I received the RFE today and they’ve asked for documents I already submitted. They asked for birth certificate of kids ( I don’t have kids), mortgage documents(already submitted), drivers license of both wife and me (did not submit - I still have the license from NY where we both lived 3 years ago not the Illinois one where we lived for 2.5 years),  property, life and health insurance documents (already submitted life and health), utility bills ( submitted electricity, internet and water), credit card (submitted joint cc statements). It also says not to send whatever I’ve already submitted. I’m super confused on what to do.

They said not to send the ones you already submitted, so I guess just add whatever you can. I literally added the most random ones I can think of, like Facebook chat logs between/regarding me and ex, email correspondence, comments and posts... Even paystubs that show the physical address of where we used to live together.

I got the notification last Friday and got it just this Monday. Will try to submit the evidences by next week.

  3. So here’s what I compiled so far with my RFE

    - Screenshots of conversations between my ex-husband, my father-in-law, my grandmother-in-law, a group chat with my in-laws

    - Facebook screenshots of comments of friends, family

    - Text correspondence of my family, mentioning my ex-husband

    - More joint checking acct copies

    - Affidavits from my aunt and uncle

    - Random e-mails regarding my ex-husband (resumé, dentist appointments, etc)

    - our sons’ invitations to their birthday parties

    - Our son’s school registration card

    - more pictures, including our families and friends

    - His old paystubs with the same checking

    acct number

    - My old driver’s license showing same

    address

    - His old mail with same address

    - Our sons’ baptismal certificates

I’m not so sure if these are enough; I submitted all my copies of health insurances already, though.

Did the RFE just ask you to send more proof or did they ask something specific?

They asked me for children’s paperworks, joint financial statements, joint bills and leases, and wills. I already submitted my sons’ pictures and birth certificates, copies of our joint checking account statements, mine and his paychecks, even his driving permit and my first driver’s license with the same address. The thing is, we never had bills or leases under our names because my uncle paid for everything and didn’t ask us to pay. The only thing that’s under our names is our joint checking account and insurances.

    Oh I see.

And you said you were married for 11 months?

I am a divorce waiver filer as well.

My documents were mostly, tax documents for 3 years of marriage, letter from the ex husband saying that the marriage was in good faith but it did not work, shared health insurance, beneficiary proof, joint car insurance, phone bills and photos.

Yes. We had health insurance, car insurance and photos since we have two sons. I’m just worried because I mistakenly sent them all the original copies (except for birth and marriage cert, divorce decree) and I’m anxious they might need more.

  6. I finally received my RFE 😫 It says that they need more proof of good faith marriage, joint financial activities, and wills. I have sent most of the original copies on my first application, and I have already sent what is asked.

We never had bills of utilities under both our names since we lived with my uncle's family and they paid for everything and did not let us pay as a way of helping us earn money before we are ready to move out. I will submit affidavits, copies of my ex-husband's pay stubs, our baggage tags, more photos, conversations between my sisters-in-law, my grandmother-in-law, and my family regarding me and my ex, screenshots of conversations and copies of bank transactions on our old joint checking account.

We were together for almost six years but only married for 11 months. The conversations we had after we separated were hostile, so I'd rather not print those out. I do have photographic proof of the reason for our separation, but I'd also rather not include it. Should I also include screenshots and photos of before our marriage? Also, how many affidavits from people is recommended that I should send?

All this backreading through our conversations and photos gives me flashbacks and gives me so much emotional distress that it worsens my anxiety 😔

@madpnd - it will not be an interview (yet, if there is to be one).  The adjudication process is by the book.  RFE is the step taken to resolve any issue that could be resolved by “documentary evidence” first.

Only if what you submit still doesn’t satisfy the officer working on your case, then the case may be “transferred” to your local office for an interview.  If that happens, it will take however long it takes for your local office to schedule you for an interview.

I am one of those nerds and I read the entire adjudication manual, which must be followed by all adjudicating officers.  I know pretty much all procedurals and steps USCIS are required to follow before they can do anything.  Immigration process is very bureaucratic and that is why it takes forever for cases to be processed (apart from their “don’t care” attitude).  Even your RFE must be reviewed by a supervisor before it can be sent to you, if the officer is a junior person by rank.

Thank you for explaining this to me. ☺️ I was wondering, do you have any idea how long is usually the estimated time between the submission of RFE and approval/interview request? I have less than 3 months before I leave and I just wish I’ll be here in the country when they send me an update.

