  1. Just another one needing help with. My husband is currently volunteering and so doesnt earn enough to support. so my sister ( who is in CO) is joint sponsoring.. Now does she just download the I864 form from the website or will she need to have one with a bar code like the one Jeff will b getting??

    also do people who are joint sponsored generally get through the process ok or have there been denials?? just curious? :mellow:

    What is CO ?, who is the USC ?, you or your husband ?

    Co is Colorado, USC is my husband I'm from Scotland. My sister in colorado became a USC last year.

  3. ok so I knowI'm still a while away from working in the US... but I already have a Social Security number which I got in 2004 when I was on a J1 visa for the summer working through a programme by BUNAC. So will this be my number forever and can i start wokring as soon as i arrive.. or will i have to apply for a whole new one?? Any thoughts? :blink:

  4. Yes i know what you mean. I am sick to teeth of people asking me so when do you go to the USA...?? I DONT KNOW.. I am waiting for the visa to go through this that and the next thing.. oh but surley since you are married you could just geta visa... ( if I hear that one more time U'm going to go mad)

    I am having to live with my mum at the moment and its so hard.. I feel like I am in the way aand I just wish this whole process would go faster!

  5. I really dont think its the right thing to be calling USCIS staff names, and making generalised assumptions about their work behaviours.

    This forum is monitored by lawyers, DHS, and USCIS from time to time according to several reports from other members here, who have had interviews where the IO has mentioned this site,...Just be careful.

    I know this process can be frustrating :yes:

    Yeah,, I really don't care.. How long are we going to put up with this #######... You want to wait forever???

    We are all in the same boat here.. why not try to be supportive and positive instead of bringing a negative vibe to the forum! A little patience can go a long way!! Good things come to those who wait! :yes:

  6. I called the NVC yesterday and apparently there is no record of my case.. which means they dont have my case sent over from USCIS yet. We had our I-130 approved on the 29th June.. Any ideas how long it takes to get a case number and then get the first of the packets??

    It will be at the NVC soon. The average time is between 7-15 days from the approval to NVC.

    Well thats 15 days today so hopefully will get it soon :) how ru today?

    Becca, we're at the same boat. Nothing known yet. After request to CSC they told us to wait for a month after NOA2 date. Here is a copy of their reply:

    You can phone National; Visa Center public number 1-603-334-0700 to see

    if the petition has been received. It takes a month from date of approval for this to occur as the petitions are sent in truck loads and must be put on NVC system.

    Man a whole month thats rubbish!! thanks for letting me know tho at least I know what to expect now. I think our service centre is Nebraska... thats the one we sent the I-130 to.. so hopefully it goes quick!

  8. I can't find any info in the FAQs or Guides about this, so I'm hoping someone here knows something about it. My wife is from Thailand, she has been here since late October on a K-3 Visa. Today we just received a letter stating that we missed our scheduled appointent in May, but this is the first we have heard of it. We never received notification of this appointment and this is the first we have heard of it. Now my wife is in danger of losing her right to work and possibly being deported. The letter I got has no phone number, only an address. I suppose I can write them and try to find a phone number to tell them that this is not my fault....But if anyone knows how to begin fixing this, or can even point me in the right direction, please let me know. I think I need to file some sort of "appeal" form(even though the letter says the decision cannot be repealed, only "reopened") and then file the same Adjustment of Status forms again. And hope I get contacted this time. What a mess. The text of the letter is reproduced below. I'm worried, any help is most appreciated.

    Decision on Application For Status as Permanent Resident

    ATTACHMENT TO FORM I-291

    On December 28, 2005, you filed an Application to Register Permanent Residence or Adjust Status, Form I-485, under Section 245 of the Immigration and Nationality Act, as amended. You were scheduled to appear for an interview regarding permanent residency on May 5, 2006. You failed to appear for your scheduled appointment and/or failed to submit justification of your absences prior to the interview. A search of Service records reflects no report of a change of address.

    * CFR 103.2(B)(13), as amended, states in pertinent part:

    ... If a person requested to appear for an interview does no appear, the Service does not receive his or her request for rescheduling by the date of the interview, or the applicant or petitioner has not withdrawn the application or petition, the application or petition shall be considered abandoned and, accordingly, shall be denied.

    8 CFR 103.2(B)(15), as amended, states in pertinent part:

    A denial due to abandonment may not be appealed, but an applicant or petitioner may file a motion to reopen under 8 CFR 103.5. Withdrawal or denial due to abandonment does not preclude the filing of a new application or petition with a new fee.

    Since you failed to appear for either interview, the application for adjustment of status is denied.

    Any rights or privileges, including the right to reside and work in the United States, which you derived from the filing of the application, are terminated.

    Failure to file a new Application to Register Permanent Residence or Adjust Status prior to the expiration of your K-3 non-immigrant visa will result in the initiation of removal proceedings.

    I am really sorry for your troubles.. I am not expert but maybe you could call one of the service centers and speak to someone or even go down to a service centre and try to speak to someone there and explain your situation. If you didnt recieve any notification of the interview then in my opinion it is their fault not yours..
