    So as long as you file before then, the interview itself doesn't have to be before then? Because what happens if they can only schedule the interview AFTER the green card expires?

  2. Hi there,

     

    I unfortunately was divorced from my husband as of recently and I've heard I need to file a I751 with the filing joint waived. Do I indeed file it now or within the 90 day window before the expiry on the green card as per usual?

    Also, I'm of course very nervous I'll get denied. Any tips for evidence that it was legitimate? I know it's hard to say if they'll approve.

  3. Hi! I've tried to look up this topic, but cannot seem to find what I'm looking for. I apologize if the answer is simple, but I am confused.
    From my knowledge I understand as a new GC holder (as of a year ago or so) I can't spend more than 6 months outside of the US in any given year - is that each calendar year? Or from the time of my initial GC date? And is it days in total, not 6 months at a time?
    I've been traveling alot and have been tracking days out of the control, which it's fairly close to 6 months now (it's 5 months or so in 2018).

    I am needing to find out of I apply for the removal of conditions separately immediately after divorce or the normal 6 months prior to the 2-year conditional GC I now currently have expires?
    It's sort of an urgent question because I wasn't aware of needing to file immediately after divorce IF that's the case. Yikes!

  5. My husband has filed for divorce this week and he’s agreed to send me all of the necessary documents that I’ll need to prove a bonafide marriage once I renew my green card. I am currently asking for our official marriage license and everything we had copies of for our petition. What else would be a good idea? It is my one opportunity.

    I received my conditional 2 year green card 5 months ago.

    I have changed my address - do I need to report our divorce to USCIS as it is processing or once it is official?

    I've heard otherwise from every other source. Hmmm. As long as you can proof it was a bonafide marriage after the divorce it will be likely I receive it, no?
    I'm asking if I leave to live overseas and come back within 6 months will it be a problem?

    My husband has filed for divorce last month and I have since changed my address and in that process.
    I have savings and am planning on traveling to Europe for 4-5 months for a "self-exploration" and fun travel experience... will I find problems coming back into the US when I arrive back in 4-5 months if I don't have any ties to US (job, lease, etc.)? I won't accumulate more than 6 months outside of the US... although - does the time limit begin each new calendar year? Thanks. :-)

    If a married couple legally separates is it better than divorce in legal eyes? I have my conditional green card... are the two interchangeable in this place, or should we go with being legally separated? We've chosen to take a long break from one another and live in different places - will it seem wrongful or fraudulent to wait to be divorced? Thanks.

  9. I am the beneficiary and my husband has asked for a divorce after a month...he in fact kicked me out via TXT (yes, I know).

    I am concerned I will not be able to keep my conditional green card now, let alone have my green card renewed in two years time.

    We have several shared accounts and I have been a beneficiary on his retirement accounts and that...does anyone have a sense of how likely it is I can keep my card? It is clearly a no fault relationship - he simply thinks I haven’t been investing enough in the relationship.

  10. Hi - I was told I don't need a certified copy of my birth certificate to bring to the interview... but just the other day I was told directly by USCIS that I only need a photocopy of it. Is this correct? On the list directly on the form it says "Your Birth Certificate" and a few items below that it says the "original" and "copy" of everything submitted. The problem being that I am pretty sure I accidentally submitted the certified copy I had with the application already... will they have it at the interview? Do I still need another certified copy to bring to the interview?

    Sorry for the questions, but as we all know this process can be SO tedious... just double-checking! It's making me SO nervous. THANKS! :-)

    You can remove conditions with a divorce waiver. You must satisfy them that the marriage was entered into in good faith. Seems a shame for it to be over so soon. Have you tried counseling or maybe just a break for a short while might be enough? Have you been home at all since you moved here? Homesickness can cause a lot more problems than people initially think. 


    Counseling is very expensive, but we've certainly considered it; we have always considered a break.
    And no, I have not been home since getting the K1. Our marriage in Michigan was the last time I've seen some of my family unfortunately.

    So if I travel abroad 2-3 months after our divorce it won't affect my eligibility? As long as I can prove that it was entered in good faith?

  12. My husband and I have been going through some rough patches and we've brought up the discussion of divorcing... I'm wondering if this will affect my eligibility to renew my green card (I received my conditional green card about a month ago).
    Our documents include:

     

    - beneficiary on retirement/health insurance

    - beneficiary on airline benefits

    - joint car insurance

    - joint bank accounts

    - joint creditcard accounts

    - marriage photos/invitations, etc.

    - photos and documentation of our ongoing relationship (letters to both of us at our US address, etc.)

     

    If the relationship ends I'm going to most likely travel abroad with the savings I have for 2-3 months, while having a new US address and bank account, etc.

    Would I have problems getting my conditions removed if I choose to file separately?

  13. Hi! Just a quick question - I have submitted my only certified copy of my long-form birth certificate in the K1 interview at the US consulate in my home country previously. It says "Your birth certificate" under required documents to bring to the AOS interview - does that mean I need another certified copy of my long-form birth certificate? I don't think they'd have the certified copy with them at the interview, correct? It's up to me to provide a new one. And if I can't get one in time - do I reschedule?
    Will my husband need a certified copy of his as well?

    My husband and I are considering traveling the world for awhile after I receive my 2-year green card from marriage. How do we go about doing this in a proper manner?
    From what I understand I can't travel more than 6 months outside of the USA, however we can hop around during that time in other countries each year... right?
    How does a permanent residence work? If I'm renting our place out during our travels it can still be used as our "permanent residence", right?

  15. Hi - I cannot find good information about this online... is it simply too difficult to answer accurately? Assuming one had a good amount of proof (shared accounts of all sorts while married, etc.) and divorced sometime within a year of the initial 2-year green card, how likely is it to receive the 10-year green card if you file separately after divorce? Thanks so much.

    you can go a few months each year, but 6 months is too much

     

     

    Yes, it would most likely be 3-4 months a year in Mexico for us. And, not necessarily spending 6 months in the US a year, maybe a couple. 

  17. Hi!

    I'm currently living with my husband in the USA now and have applied for my AOS Green Card about a month ago. We're looking into buying a home in Mexico, to live there about 4-6 months out of the year very soon. Is it a problem if we're living there for that long? If so, is there any ways around it? We'd be staying in the USA for a few months a year and elsewhere for the remainder. Any ideas?
