    Hi Duncan 21, thank you for your answer. The only reason I haven't done the 2016 taxes us that I have some e-commerce income; in addition to my regular job's income. The e-commerce income is nothing substantial and my full-time time income satisfied the  sponsorship requirements by itself. The problem is some of the e-commerce platforms don't provide 1099s unless  you reach $20000 in transactions. So, since the embassy will want to see the tax forms that prove income, I can't provide them with a 1099 to prove income from online platforms. I can only supply the W2, which meets the requirements of sponsorship. I didn't want to complicate things by adding 2016 taxes. This is the first year I made money on e-commerce.     My wife has her interview in two weeks from now. My question is about the affidavit of support. I haven't done my taxes for 2016 yet. On the affidavit sent to the NVC about 4 months ago, I sent transcripts for 2015, 2014 and 2013. Will the embassy ask for the 2016 tax return or should I just send my wife the same affidavit and tax documents that I've sent to the NVC. Your advice is greatly appreciated. Thank you in advance! 

  3. Hello everyone. I just sent my I-130 package and somehow I made a mistake on the G-325. instead of putting 2013 as the date of divorce I entered 2015. The Date is correct on the I-130 itself and I also submitted a copy of the divorce decree that has the same correct date as on the I130. Onlu the G-325A has the wrong year. I realized that I made the mistake the same day when I sent the package. I requested a package intercept on usps website but I'm not sure if that will work.

    What should I do now? The package isn't the delivered yet but I can't stop it.I am so mad at myself for overlooking such an obvious mistake. Please advice!

  4. Hello everyone! on August, 2009 I obtained my first green card and then 2 years later I got my 10 years green card, and this was through marriage to a US citizen. August, 2013 we got divorced. Last November I obtained Citizenship through naturalization after being a permanent resident for over 5 years.

    Now,I got married last August and I'm preparing the I130 to bring my wife here to the US. I'm having a hard time figuring out what to do with questions 14 and 14b. should I answer question 14b with yes. I know that they ask this because people have to wait 5 years after becoming residents to be able to file for a spouse after divorce from the previous one. Do the 5 years start from obtaining the 1st green card or after receiving the 10 year one?

  5. That is not correct! per IRS and many tax professionals. When filling MFS you only need to put "NRA" instead of the spouse's SSN.

    Filing MFS will need an SSN or ITIN so the IRS can go look at the other return to prevent the other MFS from taking disallowed credits and deductions.

    If she will have an SSN by October 15, you can get a 4 month extension, then another 2 month extension on the filing. Since you expect a refund, no need to pay any tax due.

  6. Thank you so Maria! from what I understood I can amend MFS to MFJ within 3 years but I can't do the opposite unless you do it before the tax filling deadline.

    Do I have to include any special forms when I amend the return. cause they lady at the IRS office mentioned that I have to include a W7, which doesn't make sense because hopefully my wife will have a social security number by them? I will be submitting the I130 next week. Thank you once again! I really appreciate it!

  7. Thank you For your answers. What I really want to know is if it's possible to to amend a the return a year of so later and still get the refund difference. getting my wife's passport certified means she has to schedule an appointment with the embassy or the consulate and that will take quite sometime, a couple months at least, just for the appointment. Also, mailing original government issued IDs of passports is illegal and the post office over there checks what'd inside each envelope before sending it. I'm just hoping that it's possible to file separate now and amend the return as joint later. Thank you once again for your answers!

  8. Hello, I have been having a hard time finding correct information about the ITIN filling procedure. I have contacted two H&R Block acceptance agents, a private CPA Firm That has acceptance agents, The IRS both over the phone and in person. So far none of them seems to have a clue;it's shocking. The first one asked for my wife's drivers license and National ID (originals only) and also the marriage certificate (which is not mentioned anywhere in the required documents in the IRS website. The second place said they wouldn't do it because my wife should be here for them to accept her passport. I left in less than 5 minutes, because I wouldn't let someone who has no clue file my taxes. Then, after calling the IRS, the person on the phone stated clearly that she doesn't have that information and that should look at the website. I scheduled an appointment with the IRS tax assistance center, the lady there said that I would have to get a certified copy of the passport (which is, like everyone knows, somewhat a hassle to obtain in many countries). she also said that I can amend the return and include a W7 with it, which doesn't make any sense.

    After that I called another H&R Block acceptance agent and she seemed to be helpful, until she said that I wouldn't be able to amend my return from MFS to MFJ.

    You Guys are my last hope before I give up on filling jointly. The difference in the refund I will get If I file jointly is significant. Also for USCIS, it better to file jointly.

    Does anybody have experience with the possibility of amending the return from MFS to MFJ? Can anybody advice me if I should just give up on it and file MFS? It has become very frustrating to call and meet tax professionals who only contradict each other's and leave us confused at the end. I mean, If I called the IRS themselves and they said that they don't have that information, than who else would know. I have faith in this forum, as I believe that peoples' experience is the best teacher and the best source of information. Please help! it would be greatly appreciated. Thank you!

  9. Hello everyone! I'm new to this forum and I need help with the ITIN Number.

    I got married last August and I just recently became a U.S citizen. I am about to start the procedure to bring my wife here. Since we are in tax season, I need to file my taxes as married filling jointly, because of the financial advantage of doing so. My questions are: do I need to wait for the ITIN Number before I can start the I130? also, do I need to send copies of my annual income taxes, including 2015's with my I130? Do you recommend that I file the I130 myself or should I seek help from and advisor?