RFE will give you 84 days exactly to respond.  That is coded in USCIS regulations.

My RFE was mailed today from USCIS. I cannot wait the last minute to submit it just so I have leeway from my trip. I just hope they don’t request an interview in the middle of my trip dates.

Hey @madpnd Thanks for letting us know about your updates. From the look of Jan Filers that I'm collating too, it seems like the RFE is given a period of time to send the required documents back to USCIS, and the time period is about a month, I think you should be fine, moreover the extension letter is what they are looking at. As long as you do not miss the interview. Perhaps let's wait for the RFE letter, and see when the due date is, and let USCIS know about your travel dates? Is your air ticket an open ticket, are you able to change the dates?

@LCHANG Thanks for the update, our list only note when case is move from State to State, but its really good news that your case is moving! Some of us are not moving since last year! (Like me :( )

Unfortunately, it’s not an open ticket. I leave by May 17 and get back on June 3. My concern is what if they send the interview letter when I’m gone 😰. Do you know how can I inform them of my travel dates? Thank you for replying.

  10. Hello everyone,

I just received an RFE notification in my e-mail, and I’m worried to my wits since I bought my plane ticket for May 17th 😰. I have read before that usually RFEs with divorce waivers have higher possibilities of requiring an interview.

I’m worried that it might affect my travel plans on May, and possibly have an interview scheduled at the time I am away. I will only be gone for two weeks, but my anxiety is not helping me at all 😫. Has anyone tried traveling with an RFE and extension letter?

  11. I am a Permanent Resident and my ex-husband is a USC. We are applying for CRBA for our two sons (aged 2 and 3) in the Philippines. The problem is I'm a little confused about which particular rule should we follow. Our sons were born before we got married but were legitimized a few months after the marriage. It looks like the guidelines are more complicated if the conditions are for children born out of wedlock. Are they still considered children born out of wedlock?

  12. Hi all,

I am currently facing a difficult situation wherein I live in New Jersey and my ex lives in Washington (Seattle), and our two sons are living with my parents in the Philippines. We separated December 2016 and got divorced November 2017. Since we separated, he does not provide adequate money for my two sons. Most of the time, he won't give me anything at all. I literally have to pay for their monthly needs, plus their miscellaneous expenses such as hospital bills, check-ups and whatnot. I've had enough of this nonsense when I found out that he has a new girlfriend, expecting to give birth anytime soon, and he has been financially supporting her new girlfriend's family (she and her three older children) on a regular basis. I asked for help since my sons were sick and needed to be confined to avoid dehydration (both of them, at the same time) so imagine just how financially and emotionally draining it is for a single mom like me.

I want to know if I can demand for child support even if my children are not physically residing with me here in the USA. Again, me and my ex are both in the USA.

    Any helpful suggestions are appreciated.

  13. Hello everybody,

My account was cashed 01/02 and I got my NOA1 01/06. Finally, I was so anxious that my paperwork were lost. I'm updating the template with my details now. :)

  14. Hi,

I sent my package and they received it last December 11. It's been more than two weeks since they got it and my bank account wasn't even debited yet. :( I'm afraid that some of the paperwork I sent were originals (health insurance cards, car insurance, other related paperwork) since I am filing for a divorce waiver, I don't need the originals anymore except for this purpose. I'm anxious that the other people who filed later than me, got their NOA1s already :(

    VSC, from New Jersey.

  15. Hi people..

I am in constant worry about my situation. See, I married a US citizen (he's Filipino like me, too) and moved here to NJ last June 2016. However, things did not go well between us ever since and decided to separate ways. I have sufficient proof for USCIS that I have entered the marriage in good faith, especially with my children. Now, I have questions that seem to be unanswered lately that I want to be enlightened about:

    1. My husband is planning to move back to the PH on May. I cannot file for divorce yet until June 2017 since NJ requires a year of residency. How will they serve the divorce petition if he is overseas?

    2. How long does divorce with petitions served internationally usually take? My GC will expire on June 2018, which is a year after I file for divorce.

I am really worried about my current situation right now.

