  1. Hi!! I am trying to find the correct place to leave this topic but because I have approved I-130 and now dealing with NVC Perhaps my post best fits the NVC section..

    Ok so My issue of course trying to do all this on my own 8 months ago, I had read the obvious plans for the I-130 to the I-129F for a K3. And as it says only file one I-130 form which includes her children.. So Obviously I never realized that I should have filed 3 forms till My wifes form was approved..

    Now My Wife got a letter from NVC with a Reg Number etc and of course had we been going for a K3 we would be about 2 months away from my family being able to come here.

    However Now I am left having to file two more I-130 forms and waiting that out..

    So my question FIRST is.. Does the NVC have a timeline or a deadline in which I have to pay fees and folow through? Because now I will have to wait up to 6 MONTHS for my Kids i-130.. Is there any reason I can not just file the two more i-130s and wait for them to be approved and then move forward with the NVC ALL Three at the same time?

    Or will My wife's i-130 form EXPIRE???

    Also I was reading about expedited i-130s for a pregnant wife or conditions which cause hardship. Aside from the hardship I already experienced of having to pay for the support of my home in Hawaii And Asia.. The Obvious Hardship is the outdated directions implying to new partitioners that they can get a K3..

    So Could I expedite my two childrens i-130s based on the mistake of only realizing K3s are not an option after being approved for the i-130.. ?

    If I can expedite the two Children i-130s It should be a lot faster than six months. perhaps only 3.

    But still the BIG question for me is do I go ahead and complete my Wifes Visa which once approved she only has six months to enter USA which means I somehow wuld have to send her BEFORE The kids get approved..

    Hence the best Option would be to wait for the Kids I-130s approval and move forward with NVC with all 3 applications..

    However the issue is does my Wifes Visa partition Expire if I do not pay fees and ect ect?

  2. Hellow again, well today I find out some crappy news which at this point changes everything for me.

    Obviously when I was first reading dirextly from uscis website they still i struct you to file as follows, i-130 then i-129f for a K3.

    Was not till months later i find this forum and everyone telling me CR1 is the way to go.

    That would be fine if USCIS told me this in the first place and origional planning a K3,4 which USCIS tells you to file only 1 i-130 which includes her children.

    So its been over six months since my filing date, im expecting approval any day on the ONE I-130 and today i find out To get a CR1 i have to file i139 for all 3. Putting us another Year off.

    And to be honest its pretty simple at this point. I follow through with the K3,k4 in spite of the extra costs or I move to asia and forget about immigration to the us for a while.

    Its been nearly a year and i suppose it would not be so bad if theh could visit but planing to move to usa screws you for a tourist visa.

    So i am not quite clear if im being advised about the CR1 most people tell me I can NOT get a K3,4 visa anymore but then spend ten minutes explaining why the CR1 is cheaper and better.

    I still dont know if im being told that I can Not possibly file K3 or it just costs more.

    At this point my family and I are tored of the bs and if a K3 is not possible i e we now have to wait another 6 months for 2 more i130s forms while im expected to work and reflect income in the us and they are expected to wait in asia its just too much.

    It would have been fine if USCIS didnt have the Step by step information telling you to file EXAXTLY as I filed and only when I decide to hire a consultant do i realize i should have filed 3- i-130 forms.

    So honestly can i follow through with k3,4 or do i scrap it all and move to asia my self?

  3. Hope this is under the correct topoc. My i130 they tell me to expect the descision within 30 days.

    As for the remainder of tge CR1 process goes id like to hire a legal rep to handle it all for me. After reading all the little ####### 500$ is cheap to pay someone to handle it.

    I got quoted 450$ to handle my case from the point of approved i130 since i did that on my own to a CR1 for my wife n 2 kids.

    Iv been getting better info from this forum so id like to pay someone from this site.

    But can someone give me an idea how i start with them? As far as to i send them there payment and send them the funds for the visa fees or do i have to make money order out for each fee involved my self.

    Also assuming my i130 is approved this month what should i expect to pay in total to have a rep take over process from here for CR1 wife 2 kids?

  4. Aloha, Im waiting for my Visa for my eife and two kids. I visit Australia frequently and my wife is from Asia. Currently Countries like Australia have an Electronic Visa but only for first world countries. Its a bit of a pain in rump to get them a tourist fisa. Because they are from a third world country they request a visa in tgere country.

    Does this change when they move to US? For me being american its just 15$ and aboit a week. Does this ever change for my family?

