My wife's parents are arriving in the US in two months on IR5.  When I brought my wife over a few years ago, she was given a packet with all her documents that needs to be presented when she arrived at her POE.  However this does not appears to be the case anymore, has anyone done a IR5 entry recently and can share what the process was?  Is there still a separate waiting area to turn in the documents?  Or is everything now all automated and digitized they'll just enter like any other international traveler without the extra wait time?

    Right, I forgot to mention that our current W-2 will also be included but that's not what I'm asking.  What I'm asking is because it's been so long since the I-864 has been filed, should I include an updated version WITH information from the 2020 tax year on it since we have heard from people who recently had go through this in similar situation were asked to provide the newer tax transcript.

    My wife and I filed I-864 for her parents last year before all this bruhaha blew up (in early Feb).  And thanks to that the entire process of bringing them over from China grind to a halt for the entire year with all the consular services halted.  Now that things are starting to clear up and process is starting again, we're now hearing some people saying that at the interview they're requesting updated evidence of financial support information for 2020 tax year.  Our original form only has information for the 2019 tax year and I understand the need for the 2020 tax year transcript.  Now my question is, should I consider sending an updated and signed I-864 with updated 2020 tax year info to my in-laws for them to take to the interview or would just the tax transcript be sufficient?  I'm leaning towards sending them the updated form since I'd rather be over prepared than not.

Just need some clarification.  My wife is workingon bringing her parents over and I am filing as joint sponsor.  When filling out the I864 form in the section reagrding the individual income.  The instruction directs me to enter the value from our tax form.  However since we file married jointly, should I just enter our combined income on bot the 864 and 864A or do I need to figure out what each of our income is?

    The subject header may be misleading......

     

    When we filled out the DS-160 for my inlaws, we didn't know the birthdates for my inlaw's parents so we filled in as don't know.  However now that we're filling out the DS-260 to bring them over, we found documents that has their birthdates.  My question is should I just fill out the same as DS-160 as don't know or should I actually put their birthdates down?  My wife's worry is if the inconsistent data between the two forms would cause an issue when comes application review on their end.

I'm in the process of bringing my in-laws over and while I was filling out the I-864, I've run into some weird wording in one of the doc.  I am currently filling out separate application for both of my in-laws and on the I-864 part 3 question two it asks if I'm also sponsoring someone else other than the principle immigrant.  Should I list both of them on this form (since they ask not to include the other immigrant if filing a separate application) or leave this part blank and file a separate I-864?

    Now that my wife is officially a US Citizen, we're now on the next step to apply permanent residency for her parents.  However after going through the new I-130 (it has changed since I filed for my wife), I'm a little confused on does both of her parents need to have separate I-130 filed?  I'm assuming it's still necessary to list the other in their respective I-130 form?  Also, when filling out I-864, when counting household size, do I have to count both of them in each of their I-864 form?

    So while we're waiting for the 97billion years that takes them to process the I-751, we filed N-400 for my wife back in mid May.  She got finger printed and interview scheduled in less than a month from NOA1.  As of this past Wed, she's now approved for her citizenship (oh and had her I-751 approved at the interview lol) and her naturalization ceremony is next Wed.  The long road is finally coming to a close.

    My wife just got the same notification after sitting in limbo for almost a year.  Her case has been moved to the Texas Service Center (which is odd since all of mine and my other family members cases were handled by VSC).  Crossing fingers and hoping that this won't take much longer.

I filed it for my wife in March of '18 and we JUST received notification that it was forwarded to Texas (instead of Vermont, the service center that had processed mine, my mother, my sister's citizenship, AND my father's GC.  Not too thrilled with the estimated processing time.  I'm hoping that's not 16-20months from date after the paperwork is transferred there.....

    That's the category that your wife falls into as she is a conditional resident submitting the petition.

     

    You can resend the returned forms (assuming they are still the accepted editions, but I don't think they've changed recently).

    Its not selective reading.  The statement itself is somewhat misleading which is all too common in immigration documents.  I should've known better given the past process of getting her here.  Either way I'm resending the packet in the morning with the updated check.

  13. My wife's application for ROC was returned today citing insufficient application fee because we didn't include the biometric fee.  Now before people start saying I should've included that to begin with, let me cite the instruction:

     

    Quote

    2. U.S. Citizen or Lawful Permanent Resident Spouse. If you are the U.S. citizen or lawful permanent resident spouse, you do not need to include a biometric services fee at the time this petition is submitted. If USCIS later notifies you that you must submit your biometrics, you will receive a biometric services appointment notice with instructions on how to submit the additional fee.

     

    Since my wife falls under the above category, we didn't include the biometric fee.  But, that's not the question here.  My question is I'm going to resend the application tomorrow and I was wonder if I should send the original application back or should I print out another copy of the completed form.  There are some writings on the original application, but I don't want to send that and get rejected again or not send that and get rejected for not sending the original application again.  Has anyone else had this experience before?

    They probably do but not that they're gonna tell you.  The instructions are cryptic at best as i found out during this entire process.  The second issue was the interview agent wrongly told her that a scanned copy of the signed doc was sufficient when it was not.  This whole process to update the doc was further complicated by the fact that in China you can't just send the doc directly to the consulate but must go through a third party intermediary (which you have to go in person), and on top of that there are like only 6 places in the entire country where you can do expedited service (once again in person only).  Fortunately my wife had a friend who worked in the consulate in Shenyang where an expedited agent was also located.

     

    my wife has been in this country for a year now and we welcome'd our first child this past Feb.

    Sorry it took me until today to post a follow up. I wanted to let all of you know that we were able to get everything resolved and her visa came with two weeks to spare. She has now being in the US for about six months now and we're finally enjoying a true married life :D

    I wanted to share the story of what happened after we received the denial letter:

    We found out that you CAN'T send the document directly to the consulate but must go through a consulate approved document service provider at China CITIC bank. Normal processing time was around 7-10 business days BUT we found out that there are a few that offers express service with a 2-3 day turnaround. The downside to it was the closest brand that offers express service was in Shenyang 4 blocks away from the US Consulate (except they don't process any immigration docs, or it'd be too easy...). She happens to have a college friend who worked for the US consulate and I was able to DHL the letter to her in less than 4 days and had her drop the doc off at the branch. Once submitted it took about 2 weeks and we received the notification that her VISA has been issued and passport returned to her.

    She entered the United States on March 30th via Chicago after waiting in custom's line for over 4 hrs. I want to thank everyone who's helped answer my original question and I hope that my information here would help someone in the future that would run into the same issue.

  16. Hello all,

    So funny story here......my wife had her CR-1 interview about two weeks ago in Guangzhou. During the interview the interviewer asked for the original copy of the I-864 form but my wife didn't have it but had all my tax doc and a copy of the I-864. At the interview, the interviewer gave the approval for the VISA and took her passport and everything. Today I get an email from the consulate stating that her VISA application is denied pending further documents. To make things even more stressful, we went by the notion that she was given the clear by the interviewer so we have already bought tickets for her to travel to the US at the end of next month and she also turned in her resignation notice. My questions is has anyone run into this issue and what is the processing time once requested documents has been received by the consulate?
