  1. Can't help with that I am afraid. Us K1s do not have to file a I-130 petition, as we did a I-129F petition during the visa process. Only J1, F1, B1/2, VWP adjusters need the I-130. I think it needs to be approved before getting the GC. Also, as an adjuster from anything but K1 you are almost guaranteed to have an interview from what I am reading on here.

    Disagree with interview part. USCIS interviews most/all marriage based cases. In case of K1, since people have already appeared for an interview @ consulate, USCIS gives them interview Waiver - not all K1 cases get Waiver. People adjusting from other marriage based visas get interview call, this is because unlike K1, they have not appeared for an interview - like people adjusting from J1, F1, B1/B2 etc..

    USCIS gives interview wavier to all/most employment based AOS - like people adjusting from H1B, L1B, L1A. They can still be asked to appear for an interview which is 2% to total cases, for audit purpose. Also, they can be asked to appear for an interview if the name check/background check returns some sort of flag.

  2. Since many of us have just received EAD/AP approvals, it is a good time to know about potential USPS issues. Some people get 'card not deliverable' or get cards lost in mail. Is there anything we can do in advance to offset such possibilities? Should we call our local post office or anything?

    Why not think positive ? If you got your NOA on the address on file, you should get your Cards as well. All cards are sent via 2 day priority & USPS tracking, sometimes the tracking number is mentioned on your status update. if it is not, you can call USCIS and they will give you the tracking number.

    Use that tracking number and contact your local post office.

    No one can predict exact timelines. Marriage based AOS can take anywhere between 3 - 6 months. While employment based can take a little longer than that 6 - 8 months.

    Marriage based AOS cases get GC faster as USCIS assigns 240,000 GC's for this category. For Employment based GC's the number is 140,000 - no country can get more than 7% GC in a given year.

    Since you have your EAD/AP approved, you would either get an "interview wavier letter", would be called for interview or directly get a GC. EAD/AP to GC should take about 2-3 months max, but again this is not 100% accurate. USCIS is always short staffed and local office might have several interview cases ahead of you (if they decide to interview you).

  4. Just got the text for AP approval. It didnt say much. Site said approved though:"on march 20 3106, we approved your form 131 application for uscis travel document...etc...we will mail your approval notice" ....strangely loggin in now shows a site error :(

    No email.

    Yesterday got email first, text shortly after. Email said same as site. Text just says case has been updated goto site for the EAD approval.

    update: email re AP approval just came today. and site error has gone away.

    USCIS website & Level 1 Support cant be trusted :) You will get your AP & EAD combo card (If you applied both together). My wifes EAD came without any update -- one day it just showed up in our mailbox - they update the website manually, so it is upto the agent working on our case what level of details he is willing to enter. Sometimes they are kind enough to provide tracking details as well. All cards (EAD/AP/GC) are mailed via 2-day priority & 100 USD insurance.

    After the flurry of status changes I got yesterday, anyone know what the next step is? I am guessing I'll get a NOA in the mail for EAD/AP and eventually the card will be mailed out. Does the status update online as well?

    Hi - You would directly get your combo card by mail - within 4-5 business days or earlier. The status on website would change to 'Card Mailed'. Sometimes, the status update would have a USPS tracking number. when my card was mailed, the status showed a tracking number. This was not the case when my wife's EAD/AP arrived.

    You should have yours around Friday or Monday next week. :)

  6. That is not true. A large number of K1 visa holder get approved without interviews as they already interview in their home country. These cases typically process at the NBC and can take longer. There is no way of knowing which batch you are in but this "all marriage based cases need an interview" is not correct.

    Almost All from EU countries do these days. Have seen few from UK getting GC without interview.

    Where I am now if my case was received Jan 4th? Can I submit an inquiry now?

    Yes, you are well over 90 days. please call uscis right away.

  7. Awesome news! Once you have GC you are good. No EAD or AP needed.

    For me, it is day 60 since NOA-1...

    Hi _ everything depend on field office. how fast / slow they process your information. NJ stays busy with applications - lots of applications. Since, almost all, marriage based cases need an interview, expect few months wait time before you get you GC. Which you will.

    Also, national average for EAD - AP is currently around 85 days. You are well within that time frame.

    Sit tight, you have your EAD/AP soon. GC could take a few more months. NJ field office moves a little slow, as there is always a good number of applicants waiting for their interview date. But rest assured, if you have proper documentation, you will get your GC, sooner or later.

  8. Thank you Abby, Yes i checked it many times and it is GC. I also checked AP and EAD case #'s with no update. I would like to thanks everyone who has helped me and Visajourney for creating this website with the steps outline that i can follow.

  9. I checked my case USCIS site this morning and got message "New Card is Being Produced!" Does this mean we are approved? without interview? SO unexpected!!! I also checked status of EAD and AP no update!. Can she travels to asia with this green Card? or she stills need AP card? I applied AOS in January 4th. Bio appointment Feb 8, walked in a day early.

    Hi Check again, It might be the combo card that is being produced. USCIS issues EAD & AP within 3 months of filing.

    GC would take a little longer.

    Let us know if you checked the status for I485 or I765

    ALSO - there are cases where i-485 was approved before USCIS approved EAD or AP. So, if it is showing "New Card is Being Produced!", you might be getting your GC.

    GC allows you to travel as many times you want. Single international stay should be less than 365 days/ 1 year. And NO - she would not need AP or EAD for travel. After you get your GC, your EAD & AP are useless.
