent because my hubby shredded them by mistake!!! So I filled out the forms again for our copy…sigh! (I sure hope this won’t cause problems).
Any comments will be much appreciated. Thank you in advance!

Sahara, I've updated your info. I assume you meant 01/22/08 rather than 01/22/07
Yup, thanks CB82!

I got my TD shot from a civil surgeon and he charged me around $30 (cant remember if it was 30 or 35). The cost for transferring the vaccination info to the supplement was abt $25. Sorry can't remember the exact amounts but they were in that range.

just wanted to share this site (Manila Forwarder) with you guys...haven't tried their services myself but worth checking out to compare shipping rates from Phils. to US...

Thank you fellow VJers! jasman, I hope the expiration date on my EAD card will be same as my I-94 which won't be until 2008...
Oops, made a typo. I meant 2009 not 2008...

I don't think 5 months is still within the normal processing timeframe! Have you checked if your case has been touched after your senator's office made the inquiry? I filed in June and asked for assistance from my congressman in late Oct. The letter he sent stated that accdg. USCIS, the application was still under review and to wait 30-45 days! My case got touched the day after I received the letter and was approved 20 days after. As per YuandDan, you may have to do an infopass to find out what's causing the delay and for an immigration officer address the problem.
-
YAY! Congrats on the approval! Happy job hunting to your wife!

sahara,
zipcar can be rented by hour which is convenient, and all their cars are road-worthy so that shouldn't be a problem. however... to join the zipcar - if you have an out of country licence - they require your driving record from home country. all details are up on their website. there are different levels of membership... take a look, you might find out it will suit your needs for now!
i will rent a zipcar for my driving test in San Francisco next month (using my australian licence), but i have joined zipcar recently so i can drive it. they don't care what the reason for renting is, but they will not let you join unless you've had a state licence for at least 12 months OR a clean driving record on your valid out of country licence. we rent zipcar all the time and now i will be driving with aus licence for the next 12 months until my CA licence becomes "valid" for zipcar!
good luck!
ausqueen
PS: getting my driving record from Sydney took only a few days, and zipcar approved me overnight. it was easy!
Thanks for the valuable info ausqueen! I will contact our local land transpo. office to make the request.
Being able to rent a car is very useful indeed and zipcar's hourly rental is really convenient! Good luck with your driving test next month! Thanks again...

This morning I checked my EAD status and finally!!!!!!!!!!!!!!!!!!!!
Application Type: I765, APPLICATION FOR EMPLOYMENT AUTHORIZATION
Current Status: Card production ordered.
On November 19, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
OMG! I've been waiting for this approval for a total of 155 days from date of filing! I had to turn down a good job offer because I didn't have my EAD.
For those who still haven't received their EAD's yet and are outside processing times, call your congressman! I contacted mine because unfortunately my infopass was not succesful. I was told by my congressman to wait 30-45 days as well, but ever since they made the inquiry on my EAD, my case started getting touched. It still took 20 days from time of inquiry to get my approval, but I am nevertheless extremely HAPPY!!!! (happy, happy, happy)
Finally I can apply for my SSN and driver's license very soon...BEST of all, I can start working and help my husband pay for all the bills! My birthday is coming up and I couldn't ask for a better gift!!!
Sorry for going on and on...I'm just extremely DELIGHTED!
Cheers and advanced Happy Thanksgiving to all!!!

Thank you both for the advice! We'll definitely be calling the driving schools in the area. Also just earlier, a friend from out of state told me that zipcars allow clients to use their car for the driving test so I might try calling them too. I really am hoping to get a car soon....it's getting too cold to be waiting outside for the bus! Thanks again guys!!!

finally! congrats...

My husband is the US citizen but in essence we are both just starting out as he moved to the US only last year. He has a foreign license. He tried getting his MD license last year but failed the actual driving test because he failed to stop long enough at a stop sign. On his 2nd visit, MVA refused to have him use his uncle's vehicle for the test because the windshield's tint was abt an inch too long. Which is weird because that was the same car he used during his first take.
He was able to get by without driving as his office building is right across the street, but now we REALLY need to buy a car and be able to get around. What are other options to get a driver's license if we don't have our own car? We do have a few friends who are willing to bring him but their cars are not in top condition and most surely wont be accepted by the MVA. The ones whose cars are in good condition are either not willing to do it or can't do it because of their busy work schedules or dislike of being at the MVA...which of course we understand.
Is anyone aware of a feasible way to obtain the use of a car for the purpose of taking a driving test? I really want to get this license ordeal done and over with...Help please....

Have you contacted your congressman? I'm actually in the same boat as you are. EAD application was received by USCIS on June 17. Made an infopass a couple of weeks ago and immigration officer said she'd fax CSC. One week after that infopass I still had no touches so I decided it was time to ask my congressman for assistance. On Oct. 31, I got a response from his office and said that the application was still under review and that I should give it abt. 30-45 days. But I think the congressional inquiry must have done something because I've been touched two days straight since Oct. 31. Well I am not all confident of an approval coming my way soon (it's hard to keep getting disappointed) but at least my EAD is now showing some signs of life.

Congrats on approval...I hope I'll get an approval soon too. Mine's been pending for 138 days already.
Help with RFE and Green card error
in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas
Posted
Yes, I called twice and both times they recommended that we send in the documents as requested in the RFE. As for the G325B, they were also uncertain why my husband had to fill that out instead of the G325 and told us to note that hubby was never in the military . We called again this afternoon to ask if we should still send other documents for reference. But the person we spoke with suggested an infopass because it seemed strange that we were given an RFE even though the case had already been approved. She also told us to bring all documents and the green card to get a stamp.
