  1. Hi everyone!! I sent my N400 on 19th December 2016. It's arrived 21st December 2016. However, it's April 2017 and the money has still not been taken out of my account and I haven't gotten and NOA or anything. I filed at Nebraska under INA 319(b) because my husband is in the army and we are stationed overseas. 

     

    I called the military hotline and after contacting Nebraska they said that there is a dispute as to if they should charge the old fee or new fee, since the fee was changed in 23rd Dec 2016 and once that is resolved then they will proceed with my N400. Apparently there are many applications sent that week and USCIS is deciding if they should charge the fee based on when you sent it in or when they put it in their system. 

     

    Is anyone else going though this? I'm at my wits end.

  4. I am filing my N400 under INA 319 (b), because my husband is in the army and we are stationed overseas. 

     

    I sent it to Nebraska and it was signed for and received on the 21st of December 2016. I still haven't heard anything back from them. It is now over 2 months.They haven't taken the money out of my account but I know it got there because it was signed for.

     

    Who can I call to find out about what is happening or is this the normal waiting times? I am getting a bit worried now.

     

     

  5. I am wondering what I have to put for Part 9 (time spent outside the USA in the last 5 years) on the N400 if filing under INA 319 (b)?

    My husband is in the Army and we are stationed in Germany right now. We have been here for 3 years and are going to Korea for another 2 years. In the last 5 years I have only been to the USA for vacations with my family(totaling about a month) and 2 weeks to meet my husbands family.

    Should I not fill out this section and explain why in the cover letter? Or should I take away the 6 weeks I have been in the USA from 5 years and put that? I honestly can't even remember when some of the vacations where.

    What should I do?

  6. Thanks for the info. :) I think im going to send it and if it triggers a RFE then ill just wait.

    I'd follow the directions on N400 to the letter. I'd wait for the actual resident card in the mail but that's me. You can submit N400 without a copy of your resident card and submit a photocopy of the I-551 stamp in your passport in it's place. I don't know if that'll trigger an RFE which it might well do and you'll end up waiting anyway. It may not, they may accept it. I'd consult USCIS by phone for clarification assuming no one else here has something to throw in. I'm sure someone else in this forum has been through your process before.

  7. Filing under INA 319 (b) means you dont have to meet those requirements.

    How long have you been a resident and married to the USC. Are you also in the military. I believe you need to be married at least 3 years and a resident that long before you can file N400 if your non military. From what I've read you can file N400 90 days before your hit that 3 year mark but not before it. Detailed instructions are in the N400s filling instructions on the USCIS website.

  8. My husband is a USC and in the military. I have my CR1 visa. I want to file for citizenship (N400) under INA 319 (b) since we are stationed abroad. I know that it says that you can only apply if employment overseas will be at least 1 year after naturalization.

    However, I am still waiting for my plastic green card to arrive in the mail (to a California address). But I do have the stamp in my passport the customs people put in at the and airport.

    I was told that it could take up to 6 months for my plastic green card to arrive and that the N400 takes 5-8 months. Given that i just got my CR1 this month (November) i am worried that by the time I naturalize, my husband will have less that 1 year on his orders and they wont give me my citizenship. We are due to leave Korea June 2018, which is definitely less than one year from when i would get my naturalization . We dont want to waste money or have it denied.

    So, can i file N400 with the stamped green card in my passport? Will this suffice? Or do i have to wait for the plastic green card to come in the mail first?

  9. Trust me, it is definitely not my "choice" to move to Korea next year. On the USCIS website it says:

    If you are at least 18 years old and are the spouse of a U.S. citizen who is a member of the U.S. Armed Forces and you will be proceeding to join your spouse whose work abroad under orders of the qualifying employer will continue for at least 1 year after the date you will be naturalized, you can file for naturalization. There is no time requirement for permanent residence in this case--you just have to be a permanent resident (even if conditional) at the time of the USCIS interview. There is no continuous residence requirement in this circumstance. There is no physical presence requirement in this circumstance. The good moral character, english and civics knowledge and attachment to the constitution are still required.

    That is why i was asking and confused.

    You don't jump the naturalization line due to been married to a military man or woman.

    The Military man or woman can get expedite naturalization because they are going to fight for a country and they could die so they get citizenship before deployment but you are a wife. That benefit doesn't transfer to you.

    They will definitely process it fast. Not all military families move with their spouses to their stationed base. So that's a choice and citizenship is not awarded for that choice.

  10. We got married in December 2015 and are about to complete the direct consular processing for a CR1 visa through Frankfurt (we are stationed in Germany) .

    My question is this:

    My husband has orders to Korea. Can i apply for expedited naturalization? I am under the impression that if you are a military spouse, you can apply for expedited naturalization abroad and not have to be married for the 3 years if his orders are for more than a year. Is this correct?

    I was just wondering which vaccinations I need. We are going the Direct Counselor Processing route in Germany. I am just wondering so i can get them done (for free) before I go because i don't have any at all and don't want it to be expensive for me.

    I have already checked the website and it says that it differs depending on your gender, age, and medical background so not to go get all the shots before your medical as you won't know which ones you actually need.

    My husband is in the US Army and we are stationed in Germany right now. I am a British citizen. We just got married and just sent off the form I-130 to Frankfurt USCIS, to get my visa/ green card through the Consular Process procedure.


    I am unclear about a few things. On the website i read that you can have your naturalization expedited if your husband is going to be deployed for longer than 1 year. Well my husband just got orders for Korea for 2 years.


    After my I-130 gets approved, i understand i will get conditional permanent residency and not legal permanent residency? is this correct? Or will i actually get a permanent residency and become a legal permanent resident? In the case of if ill already be a permanent resident, does this mean i will not have to file to remove conditions in 2 years?


    And will i be able to use that residency to file N-400 and apply for expedited naturalization since my husband will be deployed for longer than a year?
