  1. Hello,

     

       My wife came in on k1 visa. We filed original paperwork for I-485/I-765 in June 2017. We have heard nothing until a few weeks ago. Well, now my wife is pregnant and the due date is Sept 26. USCIS scheduled our interview on Sept 24 and since the office a 2 hour drive, we called and asked to reschedule. Well, they did, for October 2nd! This is crazy because the delivery might be late or we'll be traveling down there with a 1 week old infant (our first one). We called again to ask to reschedule and USCIS said because we just put in a request, we need to wait til September 27 to request another reschedule and there is no guarantee it will approved. We've put in Info-pass requests for local office but they turn them down. USCIS said they have no way to contact the local office to let them know our situation...

     

       Does anybody have any suggestions for how we can get this re-scheduled so we aren't super stressed about trying to make an appointment when we have a baby due?

  2. Hello,

      My fiancee has just arrived in the USA. We are going to the Social Security office this week to get an SSN so she can open her bank account.

     

      We have had a discussion before that because she is Chinese and there is no middle name, she should use the English name that she has been using social for many year as her middle name in USA documents. She often uses this name is social situations because people have problems pronouncing and remembering her Chinese name. She has no plan to change her last name to my last name after the marriage because she wants to keep a Chinese name for her business as a translator and Chinese teacher. 

     

      So our question is, if we add a middle name at this point to her Social Security Application and then the AOS application, etc, will it cause problems when returning from China? Will the airline or customs in China refuse to let her leave China to go USA because the name on the green card would have a middle and the original passport would not have a middle name?

  3. Hello all from Guangzhou,

    My fiance'e just completed the interview at the US consulate here. Everything went good, they gave her a piece of paper that says "Final Processing Letter". It says she got preliminary approval pending submission of documents listed. The missing document was the "CCP - Submit a statement". We just wrote a quick statement, answering the 9 questions completely and honestly in English and Chinese. We to a local shop, printed it, signed it, scanned it and sent it to the email they gave us.

    My question is, does anybody know how long til she gets the visa so we can think about booking our flights? I have to go back to USA mid-January. Also, I thought they would take her passport during the interview but they didn't. Will they contact her to get the passport?

  4. Hello,

    We have received notice for ustraveldocs and paid the fee for k1. We are in Thailand now for a vacation until Nov 26th and the only interview dates available are showing Dec 1-15. Would we have enough time when we get back to China to gather all the documents, get the medical exam, etc before Dec 15? Or should we wait until we are in China to schedule the interview?

    Also, we heard that in the package we need to present birth certificate and non-marriage certificate. Her parent's do not have the regional copy of the birth certificate. Can we only present a notarized document or do they need the original?

    It's hard for us to konw all the things we will need because we can't look at the packet until we schedule the interview?

  5. Ok people! We have the packet now. Well, not in hand (we're still hanging out in Thailand) but it arrived in China and my fiancee's mom took a photo of it.

    My congresswoman or somebody in her office called both state dept and USCIS on my behalf and that seems to have moved the case forward. Before it was stuck in a status where State Department said "Returned to NVC" and USCIS said "We have reaffirmed your petition and sent it back to State Dept, please contact State Dept"....

  6. We're going to see out the k1 process for now. If this falls through, I'll ping the forum to see about doing the DCF. I have been basically living in China since March. This is the first time I'm in the USA but just had to come back for some business. We also spent 2 months in Thailand for May/June 2016...

    How would I prove to them I have been living in China if I am just on a tourist visa?

  7. Also, to respond to what Randy said, to establish residency in China, I would have to get a job or something. How would I get a job if my plan is just get married and then move back to the U.S.?

  8. I actually spoke to somebody in my congresswoman's office today. They are sending me a form to fill out and then she said they will follow up with the department to see what is going on. If they get something moving on it, I'm definitely voting for her!!! Not that she needs my vote, she's way ahead in the polls.

  9. yeah, we are reading the some people had to fill out a new i-129f or get married in China and try to do a DCF. We talked about doing the DCF at first but I would have to establish residency in China for 6 months and there is no guarantee that it would get approved. We sit and watch with envy as others seem to get approved...

