    I have read previously that this site is really backed up since it only opened back up on 08/17 (Phase 1; Phase 2 on 09/28) .. and also that it prioritizes military and their family applications.

  2. When I was getting my Australian Permanent Residency, the Case Office asked me "What would happen if you were denied?" My jaw dropped and I must have looked totally shocked. I mumbled something about trying another time or another way.

    The CO smiled at me very apologetically and said that she was required to ask that question of everyone, and that she could tell, from the facial expression of the petitioner, how much the visa meant to them.

    It's a good question to be prepared for!

    Can't plan for a question like that. I spoke honestly and stated that my wife and I would work through whatever obstacles and that we would do so together. I was abit surprised when that was asked but just speak honestly and from your heart.

  3. GOD IS AMAZING!!!!!

    I got to the embassy at around after 6am for a 7am interview. Got to the first window at almost 7:30 and presented the necessary documents (marriage certificate, police record, birth certificate and medical)

    Waited almost an hour then name was called for the interview

    I wasn't asked for any tax stuff or pictures. They did ask me quiet a few questions though

    Questions asked

    Who is filing for you?

    What is her name?

    Have you ever been arrested?

    Has she ever been arrested?

    Does she have any children?

    What are their names?

    How old are they?

    Do you have any kids?

    How long have you known your wife?

    How long have you been married?

    How old is your wife?

    What does she do?

    Who is (the name of affidavit of support)?

    When last did you speak to your wife?

    Is she nervous for you?

    What did you talk about today?

    How does your wife make money?

    Have you discussed with her if you should get denied?

    Okay you are approved

  4. I agree that you did not technically file a petition for your first wife. She got her GC along with you.

    About your second question, it is what it is. Just make sure you have and show enough evidence to overcome any suspicion. Submit evidence of the bonafides of your current marriage/relationship, to show that it is genuine.

  5. Your I-130 checklist seems good to me. About your birth certificates, I am not sure I understand exactly what you mean by notorial certificate. But for all the documents you submit, you need to only submit COPIES not originals. In my case, my wife's birth certificate is in another language and was translated and the translation was certified. So we submitted a copy of the original birth certificate and a copy of the certified translation.

    Can I ask a question related to sending all documents to NVC?

    I am living in Vietnam. My case number starts with HCM.

    Can I send email to NVC all of my documents or I have to mail all documents to NVC?

    Check this NVC webpage for the list of countries and case number prefixes that must or can send the documents to NVC electronically.

    It looks like case numbers starting with 'HCM' CANNOT file electronically and MUST file through mail.

  7. I have a query. My father in law will be the joint sponsor because he earn enough. But my father in law and mother in law both do tax jointly. What form should we need to fill and what do we need to send. Please help!

    If only your father-in-law will be the joint sponsor (and not your mother-in-law), then you will need to submit the following:

    1. For your petitioner (spouse):
      • Signed form I-864, original (wet signed)
      • Tax transcripts or tax returns (most recent tax year or last 3 years)
      • Employment letter (as proof of current income, if applicable)
      • Pay stubs for the last 6 months (optional but another proof current of income, if applicable)

    2. From your joint sponsor (father-in-law):
      • Signed form I-864, original (wet signed)
      • Proof of US citizenship or permanent residence
      • Tax transcripts or tax returns (most recent tax year or last 3 years)
      • Employment letter (as proof of current income, needed to show your father-in-law's individual income separate from your mother-in-law)
      • Pay stubs for the last 6 months (optional but another proof current of income, also will show your father-in-law's individual income separate from your mother-in-law)
      • Form W-2 (optional but another proof current of income, also will show your father-in-law's individual income separate from your mother-in-law

    And don't forget to attach the barcoded AOS cover sheet that you will get from the NVC after paying the AOS fees.

    1. On the G-325A, under "This form is submitted in connection with an application for": Select "Other" and write beside it "I-130 petition for my alien spouse".