    And at what point if any does my family get american passport?

  5. You guys are far the most reliable information iv found.

    The I129F might be a waste of time all together as im planning a CR1 anyway now that iv talked to you guys, and i filed the 129f 3 months after the i130 anyway. I130 only tequesting a photo.

    I129f has the criminal question but it says "if Yes include documentation" my answer is clearly "no".

    So looks like for i129f its just a photo and a "No".

    Ipl ho ahead and respond to both anyway for S and Giggles ;)

  6. Ok i figured it out! I got Two requests the same day i130 and 129f i Both cover letters "reminding" me about english translations Not requesting same documents.

    I must have forgotten the photo because Both are requesting a Photograph of Me, not wife or kids.

    I129f is requesting a photo and included is a form asking me about human trafficing and wife beating criminal history which i have none.

  7. Ok im not 100% clear on wth they want because obviously the one document that isnt in englisj is just one which i sid include both copy and translation.

    So the fromt page is asking for english translation and copy of document. But its not saying which one.

    However Page Two is asking for a passport style photo of me which I think I also included but its possible I did not include the photo before.

    Still a photo doesnt need an english translation. Further the next page is asking me about crimes mostly involving trafficing or womanizing which all of the above is NO.

    Why is this being asked now? Wouldnt this have been asked on i130 form?

    Do they send other i130 patitooiners this form asking about crimes which might involve prositiution and other trafficing related #######?

    Lol Im 40 years old first marriage absolutely first import of wife;)

  8. Guys Iv got another good Question. Currently if someone of a 3rd world country, my wife, my kids, wants a tourist visa for a 1st country its not an electric 2 week 15$ visa because they are from asia.

    At what point will my kids and wife wualify for a us passport? And or at what point will if ever, they be able to fill out the same online visas i get say when i visit australia?

Ok Giys I called USCIS this morning and it appears for at least the last 3-6 months the Nevraska office has been completing all i130s right on 6th months.For example Today the most recent completed patitions are September 2 2015. When they update the status they tend to be moving from the 2ed to 2ed of each month. Mine is October 20 so Before May 20 which is month 7, I should have a notice.

    So as of the last 3 months the Nevraska office is right on the six month. Give or take two weeks.

    Hind sight Im not sure whos reply I read that told me to call and find out how far away my priority date is but thats the best advice. If someone knows how to watch the progression of approved i130 forms by finding out the most recently completed forms they can keep a fairly good idea of when there forms should be processed.

    Obviouslt Id been told before how to look at the charts online but those are in most cases a couple of months old. I think for a person who is New to this and wants the most accurate time he can get, Beings everyone is trying to plan the next year of liveS according the what ever timeline they can find.

    The best option is to call, Id say monthly and keep track of which months had been completed. In Hind sight I remember seeing a few outdated pdf forms for timelines bus as i went from 2014-2015 and 2016 I can see the speed at which they completed forms and get a mush better idea of what to expect.

    Especially month 5 and six, if they simply call and ask which forms are being processed at the field office there form is in than they will know if they are a month or three away from having processing. Or at least as best as you can know.

    Its even more accurate tha trying to compare others who had approved months or the year before. It reflects whats going on right now. And fate can change and cause more delays but still thats the best odds of having a timeline you can arrange your life by.

    The only service in the world you can not expect perfection is any government or military. Again humor is the only reason I add this tid bit but Imagine our military contracts Haliburton for a laser guided cruise missiles and they better be perfect for those 20 million dollars but when they get mistake ly dropped on civilians the excuse is "well we are the best and we have the best but we cant be perfect"!!

    I read so much disinfo one said i didnt even need visa if married outside US just need embasy to notorize her as immedate familyk. I was pretty much married and completed my i130 and i129 before finding you guys.

    I think part of the things i didnt understand before is i was looking at the wrong field office for my timeline and now I realize its Nebraska.

    I think the timeline you posted when i asked before was after the i130 for the CR1 and that was a nice link you sent me it showed pretty much atep by step and made me realize i want to have an attorney prepare that one.

    So after i130 is approved ill pay someone to handle it from that point on. It appears the CR1 timeline after i130 is at least 4 months.

  11. All good replies and great info! I wonder if tgere is any accuracy to something i read today on another forum. Couple of people complaining about the exact same 7-9 month waits for i130 and one guy pointed out he calld USCIS and they tell him tge month cases they currently working on.