    My next step is probably to try to get through to a tier 2 representative at USCIs. Today, I talked somebody at my congresswoman's office and they are sending me a form to fill out so they can start case work for me. I'm not

    and see if I can get some answers. If we do another i-129f, I'm definitely hiring a lawyer....

  10. Funny you should ask. I just followed up again today. I called NVC and they said, "We sent it back to USCIS for review". I said "#######??? Why?" They wouldn't say. They said, "Call USCIS."

    I called USCIS and got a automated menu. I entered my case number and it says, "Your petition was sent back to USCIS on Aug 19 for review." Then it says, "Please allow 180 days for your case to be reviewed". 180 days?!?!? madness.... I will probably try to get a human on the phone at USCIS in a month or so, not sure what good it will do. I'm pretty sure if I got a human on the phone at this stage, they wouldn't tell me more than, "we receivied your petition back from State Department"

    Puzzling that they would send it back to USCIS without interviewing my fiancee. Maybe has to do with CCP membership? We don't know. The more we try to come up with logic to explain it, we realize we are battling a bureaucracy that abhors logic.

    Meanwhile, I'm going back to China next week. My fiancee got a visa for Taiwan and Thailand so we're gonna do some traveling while we're waiting. What else can we do? It's been frustrating but we're trying to enjoy our time together and explore Asia. Our love is strong so we'll make it through....

  11. Ok, we got a response from the embassy:

    Dear Visa Applicant,

    Thank you for your inquiry.

    Your petition has been returned to the National Visa Center on July 22, 2016 as per their request. Should you have any questions, please contact the National Visa Center.

    So we contacted NVC and all they said was that they received it back from the Embassy but wouldn't say why it was sent back or when it would be processed...

  13. I called and spoke to somebody, they said they haven't received the case back and that we need to call the embassy.... I'll have to call them on Monday.

    If our NOA2 says the petition expires on August 28th, does that mean if my fiance'e doesn't receive anything from the embassy we will have to re-apply???

  14. My income is high enough that there shouldn't be any questions but thought I would need the letter. We'll just print the scanned one.

    Did you guys really get a marriageability certificate? My fiancee said the chinese goverment stopped issuing it since late last year...

  15. yeah, we are getting the birth and police certificate this week.... Hopefully we will get the packet in a few days. Every time her phone wrings, I'm like "It's the packet!" :)

    We are printing out my tax returns from the last 2 years. Since I'm self employed, I don't have pay stubs.

    I have another question about Affidavit of Support letter from my bank, does it need to be original? I received a copy of the letter from my parents but it is a scanned copy. Should I ask them send the letter via DHL?

    All immigrant and K visa categories require an interview appointment. When an immigrant visa petition is approved and the applicant’s case is ready to be scheduled for an interview, beneficiaries will be contacted by the U.S. Consulate General Guangzhou by email Notice or Telephone with further instructions on how to schedule an appointment. If the Consulate has not notified you that your case is ready to be scheduled, you will not be able to access this function through CGI Stanley.


    Please take note: The Principal Applicant must interview at the same time as or before dependent family members. Dependent family members should not schedule their interviews before the Principal Applicant. If a dependent family member schedules their interview before the Principal Applicant, they will be turned away the day of their interview and told to wait until the Principal Applicant interviews first.

  17. @Chris thanks for your response! I have never seen that link for state department application status. I went over and looked at it and it says:

    Case Creation Date: 18-May-2016 Status Updated Date: 08-Jul-2016
    Your case is ready for your interview when scheduled at the U.S. Consular section. If you have already scheduled an appointment for an interview, please prepare your documents as directed in your appointment letter and appear at the consulate on the appointed date and time. Otherwise, please wait until you have been notified of your interview appointment. Additional information about how Immigrant Visa interview appointments are scheduled can be found at:

    Does it mean they sent the packet last week but we haven't received it? Does anybody know if it get sent by EMS, normal China Post or a courier?

    Don't think anything will change in the DS-160. Man, that thing is a pain. There's like 100 questions about "Are you coming to US to commit terrorists acts?"...