    2. For the address, best to use her own actual address but as long as she can get any mail sent by USCIS or NVC at that address, you can use whatever address you want. Remember, you can always change the address with the USCIS or NVC by calling them once you have the receipt number (USCIS) or case number (NVC).

    3. The alien registration number of A-number is on the Green Card itself and it should be nine digits.

    Most of these answers are already on this forum in many places and you should be able to search for them.

    Looks like you got that email you were waiting for. The email or the attachment should say when they received the docs, that is the scan date. You can call and verify if you want as well.

    Regarding sending only one tax transcript and W2, I think that is fine because that is all that is required, as long as it is for the most recent tax year. Some people, including me, choose to send tax transcripts for the most recent three years just to be on the safe side and also as evidence of the income reported for the most recent 3 years that can be disclosed in the I-864. But as far as the wording of the requirement goes, only the tax transcripts for the most recent tax year is required.

  10. Thanks. Is 603-334-0700 the number to call? What exactly are the correct questions to ask? We've done all this thru a lawyer so I haven't spoken to anyone official yet. Sorry if the questions are stupid!

    That is the correct number. Go through the options on the automated phone system first (I think first you choose 1 for english and then 7 to talk to a person, but the options may have changed). They will ask for the NVC case number, beneficiay's DOB and the names of the beneficiary and petitioner. Afterwards just ask them what is the status of your case, if you a case complete and when. That's it.

    If you have a case complete, you should get an email from the NVC in about one week of the case complete date.

    I wasn't aware of the insurance requirement for the K-1 category as well, but @Amadia and @Frankjavir seem to found info on this. However, there is no insurance requirement under the F-2A category, at least none that I am aware of. My case is under the F-2A category as well and we have a CC from the NVC without any such requirement ever being brought up.

    May be you should double check by calling the NVC about this. Also let us know on here how it goes. Good luck.

    on 9 March 2015, we received the approval notice from uscis my PD is 4November 2015.

    My husband told me that NVC call him yesterday they ask him for his income and they told him that he has to get an insurance for me ??? ?

    The problem is when we verify the W2 his gross pay is about 19.896 per year !!!!!!!

    And the minimum requirement is 20.025 in the property ...!!!

    So that means my husband can't sponsor me alone , he start working another job but just in his free time can he put this also to complete his income in the paper or not ???:?? Please I need help

    What visa category is your case, is it really F-2A or K-1?

  13. Irene and Joanna, I knew this was coming when you ladies started posting each other in Spanish, that is impolite and rude to the rest of the non-Spanish speaking VJ memebers.

    I have not read the extensive VJ's TOS but I am pretty sure some where in there it addresses your behavior which is a way of hijacking the thread.

    I am Hispanic and I am glad VJ has accommodated Spanish speaking members not only by language but by regions, so do not even try the discrimination card here.

    Every body here is welcome, we all are from different countries, cultures and backgrounds and English is the common language for us to interact and support each other.

    Dwheels76 has not been rude to any one in VJ, she has supported hundreds of people here and she is the official moderator for the topic.

    She was not rude to you ladies, she is just doing her volunteer job.

    A VERY short greeting in any other language to emphasize sympathy it is OK, I have done it in Spanish, Danish and Russian but keeping the subject in english. You can PM each other in any language.

  14. I called and asked for a supervisor. She said they shouldn't have check listed me for the Nigeria and Liberia PCC. She said she can't update my file based on our conversation but will have them review my case again for the India PCC and the BC. I explained to her again that if they are looking for something that says Birth Certificate they won't find it, but as per the DOS website in lieu of a BC we provided the sworn notarized birth affidavit from his mom, a notarized affidavit of birth not registered, and baptism certificate. I asked her if I should go ahead and submit the forms again just in case they come back and say they don't see it and her response was "it's up to you." She said she will get put in the request today for them to review my case again. I went ahead and FedEx everything over night as back up.

    I can't believe that when I provide everything exactly like they asked I still get check listed. I'm praying I don't have to wait another 30 days!

    So sorry you got a checklist. Be patient and persistent. Like Deji, I hope you can to get this resolved and will get a CC soon.
