  1. Okay, the fact that you signed something could be a big deal, and it was left out of your initial explanation. So that may change the advice. It's time to figure out what happened.

    I was not allowed to drive the sprinter van at all, and I don't think at all it was in my name... (honestly barely knew the people we were with. The driver/manager was roommates with the lead singer of the band we were promoting, the other guy was a friend of some of the band members. Then there was my Canadian friend who got us this promoting job.)

    Yeah, the driver/manager was the one who paid the fine.

    I'm trying to remember if we did finger prints or not, but I do remember getting a full clothed body search. There were no "mug shot" photos taken either. The border patrol man who was processing me and my friend were saying things like, "ohh you girls might get deported back to Canadia (yes he said it like that)" and would laugh. After being released, they gave us back our electronics and belongings and let us on our way to go along with the tour. We were still in Texas for a few shows. I didn't have a temporary American address, so how would I have known if there was an issued court date :(. How would you suggest I check this out? I was actually thinking of contacting the via email or calling US customs & border patrol.

    I am guessing the manager/driver didn't admit to the marijuana being his therefore all of you were taken for questioning and charged. Someone has to admit to the drugs being theirs otherwise everybody is arrested. Thats how the NYPD does it or at least did it until they started issuing summons in lieu of arrest for a small amount of marijuana. You were most likely fingerprinted and the arrest showed along with the charge to the consul officer.

    I think you might also have another potential violation that is if you earned money thru shows/concerts while not on an appropriate visa.

    Squareleg, was your application expedited? Thats an exceptionally fast service i.e 13 days for a non expedited service. Malbol's was processed quicker too.

  3. Past weekend (5/21), came back from London along with my colleague who has similar story of overstaying visa, she has received her Global Entry. She has traveled extensively before and after receiving Global Entry.

    would have to agree with borderwife on this one. Makes zero sense for CBP to approve individuals who may have violated any immigration laws in the past. Would you give your house keys to someone who may have violated and trashed your house in the past while you were vacationing? But having said that, you can go ahead and apply. Imo, the fee isn't that much, worst thing that can happen is a denial. But please do come back and update us.

    Exactly as you describe... RFE... RFE Received... In Line... without any letters sent out or anything.

    The RFE sent and RFE response received" without an actual RFE being generated and mailed has something to do with Security checks that are rerun either because the applicant wanted a name change or somehow the initial checks weren't completed. If it's an actual RFE, the OP should receive something in mail in a week.

  5. I personally prefer enhanced license. Of course not all states provide that. A few that are close to the border do like New York. Oddly enough, the prices are the same for both at least in NY, $30 a pop. And both seems to be valid for land crossings and cruises from the islands but no air travel. I ended up going for the enhanced license because after all it's a "drivers license" and everybody keeps it in their wallet. Not sure what i'll do with an extra ID that being the passport card.

    Perhaps she needs to move on with her life!? If anything, karma will catch up to him. To the OP, you're just wasting your time, energy and getting emotionally drained by going thru this. Green card or not, half of the marriages here in the U.S end up in divorce. And from what you mentioned in your previous posts, yours seemed like a bonafide marriage. What happens if he does get deported...you'll gain nothing out of it and chances are your life will still be the same if not worse. So imo, let it go and move on with your life.

I already hire a lawyer and she already filed a notice of appearance and waiver of arraignment. and as far as my oath ceremony schedule I received the schedule already. Now I dunno what to do. When I asked my lawyer about this, she said, I have never been convicted, nor arrested, fined, or imprisoned, to the date the court has not filed any charges. So she said I am good to go to attend the swearing in. Is this right?

    Correct me if I'm wrong, but I think that the question on the oath letter also asks if you wee cited (in addition to the words you listed). I don't know if what the officer gave you is or is not a citation, but ask your lawyer.

    It sounds like a citation to me, which would mean that you were cited... because a traffic citation is also just a notice to appear... So is a citation for loitering or other minor offenses. But your lawyer should know this... in just guessing.

    citation or not, she was "CHARGED" for retail theft. It's not on the court docket yet which doesn't matter, the officer may not have submitted his paperwork yet. She would have to answer YES on the oath letter which in turn will result in a denial of her naturalization application. Wait for 5 years and apply again.

  8. No you don't have to wait, but unfortunately there's no absolute answer as to whether or not it'll affect your application.

    1) This relates to the requirement to show good moral character

    2) No indication if such a minor issue will impact their view of your character, especially if you plead guilty and paid the fines

    3) It's not clear if the statutory period is 5 years for everyone or 5 years for 5 year applicants and 3 years for 3 year applicants

    4) The USCIS policy manual states that even after the statutory period, some incidents can be taken into consideration

    You're complicating things as usual. Imo, this would have no impact even if the op pled guilty. It's an admin code violation of sorts. And i think its pretty clear everywhere that GMC period is 3 years for marriage based and 5 years for all other apps.

  9. The in-line for interview status is something that causes a lot of applicants some angst, mainly because it's the only update you get between biometrics and having your interview scheduled, which can be a period of several months.

    Quite a while ago, some VJ members started noticing that many applicants who file 90 days early (or at least more than 60 days early) are placed in-line exactly (often to the day) one month before the 3rd of 5th anniversary of their green cards. Just based on all the monthly threads I've read, I'd guess that this has been going on for a couple of years now and that it applies to about 60%-80% of each month's early-filers.

    If you don't file early, you obviously can't be placed in-line before your anniversary.