    So I found a PDF Nebraska office updated Jan 13 all i130 cases completed as of then where July2. That was nearly 3 months ago so maybe they are pretty close to October cases now.

    Tha ks guys Ill post some pics of us all in our beach home in maui when its over!!

  12. Well its not all family just wife and two kids. She still owns a home in Java and will maintain it as family lives there.

    But I was reading some other peoples posts who where pretty much griping for the same issue i have of taking 7-9 months or longer Nd I noticed a guy saying he calls USCIS and they tell him what months they currently processed.

    I looked up a screenshot of the processing for Nevraska office. It was updated Jan 13- and the recent completed cases where july2. Mine is only a couple of months behind that so At this point the idea to visit is probly a waste of time. I was considering the thing takes a year to get patition forwarded being october and as far as I can tell from that point it takes at least 4 months to get the CR1. So that means it could possibly be as long as about a year from Today. In that case Im either going to Asia or they are coming here. Lol

    But if they completed July back in Jan they should be quite close to October you think? Close enough that I probly should pay for 3 tourist visa applications.

    But another thought i was considering is some of the medical ####### for the tourist visa might later save time on the cr1 or would they do it all over? Just curious.

  13. Thank you. So the short answer is no? I mean we obviously have intent to stay here and it cant really be denies but the intent to come visit is honest. Im not out to screw up anything but iv got friends that get to visit on a tourist visa and my wife cant or it seems because our obvious goal is to have the CR1.

    I wonder if anyone has been approved to travel here on a tourist visa while waiting for the longer plan.

    I recently read I chose the longer rought by marrying abrad but thats how hard it is to pick and choose what info is accurate and whats not. I had read that it was better to marry in the other country faster greencard i also read they didnt need a visa because they where immedeate family. Obvioulsy when i started I began to learn more but its trial and error for most first timer i guess. No wonder people make a business out of it.

    So is there any logical way to bring them over for a visit? Are my odds pretty low for getting a tourist visa because we already plan to be here in long run?

  14. Aloha, Ok obviously like so many here my family is waiting for the next ice age for our i-130 its month 5 and reading that it could be a year before I hear back from them. I wonder why I didnt just get them tourist Visas to come spend a few months while we wait.

    So my Obvious concern is Can I go ahead and fill out a tourist visa for my wife and kids and bring them over for a few months. If we end up moving forward before the time expires we will fly back to asia and complete the CR1 process.

    I would go there and chill together but weve got an empty home on the beach in maui so obviously i can afford to have them visit. But I had read some possible dissinformation on forum before that as soon as i file i-130 it voids tourist visa i also read that filing for tourist visa will get my family black listed. So weven just figured wed wait it out but Id of never done that if i knew it could be a year just for the i130 patition. Its ridiculius.

    But now that I know itl be a while yet. Id like to know what i can do to bring them here Nd let them spend some time here.

    I did read for tourist visa they want you to show you have a reason to return to home country. She does have a residense but the obvious reason to return is to complete the CR1 visa process in Jakarta when that time comes. Truth is the only reason to return is to accomplish all that were working for.

    You guys have been the best most reliable providers of infor ation for me even better than Immigration website. So my frusteration comes from the fact that any of us have to do this. And i wont rant but I constantly hear "the government is not perfect" for example when we pay 420$ for a patition. Government gets multi million dollar contracts but i tend to wonder if a plummer fixed your toilet and took a month and his excuse was "plummers are not perfect" wpuld you fire him? Lmao.

    Its a concept iv had cross my mind lately as the ultimate excuse for putting people through unreasonable hardships. Even the least i portant trades are expected to sell a perfect product.

    Only me tion it because it has poetic justice and i figure some will get a snicker if you think a out it like that. ;)

  15. Good points bit i have to add if i didnt get so many mixed opinionsfrom this forum id of likely realized or heard a year at some point and modified my plans. Now i clearly stated before i was already marrird going for cr1 and people providid links timelines sowing 6 months or less. Some say 5 but had someone told me one year id not be here now. Thats the thing about this ####### is few seem to state fact and no answer is at all consistent.

    Sure as heck cant rely on uscis website for any information its all outdated. I filed both 129-f and i-130

    Waiting a year is fine. Waiting a year in usa while shes in asia is conplete bs and without crappy advice id of been there a few months ago.

    Thats not anyone in particular its just to note the complete inconsistency of this forum. Too many chiefs and not enough indians;) so to speak.

