  1. I know, hence why you would need to get the I-94 with the I-551 because your passport is expired. Did you not read the info and links in post #25 and 26 of this thread?

    Its better to bring too much evidence than not enough, never know what they are going to ask for. Some USCIS offices even want to see your driver's license, don't ask me why, wife or stepdaughter wouldn't even have that until they showed a valid green card first.

    Also purchased a folder type brief case where everything dealing with the USCIS from day one was organized in folders, brought that along just in case. Had a complete copy of our I-751 with all the original evidence in it.

    You also want to keep all those expired passports, need that for the N-400, want a log of all of your trips, stepdaughter had to bring that to explain why she didn't make any trips since coming here and her IO wanted to see that, was expired before she even received her conditional green card. Wife had both an expired one and her renewed one, they wanted to see that as well.

    Then they wanted to see a completely worthless joint utility bill that is not even required evidence, but she had that in that large brief case as well. Wife commented her IO looked very disappointed when she pulled that out.

    Ha, look at this as a game, one trying to outwit the other, be prepared, and always be super nice. Don't over or under dress either, but look clean and presentable.

  2. You seem very confused. You do not apply for an I-94, and certainly would not at an infopass with the USCIS. An I-94 is given to visitors/non-immigrants upon entry to the US by the CBP.

    Visas are issued outside the US and are used to legally enter the US. You did not receive a 2 year visa. You applied to adjust status and became a permanent resident. You were given a green card with a 2 year validity, and once your I-751 to remove conditions is approved, then you will receive a green card with a 10 year validity.

    Thank you for clear me out about the difference :) So what i need just asking for I-551 stamp with my expired passport, and bring 2 passport photos to extend while i am waiting the decision, correct?

  3. Couldn't agree no more with everyone. Just divorce with her & try to get custody for your kid. You're not her real partner, just sugar daddy to provides everything not just for her but for her family, that's ridiculous, that's not your job dude! If she want to provides her family with luxury, go ahead if it comes from her own money from her job, not all from you.

    You have to be more straight to her if you decide don't want to divorce, tell her something, let her know that you're the man, and she is not the boss, marriage is equal.

    Tell her if she is looking for a man who has a house or can provide everything at anytime she wants, tell her to get out of your life because you're not the man that she's looking for.

    Don't be afraid to divorce with a type of person like this, not worth it to stay in marriage.

    So what do i need to bring beside 2 assport photos? Which form that i should fill, Newacct? this is what i got from google : The USCIS will typically issue the I-551 stamp with a validity period of 6 to 12 months. However, if the applicant’s passport expires prior to that time, the stamp will likely reflect the expiration date of the passport.

    Newacct, yes correct, my extension letter will expire in 1st April. So i can make an appointment at USCIS to get I-551 stamp eventhough my passport already expired, then where do they will put the I-551 stamp for me to carry anywhere i go?

    If you are still married to the person who initially petitioned you. You cannot do this if you are filing with a waiver unless the initial AOS case was VAWA.

    OP has no timeline or previous posts so it's hard to tell how they're filing, what they came over with, etc...

    I came here on 2011, then i got my 2 years visa 2013 - 2015.

  6. Correct. If travelling internationally you will require an I-551 stamp from an Infopass if your one year extension has already expired. Once you have the I-551 stamp you will require no other document to travel, just your passport with that stamp in it.

    They will likely keep your original green card at the Infopass when they give you the stamp; this is normal.

    Just to add to what Hypnos has already said> Even if you were working, you would not need an EAD. You are a permanent resident green card holder and do not need an EAD to work in the US.

    Doesn't her passport need to be unexpired though? The stamp is to verify that she is a permanent resident whose application for a new card is being processed. If you are traveling internationally, you need a valid passport. No?

    You have your expired conditional card and that one year extension letter, effectively extending that expired date for one more year.

    Good question to ask, is why do they only make that extension letter only one year, can't even process your I-751 application in that very short time the way these service centers operate.

    Once that one year extension letter expires you are no longer able to work or travel, so forced to make an infopass appointment to either get an I-551 stamp in your current valid passport, OR bring in two passport type photos and apply for an I-94.

    Depending on the laws of your state, if you applied for your driver's license, it may have expired the same date your conditional card expired, you cannot drive with an expired driver's license. Even with that one year extension letter, may have our experience, and I quote, P what in the hell is this one year extension notice. And if you are working, your employer may say the same thing in a politically correct manner.

    When you very politely reply, this is how the USCIS operates, you hear, what in the heck is the USCIS? Admittedly, all of my friends, relatives, and even myself never heard about the USCIS either. So this requires a lot of proof and explanation.

    And even furthermore, they will ask, what in the heck is an I-551 stamp in your passport or that I-94? That requires even more explanation.

    One key reason why we were prompted to apply for US citizenship practically exactly one year after we applied for the I-751, this everyone understood. Proof for natural born US citizens is a birth certificate.

    But we still had to make that infopass appointment for either that I-551 stamp or that I-94, the latter is far more convenient. Just like your green card, you are required to carry that I-94 with you at all times. Well maybe not to your bathroom at home, but as soon as you leave your dwelling.

    Yes, this was a very troubling time for practically all of us.

    So, let says, if I wanted to travel before receive the 10 years GC, I should make an infopass appointment and get the I-551 stamp, and travel with the NOA1 letter, and if I don't want to go travel out of country, i don't have to make the infopass? only driving around with my DL? because i'm not working either so i don't need EAD.

  9. You could file for citizenship using an N-400 as long as you are qualified. Your RoC does not have to be approved to do this. Filing an N-400 forces USCIS to adjudicate the I-751; when called to your N-400 interview they may be adjudicated back-to-back (i.e. you have an interview for your I-751, it's approved, and your adjudicator immediately moves to the N-400).

  10. Hello everybody, I'm getting frustrated now towards my ROC. This ROC journey is way too slow!

    I filled on April and got my biometric on August then I got RFE and I sent the evidences & arrived on 11/24. ( I used with tracking # but the usps lady eventually didn't put signature requires eventhough I told her ) so I had no idea who was the person at USCIS got my RFE paper works ).

    Until now I haven't get any letter about approval or do We need to be interview or whatsoever.

    I'm thinking to call them if until the end of January I haven't hear or receive anything from them.

    I'm worry because my extended visa will be expire on April and my passport is already expired ( I didn't renew my passport because I wasn't attend to go back home for visit and thinking to become U.S citizen after ROC and make the new passport )

    So my question is how can I get another extend visa if until April I still got no news from them?

    I read that Infopass for expired passport only needs to bring 2 passport photos and USCIS will make in separate letter for the new extend visa, is that correct?

    And I can't check my status online because the status only said like My Case was received on April. No description like initial review etc
