  1. Well, I have good news now. My wife just called me with the news that her visa has been approved. She'll be here on the 27th ... or by the 27th, as she's also on standby for the weekend before.

Great to hear it was just a little speed bump after all. Now the fun begins :) When I have some time I will PM you about our life here in Oregon. Some ups and some downs. We go back to Thailand in about 2 1/2 months and then back here in May. Choke Dii

  2. I am shocked. I really did expect to read good news when I saw you had posted. But like they say disappointment is only equal to expectation. I am really sorry. I do wonder why they didn't inform you earlier that you had to do another I-864.

  3. Good Luck

I am sure the interview will go well as it seemed you had everything covered. She might not even need another interview. We lived out near Phimai and my wife got her PP back in about 5 days.

  4. For the police report they want to see the cover letter of the packet 3. If you are not in the country the noa2. In my case they took 5 weeks, yes it is a long time-- they used to take tea money to get it done in a few days but I believe the military government put the hammer down on them. !00 baht is the fee, they also want to see your passport if you are in the country.. You can have the interview without the police report but the visa will not be issued until they receive it.

  5. My spouse and I were trying to figure out something similar, because he has a business that he owns in his country and he will need to extricate himself from that before he can move the US. That makes things tricky, especially when you factor in time limits and such. (From what I understand, after you have your interview and are approved, you have 6 months to enter the US.)

In the end, we have opted to go through the entire immigration process in a timely manner, without stretching anything out. Instead of trying to time it all perfectly so that his entering the US as a Lawful Permanent Resident coincides with him moving over permanently, we decided that he would come over on a visit to gain his status as a LPR, and then return to his country to tie up his life/loose ends there. Then he would make the permanent move to the US. That way there's no rush or stress, with trying to make it all match up.

(If anyone can comment on whether or not they have done this, or if there are any potential problems with this scenario, that would be great!)

I believe the 6 months is tied to the medical. You must enter before the validity of the medical runs out. He can leave and return. It is best that he stays 6 months during the year to keep his PR.

  6. Hi,

Is there a time limit that the completed Packet 3 documents must be submitted? I haven't started the process yet, but just trying to figure out if we could file the petition (to get it out of the way) and hopefully be approved, but then drag out the Packet 3 process so that we could submit it, say 3 months after receiving it, so that it could work better with my planned timeline to immigrate to the States. This would greatly help us figure out an ideal time frame of when to ideally submit our petition which would allow me to immigrate at our ideal time, but also allow time for any problems along the way.

    Thanks in Advance,

    Mike

Since it looks like you are filing in Bangkok, there is a packet 3 ( unless things have changed in the last 2 months) and Yes you can take a year ( or longer if you notify them). And after that packet 4 can also be delayed.

  7. She could not. But even with no records, she just had to have the Tdap and the MMR. Its about 1/2 price to get them done at a different hospital before the medical and bring the record. She had hers done at the "snake farm hospital" near the US Embassy. But if you go there, be careful, they will try and get you to get other shots (flu, tetanus, etc)

  8. Hi VJ, please I need clarification on my case, my case has been approved and interview schedule for 21 July, 2016, my fear is that we met on a dating site and she's 57 I'm 34, we have been dating since 2014 and only file for k1 January. Just want to know if I have too much red flags,

Positive though Coz my family and hers are in support and we are truly in love. Thanks and I hope to get feedback please.

You should start your own thread for your question with maybe a little more information. But in short, if you have plenty of proof of a continuing relationship then you shouldn't have a problem. Letters from both sides of the family would surely help.

  9. Huh. Today, I received another tax transcript from the IRS. It came with a letter saying it's the one I requested on May 9. That was the night I called the IRS, and that was just over four weeks ago. So I guess the one I received earlier was the one I'd requested via the IRS website in April after all. So be warned, these are taking 4-6 weeks to show up.

I had the same experience. When I was in the States a year ago I had my wife send me a doc I needed for my Thai visa. A month went by and I had not received it and figured it got lost it the mail. So I asked her to send it again, In about a week+ I receive the package and didn't look at the mailing date, so I figured like yourself that it was the second mailing. About a week after that, I did receive the second mailing.

  10. Do you think they will tell us at the interview if we are approved?

There will not be any surprises with medical. All vaccines done, no TB (vaccinated as child ) no syphilis lol, never drugs. Heck I don't even smoke.

I hope they at least give us a clue!!

    Thank you!!

Yes, if there isn't any other problem. The visa will be issued when the medical arrives. Here they have let people have the interview without either the medical or police report and been approved "pending".

  11. Since you got my curiosity up--- this from the web

An I-130 is approved indefinitely. Once approved it will be processed by the National Visa Center if you are seeking to bring your spouse to the US from another country. You can keep the case open with the National Visa Center as long as you keep in contact with them at least once a year.

Once the year passes however, you will have to repay certain visa fees. And if you fail to contact the NVC every year they can close your case. You also at that point risk USCIS destroying the file.

  12. We got ours from filing the i-130 to interview and approval in around 90 days, but you can take much longer if you want. I am not sure how long the i-130 is good for but after the i-130 approval you do not have to send in the i-864 and supporting docs right away, maybe months, then you can delay the interview after the embassy sends the packet 4 ( interview readiness packet). Medical is good for 6 months and the embassy warns you not to get it too soon if you are planning to leave at a later date as the visa is only as good as the length of the medical validity.

  13. I can't speak for there, but here in Thailand they kept asking for the same things 3 times. I called the Embassy and they told me if I had sent it, they have it. Its just form e-mails that they send. By the time of my wife's interview, all they wanted was my 2015 tax statement and the originals (that they at first misplaced and then found after she told them that she just gave them to them ). But if the problem is on their end, remember with government jobs (and others) people rise to rank of their highest incompetence. Be patient with them.

  14. It's the main Income tax form number. He will have other pieces to his tax return being self employed like a maybe Schedule C https://dojmt.gov/driving/ where you list the money you earned and take off business expenses. And there's Schedule SE where he calculates self-employment tax (paying into Social Security and Medicare). If his property is rent houses, that's other forms. Schedule B and D for investment income.

Everybody has a variety of forms depending on how and where they earn money. Some have just one simple form. This year mine was 1040, A, B, C, D, SE, and 8938. His complete tax return has to include his 1040 plus any other Form or Schedule he did. Or order a tax return transcript free from the IRS and it's all condensed so fewer pages and no worries because it is complete and verified by the IRS.

Getting the transcripts is the way to go. He can order online for free and he will have them in about 5 days if he is in the states. I know someone that got them in 9 days sent here to Thailand.

  15. I find that very surprising myself. Most states don't allow the new resident to wait that long to change, but do allow vacationers to keep driving on their home country license for the extended period. Many confuse the difference and they are the ones that can get nailed. My wife had a drivers license in her home country, I was well aware as she was establishing residency here, it was only good for 30 days, not the year they give visitors.

I THINK that is what I am being told. Even if I am living here in the state, and I do none of the things mentioned to establish residence in the state. I CAN still be considered a resident of Thailand and can drive here for 6 months. The one year thing does confuse me, but reading between the lines. It could mean that the license is good for one year after entering the country. So if I moved into the state after 9 months of being in the states, it would only be good for 3 months.

I apologize for the "off topic" but I thought others might want to know that there could be "grey areas" in each states residence laws as far as being able to drive on their foreign drivers license. I see the OP worked out their own problem.