    Also, if you file 50 days early, and do you biometrics a month after that, you also won't be placed in-line a month before your anniversary simply because there isn't enough time.

    So most people who don't apply early enough to fall into the category I'm talking about, are placed in-line within a week or so of biometrics.

    The remaining group; those who aren't placed in-line exactly one month before their anniversary or within a week or two of biometrics usually have a longer wait ahead of them due to a prolonged background check which can take anywhere from a month to, in rare cases, over a year. 3 - 6 months seems to be a more common wait time for this group.

    This is all just based on my observation, so we decided to keep track of it for the December 2015 filers. Out of 35 applicants, 11 applied early. Of the 11, 1 got his biometrics appointment less than 1 month before his anniversary, and so does not fall in this category. For the remaining 10, the 1 month before anniversary inline prediction tracker is shown below.

    There are always exceptions to these predictions, and no one should worry if they are not placed in-line when they expect; note that every one on the table was eventually placed in-line when their biometrics checks were completed. Also remember that being placed in-line isn't all that special... you could get an interview notice two days later, or you may have a wait of several months ahead of you.

    Out of the 10 of us who filed early, 8 were placed inline exactly 1 month before the green card anniversary date (with exceptions for weekends). Two of us were not placed inline by the predicted date.

    Agree...there is also a chance of applicants getting back to back emails for "In Line" and "Scheduled interview" on the same day or in the next 24-48 hours. One month prior to anniversary that is.

  10. Citizenship interview of an individual is coming up, who has a arrest record 2 years ago, arrest was for DV(misdemeanor) but case was dismissed and expunged before trial.

    what are chances for Applicant? i know this question should be asked from a Immigration attorney but i know there are some experienced individuals here.

    If the case was outrightedly DISMISSED then it wouldn't matter whether u were charged with a murder or DV. If the dismissal was in lieu of something like a community service, a fine, or diversions then it could be problematic for immigration purposes. You def need to see an attorney in person.

  11. Went to my interview yesterday. I'm probably one of the last ones in this group to interview, but here it goes anyway:

    Arrived 30 minutes before scheduled time, which was 1:40PM, but wasn't called until about 45 minutes after. Actual interview lasted only about 15 minutes. I was asked to do an oath that everything I say will be the truth, blah3x. Then asked to read: "What state has the most people?" and then asked to write: "California has the most people." He verified the demographic information on my N-400 application. We had moved to a new address and he wrote it down on the form, despite having an AR-11 in the file. Then I was asked the civic questions:

    1. What were the amendments about who can vote? (I initially answered only one, but he said go on, so I answered all four)

    2. What was the main concern during the Cold War?

    3. If the President can no longer serve, who becomes President next?

    4. Name one branch of the government.

    5. Name two rights of everyone living in the United States.

    6. What is one reason colonists came to America.

    Then I was asked the yes/no questions. In between those, he kept going back to how many children we have, my birthdate, is this my first marriage, is it my husband's first marriage, are our kids US citizens... Then he printed out a form with my information, asking me to sign to verify its correctness, then he printed out another form with the "recommended for approval" checkbox marked!

    I brought a few documents with me, specifically 2015 tax forms, recent joint bank account statements, recent pictures, new lease agreement... Basically anything I could think of as more evidence for our marriage since I sent in the application. But he only asked for my.

    That's it. Now to wait for the oath date, and hope my husband's off on that date so our whole family can go!

    congrats on recommended for approval. I was recommended for approval in NYC about two weeks ago and still waiting for oath. Keep us posted...did your online status change? Mine still says interview scheduled.

  12. my interview was a looong one. the officer asked if my husband is with me. he was at work so she grilled me on my outside US travel without my husband. She asked for my trips (i did not memorize all the dates of my trips) but it was stated on the form. PLEASE BRING OLD PASSPORT if you renewed one. She also asked for the CA ID, and green card.

    this was the weirdest question : my husband is divorced so she asked if i know the ex wife's birthday! i said no, i dont know because why should i? lol

    she asked me almost the whole form itself, including my birthday, my address, all those yes or no questions on the form.

    for the verbal and written, she wanted an answer word for word. the question was: what is an amendment to constitution- i answered, its a change or addition , she said that;s incomplete so i got really confused because its the right answer, i repeated the answer and this time i said, a change (to the constitution) and / or an addition to the constitution. she said correct. --- hahahaha

    the questions are preset on a sheet of paper, i got ALL answers correct so I did not have any problem. my oath is in march 30.. hopefully u dont get her as your interviewer, she was definitely tripping,

    Indeed i also think the IOs are given a preset of questions in groups. Just out of curiosity, did your other questions beside the amendment include, 1. Who vetoes a bill....2) Capital of your state....3) Countries that fought in WW 2....4) what do we show loyalty to when pledging allegiance? cant remember the sixth question though...

  13. This is usually cleared up within a week or two, but I've seen it take as long as a couple of months. It's impossible to predict without knowing if any issues came up during your interview. If none, then probably a few weeks at most.

    Online status sometimes doesn't change. It may not change at all after the interview even after your oath.

    I had a couple of issues namely a brief arrest by CBP for overstaying visa and a pink summons for riding bicycle on a sidewalk which was dismissed. Because of these issues and the IO being extremely thorough (asked each and every question from page 1 to last, including a gap of employment for a couple of months, my GC isn't work based ) i was expecting the decision not made box to be checked after the extensive questioning but i was happy when she said she is recommending me for approval. Now the supervisor is holding the file i guess.