  16. So my situation goes like this: got married last January 2016 but we were together since 2011, had two kids prior to the marriage, petitioned and got a green card by my husband, moved to the NJ, USA last June -- unfortunately (or fortunately), my husband left and moved to WA due to irreconcilable differences and in an abusive relationship. Bottom line is, the marriage went south. I stayed here in NJ since we were living with my side of the family. I'm planning to file for a divorce this July (to complete to 1-year residency requirement), but how will this affect my green card status? I have proof that the marriage was bona fide:

    * we had two kids (obviously)

    * my car insurance shows that he is one the drivers

    * he was under my health insurance

    * we had a joint Bank of America checking account

    * My Driver's License and his GDL permit shows the same address

I don't know if this will be enough to prove the government that the marriage was bona fide.

Also, I need help on how to file for child support since ever since he moved out, he is not helping with the finances to raise our kids. My situation is really rocky right now, especially I'm worried that I might be deported :( and I am planning to go to school this fall for a new beginning. I am very clueless on where to start and how to do things on my own, but I have to. I have no idea how divorce works (I'm in NJ, if that helps), how to start the process, and how to process my ROC... Please help me

  17. Hi everyone,

I received my visa last June 8 and I noticed that my passport was inside the plastic along with the yellow visa envelope. As I read the instructions, I should open the plastic, retrieve the passport and seal it back. However, when I opened it, the flap of the plastic was too sticky, it created two holes on the other side, and thinking that it can destroy or damage the visa packet due to the hole in it when I try to seal it back, I just threw the plastic away and used a different kind of plastic.

Is that okay? I know, I'm really paranoid, though. Is it just the yellow envelope I'm forbidden to open? Or including the plastic that it came with?

  18. Blue Slip: A 221g Blue slip is given when the additional documentation is required. After submitting the required documents, a decision will be taken by the Consulate.

Pink Slip: A 221g Pink slip is handed out when your application needs further administrative processing. The consulate will notify you once the processing is done. This form is most likely issued when the Visa Officer is doubtful about your current employer or work related information. You will be given a reference id and you can track the status online.

Yellow Slip: A 221 g Yellow slip denotes general type of administrative processing. The Consulate looks at all the documentation provided by the candidate and the employer.

White Slip: A 221g White slip denotes requirement for further processing by the USCIS. The Consulate pushes back these kinds of cases to the USCIS and the decision is taken based on the information obtained from the USCIS

so what color was the slip you received?

They did not give me any slips. O__o which is weird. The CO gave me the domestic violence pamphlet though. And they kept my passport. The CO also told me everything should be okay once the birth certificate and CENOMAR will be submitted to him and he'll issue it to me. Does that help? LOL :D

  19. Hi everyone,

I had my interview today at USEM in Manila. The interview went well, but silly me, I did not produce new copies of my Birth Certificate and CENOMAR because I was under the impression that since we did DCF, they will just get those documents on the I-130 filing (the Birth Certificate and CENOMAR was in the I-130 file). Apparently, the pre-screener said that we need to secure new copies of the said documents since the first documents I sent will be copies Of USCIS and they need a copy of their own in the IV Unit. But to cut it short, I was approved, the consular officer just said that I need to go to Step 5 (Releasing) so they can just pickup the NSO documents once I make the payment in NSO Pasay, and once the USEM liaision officer provides the copy to the Consular Officer, he will just switch it to ISSUED status upon receipt.

Now here's the catch. USEM only picks up the paperwork to NSO Pasay EVERY FRIDAY MORNING on a weekly basis. Today is a Thursday, and they said they can't produce my Birth Certificate and CENOMAR like, within 24 hours, so I need to wait until the 19th (next Friday) for USEM to pickup those documents.

I just wanna know how long does it normally take for the CO to receive the documents and change it to ISSUED status. If you cant provide me an exact turnaround time, maybe you could share your personal experience on the wait time so I'll have an idea. Please, please, please? Based on your experience tho. :)

We are intending to leave PH originally on 28th of May, but due to being placed on AP, we might extend further.

  20. Hello everyone!

Just received my MNL case number today and tried to do the online registration thru https://ceac.state.gov/ceac and I'm having some trouble after I click the "Continue" button.

    Here's the exact error message:

The selected Case Number and Invoice Identification Number combination you entered does not match our records. Please try again or contact the National Visa Center for further assistance.

Did anyone else experience the same issue? If yes, how were you able to push through? I called the IV Unit, and they said they really can't help with the registration process. I also switched to different internet browsers, from Google Chrome to IE. I'm currently stuck and I need to go through this in order for me to proceed with the medical appointment and the final interview.

Any tips will be very much appreciated. Thanks!
