  1. I just sent aos and iv packages to the nvc. On i-864 i decide to take risk not to used a joint/co-sponsor since my current income is $44,484 for a household of 3, i did sent employment letters and bunch of pay stubs. However, 2013 and 2014 are $17k and 2015 is only $5k(lived oversea). I feared that the worst i would get RFE for 221(g) or if through nvc, i probably got bumped by CO at the interview for not having a stable income over the last 3 years.

So i think i'm gonna make my step dad file out a i-864a in advance as a back up plan. I'll send it to my wife to bring it to a interview anyway, dispite nvc ask or not.

So my questions is. If i file i-864a should i redo my i-864 to go with it? And also if i get a RFE for 221(a), beside i-864a and his evidence(tax transcripts, photo passport, employment letter, pay stubs) is there anything else? Should we remade aos package or just missing items?

  2. Thanks mallafri76 for your answer. Yes the interview will be in vietnam. I'm gonna send out aos & iv package sometime this week. Hopefully nvc wouldn't ask for 221(g) so my case does not get any delay. I will make a i-864a and send it to my wife in case CO ask for it on the interview. We're stressed out way enough on this journey, especially our 9mos old daughter deserved to have both parents raise.

  3. hi tj875,

I'm not making enough money last year cause i live oversea for 3/4 of a year. However, this current year i make around $38,001, i got all pay stubs and employment letter to prove. I just wonder if does it good enough in CO eyes? Or they're still going to look over the past 3 years. Anyone gone through this, please let me know what's your situation. thanks

  4. I'm filling out i-864 for my wife cr1 visa. Here's my situation, i spend a year from 10/2014 to 9/2015 oversea with my wife for my new born baby. I came back here on sept 2015 and work until now. Since i worked only few months, Therefore, my filed tax for 2015 is only a little over 4k. Followed with 2014 is $17k and 2013 is $11k. However, my current income would be good enough to sponsored my wife on my own(household size of 3 myself ,my wife and our USC daughter), which i calculated my AGI around $2500/a month or $30k a year. Question is do i have to add my mom as a household member to use her income added or am i should be good on my own? I did lots of research but wasn't clear. Anyone going through the same situation or anyone knows how does the nvc determined income? Are they most likely looking at current income or past years matter? please help me? I'm really stuck on this aos, it drives me crazy. Really appreciated.

  5. Hi all,

I'm filling i-864 for my wife. As i spend 9months oversea so my income for 2015 isn't enough to sponsored, so my step father will be a joint sponsor. So far household size is 3, correct? However, our 9 months old daughter live with her mom which is my wife oversea, would she be count towards household size too? thank you for your time.

  6. So my step father will be as a co-sponsor and file i-864a because we live in a same address. However, this year he and my mom filed married joint filing, should we use 2 co-sponsor and file i-864a each? Also 1 more thing, my 9mos old daughter has automaticly become an us citizen and did not involved in this petition, so do they count her as an household member as well. If yes, we looking at 5 household mem? (Me, my wife, step dad, mom and our daughter) Thank you so much for your info.