  16. I have no idea im tempted to bring her ### in through mexico. As far as i know to import my wife i need approval on i-130 before i decide which visa to apply for. A year is just stupid dont these idiots work for us? Wth kind of marriage can handle waiting paying for two hpuseholds for a freaking year?

  17. Hi, I looked on the USCIS page for the office I filed its timeline said 6 months or Less. Its about 40 days short of six months and iv heard nothing, check status still accepted October. I know they are not busy keeping illegals out so why so slow. Should i expect an update BEFORE April 20?

  18. OK Here is a better Exmample of what Im trying to ask. YES I understand that every single case is different. But saying 5 or 6 months for expected approval is NOT based on the actual Experience of Anyone who has answered this.. I mean here is the only forum in which I have seen better answers than YahooAnswers yet if I pose this question the quality of answers is no better than yahoo answers..

    Everyone is afraid to be strait up about this and more often refers me back to the Immigration website time frames..My point is the time frames are Not very often legit..

    Here is what I mean.. When I found this Forum one of the first things I saw was a Post from a Member who had recently Immigrated using a i-130. She posted her entire schedule and her i-130 was completed and APPROVED about 60 DAYS from the date on her I-797.

    So while everyone tells me the STANDARD Answer to this question.. I thinnk I already know it can take 5 months as the Immigration website says 6 months or less. Meaning it WILL NOT Take 6 months so 5 months and change or less.. So really what good does it do to tell me something I read 100 times on Immi.gov?

    When someone who has had there i-130 approved in 2015 Might have a much more accurate time frame.. Thus far nobody has told me less than 5 months with Exception of the one lady who posted Every date from her entire process.. She posted the dates showing her i-130 was approved in Late 2014 in about 60 days.. That being said aside from her,, I had NEVER seen a single person tell me that it CAN Happen in as little as 60 days..

    This was what I meant when I asked about the timeline based on EXPERIENCE NOT The standard!

    In fact I believe the lady who posted this had her entire Visa process completed in 6 months.. But obviously she has not replied to my post and everyone who has implies I will expect one year.. Ok obvious question why should I expect One year if some people very recently had completed all this in 6 months in spite of the standard timeline?

    Its just a question?

  19. That website tells you exactly the timeline for just about everything you need to do. It amazes me the PIA it is to find such information. For example Immigration still asking you to file an i-129F when it pans out to be a complete waste of time.

    I do have a question. I do not have my i-797 form for one reason or another, I do have the Number. And I did file an i-129F without it. But now I realize that form is a waste of time the obvious question is.

    Supposing the I-130 is approved in the next three months, At which point I am notified supposedly by the Visa office. Will I need to show the i-797 to them at that time? Are they going to request a copy of that recipt? And or do I recieve an approval notice for the i-130 which I can use?

    Because I was able to find that dfor a whopping 184$ I can request another i-797 recipt. According to customer service I wont need it, But after giving me the run around all he can really tell me is "If they need it, they will notify me when the i-130 is approved" Doesnt help much as it takes ANOTHER 3 months to get a duplicate of the i-797.

    Is the Visa center going to request a copy of the i-797? Or will I be fine without it?

    Lastly, I did not know what a pain in the ### the next process is. I notice there are places that will handle all of this for you not much more than the costs of the Visa fees. However I have already filed the i-130 months ago. So at or before the point of approval can I contract a firm to take this over for me?

    Any suggestions which one is good to use? Perhaps what I should expect to pay for arranging CR1?

    Thank you, Good replies this forum is very helpful I am going to point this out to a lot of people Immigration should put this on there page and remove there outdated instructions..

    There site tells you to file an i-130, THEN an i-129F but one clearly sees the time frame is backlogged for the i-129F. A person comes here and gets the real story.. There is always a text book answer and an experienced reality.

  20. When I have asked this quetion on yahoo answer before finding this forum Nearly every response is to direct me to the .gov website to see what they say on the time it takes. However 6 months or less is not at all telling from those who have experienced it. I want to say I am fully aware what they published however Id like to hear from people who went through this as close to recently as possible..

    My i-130 was dated October 20th. People say 3 months, The website says to check in after 60 days for status, The time frame says 6 months or less. But can anyone who has had the i-130 approved or know someone who has very recently tell me how long it is actually taking ;)? Its not like Im going to demand you refund me if my time frame is not exactly like yours.. lol

    One more question. After the I-130 is approved, I File another form for a CR1 Visa? How long is it taking people from third world countries, if that matters, To go from approved i-130 to the CR1 Visa?
