There is no problem. She can file for citizenship (N-400) based on the 5 year rule. Good luck.
Thanks so very much again!

You will receive a two year extension on that green card with the application for citizenship, so the process can go for much longer and she will still have a valid green card in hand.
That is very good news maam and I thank you heartily, we will have the 400 en route in the next several weeks!

She has a 10 year Green card which expires in 2025. You are asking if she needs to do anything other than submitting an N-400, correct? If so, the answer is no. She can just apply for citizenship at any time, assuming she meets the other qualifications..
There is no visa.
Thanks much, yes I said visa when in fact it is the ten year green card. I was worried that if the n-400 process overlaps with the expiration of her green card next year and we still haven't had her interview, would that be a problem. It's our fault for waiting so long, we had ample time to apply.

Visa or Green card?
Tx very much she has a green card the IR-1 and it expires in May of 2025

Hi Everyone, for no specific reason we have waited until the end of the ninth year of my wife's IR-1 visa to send the N-400. Her visa expires in May of '25.
If we are still waiting on the visa process to complete itself as we get closer to that date will we have any problems with immigration or should we take some steps now as we're getting ready to send the N-400? Apply for a visa extension perhaps?
Tx very much!

Thank You to everyone for your help! This information was valuable and should let us proceed with some accuracy.

Hi Everyone, my Wife, in some of her most recent trips back home to Colombia noticed that her passport ( Colombian ) doesn't contain date stamps every time for when she entered that country.
For the N-400 of course it's required to verify your time outside the USA, does anyone know of other forms to verify the dates of international travel besides looking at your passport stamps?
Thanks Very Much!

Thanks to everybody for your valuable info which confirmed what I thought might be the case.
We will get her updated wth USCIS at once.
You guys are awesome!

Hi Everyone,
My stepgaughter is preparing to file her N-400, she came here in 2015 on an IR2 along with her Mom on an IR1.
My step-d graduated University here in 2019 and has worked a series of professional-level jobs in her Biology field but these jobs take her to several areas around the Country, and most times she has not informed USCIS of her new residences.
Each move was permanent but she got better job offers and would relocate again.
Additionally she has purchased and registered a car in another state but maintains our home address in Wisconsin for her Drivers License and much of her mail as well.
USCIS requires residential updates and the N-400 asks for them as well but I wanted to get your thoughts on any potential issues she may encounter over not having being current with them.
Thanks!

They want to buy through the Exchange?
Yes, in Wisconsin or New Mexico depending on which job she takes.
Just her, her Mom and I are covered with our own health insurance.

Hi Everyone,
Does getting your health insurance though the Affordasble Care Act (Obamacare) affect your chances of applying for citizenship?
My stepdaughter changed jobs to part time and wants to apply for it.
She and her mom are IR1 green card holders and have been here for five years.
Her Mom worries that Obamacare qualifies as public assistance.
Many Thanks.

Thanks everyone,
I'm not worrying now after reading your answers.
She is a retired teacher from Colombia and has health benefits from there as well as the US, but prefers a Doctor down there.
Thanks again.

Hi,
My wife is in her home country of Colombia and has been for two months having medical evaluation for an upcoming hip replacement.
The surgery will be done there in late January, her recuperating period will be somewhat lengthy so we are thinking of having her come back before the surgery.
How long would she have to be back in the States before returning to Colombia for the surgery and resetting the six month time limit, or is there even a minimum time?
Once the operation happens she will be unable to fly for quite a while.
She has an IR1 and has been in the US since 2015.
Tx!

Abandoned 485's, family emergencies, what kind of family emergency warrants risking never getting a visa to the US again? You need to get real, people sacrifice their entire lives and loved ones to come here, I have seen them at O'hare arriving with plastic garbage bags for luggage.
It honks me off to see people with tentative legal permission to enter treating this country like a revolving door for tourists when their supposed intention was to live here permanently.
If I were at the checkpoint I probably would not let the man pass.
He should not have gone.

Thanks,
It would have to be an earlier period in time in her case.
Last year I used the several continuous years that she was in Colombia PRIOR to coming here for the first time in May, 2015 because she had been in her country non-stop since 2009.
i'll have to claim my 330 days from that time block because since May of 2015 she was in/out of the US three or four times, enough that we can't piece together 330 days.
I didn't see in the rules that you can't use the same time period more than once, do you have any info on that part?

What do you guys think about my wife using the 2555 to exclude her foreign income in 2016 after having lived in the USA for several months in that same year and about 4 months in the prior year?
She filed it (the 2555) successfully for the 2015 tax year (her first year with her IR1 Visa) because she had been in Colombia for many years prior, but in this past tax year she was finalizing her retirement in Colombia and only spent the first 7 months there before coming to the US permanently in August of 2016.
Would she still qualify to have 7 months of Colombian teacher's salary excluded if she had already been to the US for 4 months in 2015 (May through September before she returned to finish her teaching obligations). ?
Tx!

Thanks everyone.
I learned a bit more here in Bogota since posting the question and we saw her Doctor , which confirmed the info posted by you guys.
Interestingly her particular blood pressure med is available over the counter, so we'll buy a decent supply from Pharmatodo before heading out. Thanks!
-
Hi Guys,
Anyone know if American pharmacies will honor an RX that was issued in Bogota?
My wife takes a common high blood pressure med and would need it refilled here once her 60 day supply runs out.
She's just now making the permanent move to the U.S. on her IR1 visa.
Tx!

The ELIS status for both of them is still " In Process---Optimized---" and the PDF snapshots are accurate, the "as of" date is June 25.

Hi Guys,
My Stepdaughter might need to return to school in Colombia ( first semester Sophomore at a University in Bogota) BEFORE her permanent green card arrives.
My Wife and SD are IR-1 and IR-2 recipients that arrived on May 27, and SD's semester begins in 4 weeks.
SD intends to transfer to a school here in the States after this semester, but she's locked in to this final semester in Bogota first.
Do you guys think she would jeapordize her Visa by traveling BEFORE the permanent one arrives?
-
Thanks so much, will do.
-
Hi and Thanks everyone.
On the ELIS site we are listed as "accepted" --- "optimized"--- and "In process".
The pdf snapshots of their vital info is correct as well.
I paid the two green card fees on May 5.
Does that sound in order?
Tx!

Hi Everyone,
My Wife and Stepdaughter arrived from Colombia on May 27, in Chicago, on the IR-1 and IR-2 visas and I was just wondering how long the physical GC takes to arrive, but more importantly... does it arrive automatically without having to do anything else?
Secondly, my SD indicated "Yes" on the DS-260 last summer where they asked if she would like a Social Security card produced for her, and is this also done automatically once they arrived and are admitted?
Thanks!
Almost last year of visa, finally appying for citizenship!
